Solicitation W52P1J-17-R-0066 Amendment 0001, Attachment 0010 Industry Questions and Government Responses Item: Navy Projectiles and Cartridges Demilitarization and Disposal

Industry Questions:

Question 1: Is the GFE currently residing at Crane in B105 going to be made available to any successful bidder for CLIN 1 and/or CLIN 2?

U.S. Government Response to Question 1: The only Government Furnished Equipment (GFM) for this effort is the equipment for the 16 inch projectiles that is outlined in Attachment 0009. If an offeror has interest in additional Government Equipment, the offeror would have to contact the depot where the equipment is and discuss a Public-Private Partnering arrangement.

Question 2: Is there a projected date for availability of the GFE for CLIN 3?

U.S. Government Response to Question 2: At this time, the U.S. Government does not have a projected date. It depends on how many awards are made for CLIN Group 3 and if the successful offeror(s) express a desire to use the GFE. If two awards are made and both offeror’s want to use the GFE, it will be made available within 6 months after contract award.

Question 3: Will the Government allow Contractors to make modifications to GFE for integration with Contractor provided equipment, in the event Contractor deems it necessary to provide a complete and safe process?

U.S. Government Response to Question 3: Government Furnished Property will be furnished in an “as is” condition IAW FAR 52.245-1. The GFE for CLIN Group 3 that is specifically offered in the RFP may be modified by the contractor. At this time, the U.S.

Government does not require that the GFE which is offered for CLIN Group 3 be returned to its original condition.

Question 4: Whose responsibility will it be to cover transportation and equipment installation costs of the GFE being offered?

U.S. Government Response to Question 4: The U.S. Government will cover transportation to the Contractor’s CONUS facility. Equipment installation costs are to be covered by the Contractor. GFE Interface issues, if any, are the Contractor’s responsibility.

Question 5: What is the plan for the GFE once the contract is complete?

U.S. Government Response to Question 5: In accordance with FAR 52.245-1(k), the U.S. Government intends to abandon the GFM in place after completion of this requirement. However, the U.S. Government reserves the right to request the GFE to be returned if deemed necessary.

Question 6: In the event a successful Contractor wants an accelerated production schedule within the specified option periods, will this be accommodated by the Customer?

U.S. Government Response to Question 6: A mutually agreed upon delivery schedule will be arranged once the Safety Site Plan and Ammunition Demilitarization and Disposition Plans are approved. Accelerated schedules will be accommodated to the best of our ability.

Question 7: Would the Government be willing to establish MGQs for all CLIN Group assets for "level playing field" pricing?

U.S. Government Response to Question 7: Refer to paragraph A.3 on page 3 of solicitation for MGA’s. The U.S. Government intends to award the full quantity for CLIN Groups 1 and 2 as the MGA (pending prices proposed). The U.S. Government cannot control offeror’s unit pricing, but is limited by funding available upon award. The U.S.

Government has not offered the Navy projectiles for demil in recent years and is uncertain of the unit pricing. Therefore, the U.S. Government chose to offer MGA instead of MGQ.

Question 8: Regarding Section H.1.3 Cumulative Orders, can the Government explain how this cumulative pricing mechanism works for CLIN Group 3? How does this work in a competitive environment?

U.S. Government Response to Question 8: Cumulative pricing will work the same for CLIN Group 3 as it does for CLIN Group 1 and 2. It will be priced based on what the offeror has been awarded during that ordering period. Contemplation letters will be issued to all successful offeror’s with a pricing spreadsheet to accommodate the different scenarios (such as single award vs. split award).

Question 9: Given that the MGA is defined in total dollars and not quantities by asset grouping, we believe that Group 2 lacks sufficient information to address every asset type in the IMP/IMS. Is the USG able to provide a best estimate for each asset quantity to use in our offer?

U.S. Government Response to Question 9: As stated in A.6, the U.S. Government intends to award the full quantity of what is currently in the demil stockpile for CLIN Group 1 and CLIN Group 2, pending funding available. Please refer to Attachment A002 Asset List for the specific assets to be demilitarized.

Question 10: Does the Government plan to provide the acquisition cost details of the GFE included in Attachment 0009 so a contractor can calculate the rental factors associated with using this equipment?

U.S. Government Response to Question 10: Acquisition cost for the control system is $250K, $300k for the material handling equipment and $300k for the high-pressure waterjet processing equipment. Total of $850K if an offeror wants to utilize all three modules.

Question 11: It is not clear to us whether rental factors associated with the use of GFE on each asset in Group 2 are required to be considered and added to the evaluated price. We believe factors for all assets should be developed and considered, even if items within a CLIN Group use the same equipment.

U.S. Government Response to Question 11: Yes, rental factors will be included for all CLINs that an offeror intends on utilizing Government Property for. Attachment 0001, Price evaluation Spreadsheet, includes a cell for use of Government Owned Property for each CLIN included in this RFP. Please refer to paragraph L.4.3 for evaluation of GFE rental charges for all CLINs.

Question 12: In Paragraph A.4 . The Closing dates for the RFQ for CLIN Group 1 and 2 are 15 February 2018 with an anticipated Award date of August 2018.

Further; Paragraph A.4.a indicates an anticipated 18 month facilitation period. We assume that the MGA is provided to assist contractors in facilitation costs is that correct or is the MGA part of the maximum dollar amount reflected in A.11 for the first delivery order?

U.S. Government Response to Question 12: The maximum dollar amounts are being removed. As stated in A.6, the U.S. Government intends to award the full quantity of what is currently in the demil stockpile for CLIN Group 1 and CLIN Group 2, pending funding available. Any future delivery orders would be for additional quantities that are added to the stock pile. At this time, we do not anticipate further quantities being added to the stockpile for these items.

Question 13: If the answer is that the MGA is part of the maximum dollar amount, is that correct considering that the statement in A.6. Is ''That the USG intends to award the full quantity of what is in the demil stockpile in the first delivery order".

CLIN 1 4032