This is unlike the Berry Amendment restriction on clothing (see 225.7002-1(a) (2)), which explicitly requires domestic source for the materials and components of clothing (other than unusual components such as sensors or electronics), as well as the additional separate restrictions on various types of fibers and fabrics that might be components of the clothing.

(4) If the acquisition of the hand or measuring tools is also subject to the Buy American Act (see FAR 25.1), then in order to qualify as a domestic end product, the cost of the components mined, produced, or manufactured in the United States or a qualifying country must exceed 50 percent of the cost of all the components of the hand or measuring tool.

(5) Buy American Act Notice: This acquisition is subject to the Buy American Act in accordance with FAR 25.1.

SECTION M - EVALUATION FACTORS FOR AWARD

M.1 BASIS FOR AWARD

M.1.1 GENERAL The Government plans to award a 5 year, Indefinite Delivery Indefinite Quantity (IDIQ) type contract for the General

Mechanics Tool Kit (GMTK) as a result of this solicitation. The Government reserves the right to make no award as a result of this solicitation.

M.1.2 It is the Government's intent to award a single contract. Contract award will be made using a Lowest Price Technically Acceptable

(LPTA) source selection process IAW FAR 15.101-2 (b)(1), which states award will be made on the basis of the lowest total evaluated priced proposal meeting the acceptability standards for non-cost factors. The Government intends to conduct a price evaluation on all offerors and then conduct a technical capability review of the lowest total evaluated priced proposal. If the lowest total evaluated priced proposal is determined to be technically unacceptable, then the Government will conduct a technical capability review on the next lowest total evaluated priced proposal. Unless the Government determines it is in its best interests to conduct discussions, the

Government will follow this process until the lowest total evaluated price, technically acceptable proposal is identified.

M.1.3 Award without Discussions: In accordance with FAR 52.212-1(g), the Government intends to evaluate proposals and award a contract without discussions with Offerors (this excludes clarifications as described in FAR 15.306(a)). Therefore, the Offeror's initial proposal should contain the Offeror's best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If discussions are held, they will be conducted with all offerors included in the competitive range. If conducted, discussions on pricing issues do not obligate the Government to discuss technical issues, nor do discussions on technical issues obligate the Government to discuss pricing issues.

M.2 REJECTION OF OFFERS

M.2.1 The Offeror must carefully read, and provide all the information requested in Section L. If there are parts of Section L that the

Offeror does not understand, the Offeror shall request clarification from the Contracting Officer no later than 10 business days prior to solicitation closing date. In accordance with FAR 52.215-1, contained in this RFP, the Government may reject any or all proposals if such action is in the Governments best interest. Examples include, but are not limited to the following:

M.2.1.1 When an Offeror's proposal merely offers to perform work according to the solicitation terms or fails to present more than a statement indicating its capability to comply with the solicitation terms and does not provide support and elaboration as specified in

Section L of this solicitation.

M.2.1.2 When an Offeror's proposal merely repeats the requirements stated on the drawings of Army TDPL 0627A0000:59678 without elaboration.

M.2.1.3 When an Offeror's proposal offers a product or service that does not meet all stated material requirements of the solicitation.

M.2.1.4 When an Offeror's proposal takes exceptions to the attachments, exhibits, enclosures, or other solicitation terms and conditions.

M.2.1.5 The proposal fails to respond to all items in SubFactor 1, Attachment 0001: Component List or SubFactor 2: Tool Chest, or fails to provide support with meaningful substantiating data, as specified in L.3.

M.3 EVALUATION PROCESS

M.3.1 Source Selection Authority: The Source Selection Authority (SSA) is the official designated to direct the source selection process and select the Offeror for contract award.

M.3.2 Source Selection Evaluation Board (SSEB): A Source Selection Evaluation Board (SSEB) has been established by the Government to evaluate proposals in response to this solicitation. The SSEB is comprised of technically qualified individuals who have been selected to conduct this evaluation IAW the Evaluation Criteria for this solicitation.

M.3.3 Determination of Responsibility

M.3.3.1 Determination of Responsibility and Eligibility for Award: Per FAR 9.103, contracts will be placed only with contractors that the Contracting Officer determines to be responsible. The prospective Offeror, in order to qualify as a source for this acquisition, must be able to demonstrate that it meets standards of responsibility set forth in FAR 9.104 including provisions for small business contained in 9.104-3(d) if applicable. In addition, the Government may assess the Offeror's financial ability to meet the RFP requirements. The Government reserves the right to conduct a Pre-award Survey on any or all Offerors (or its Subcontractors) to aid the

Contracting Officer in the evaluation of each Offerors proposal and ensure that a selected offeror is responsible. No award can be made to an Offeror who has been determined not responsible by the Contracting Officer. To ensure that the Offeror meets the responsibility criteria of FAR 9.101, the Government may:

a. Perform a Pre-award Survey or arrange a visit to the Offerors facility. The offeror's refusal to authorize the Government to visit

18 20

Name of Offeror or Contractor:

PIIN/SIIN MOD/AMD

the offerors facility may result in a determination that the offeror is not responsible.

b. Ask the Offeror to provide technical, production, quality, and financial information. If the Offeror does not provide the Government with the data as requested within 7 days from receipt of the request, or if the Offeror refuses to have the Government visit its facility, the Contracting Officer may determine the offeror to be not responsible. If the Government visits the offeror's facility, the offeror shall ensure that it has current data relevant to its proposal available for the Government to review.

M.3.4 Evaluation

M.3.4.1 This will be a Lowest Price Technically Acceptable (LPTA) source selection process in accordance with (IAW) FAR 15.101-2, as follows:

Each proposal will be evaluated to determine a total evaluated price, which will include an assessment of price reasonableness. An evaluation of the Technical Factor proposal on an Acceptable/Not Acceptable basis will only be conducted on the offeror with the lowest total evaluated price. In order to be considered for award, the Offeror's proposal must be rated Acceptable for 100 percent of SubFactor

1, Attachment 0001: Component List and SubFactor 2: Tool Chest SubFactor 2, Attachment 0003: GMTK Tool Chest Technical Information

Questionnaire (TIQ). Should the lowest total evaluated priced Offeror's proposal be assessed as Not Acceptable under any of the requirements cited in L.3, it shall be ineligible for award and the next lowest priced offeror's proposal may be evaluated, continuing until the lowest-priced offeror is found with a technically acceptable proposal. Offerors whose Technical proposals are rated Not

Acceptable may be notified at any time that their proposal will no longer be considered for award. Award will be made to the proposal with the lowest total evaluated price which was also rated Acceptable under the Technical Factor.

M.3.4.2 The Government reserves the right to conduct discussions in accordance with FAR 15.306 at any time during this process. If so, discussions will be conducted with all offerors determined to be in the competitive range.

M.4 VOLUME II: TECHNICAL FACTOR

M.4.1 Proposals will be evaluated on an Acceptable/Not Acceptable basis. This assessment will be performed using the substantiating documentation/data submitted in support of Attachments 0001 and 0003.

M.4.1.1 Evaluators will review data required by L.3. To be rated Acceptable under the Technical Factor, both Technical SubFactors must be found Acceptable, including any applicable technical support information. For the Tool Component List SubFactor, every individual item listed in Attachment 0001, with the exception of items listed in L.3.1.1, shall have a drawing number, a brand name, and a part number of the item included in the offer. For the Tool Chest SubFactor, each of the requirements listed in Attachment 0003 shall be addressed and substantiating data shall be assembled and submitted as a single Adobe PDF document.

M.4.1.2 The Government does not assume the duty to search for data to cure problems it finds in proposals. The burden of providing thorough and complete information rests with the offeror.

M.4.1.3 Exceeding Technical Requirements

The offeror will not be awarded extra credit for exceeding the technical requirements outlined in the technical specification Army TDP

0627A0000:59678 and Section L.3 of the solicitation.

M.5 Price Factor

M.5.1 The Price Factor evaluation will consider the Total Evaluated Price. The Price Factor will be assessed based upon Total Evaluated

Price to the Government to include an assessment of price reasonableness.

M.5.2 Reasonableness exists when the offered price does not exceed what would be incurred by a prudent person in the conduct of competitive business. The Government may make a determination of reasonableness by any means allowable under FAR 15.404-1.

M.5.3. Total Evaluated Price Calculation

a. The Total Evaluated Price shall equal the sum of the proposed prices for all CLINS as calculated in Attachment 0002.

b. For CLINs with range pricing, the Government will calculate a weighted average unit price by summing the unit prices proposed for each quantity range by the weighting percentages as stated in Attachment 0002. This weighted average unit price will then be multiplied by the estimated quantity to develop an extended price for each CLIN.

19 20

Name of Offeror or Contractor:

PIIN/SIIN MOD/AMD

M.5.4 Unbalanced Pricing. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items or ranges is significantly over or understated as indicated by the application of cost/price analysis techniques. Offerors are cautioned that a proposal the Government assesses to be unbalanced as to cost, may be unacceptable for award.
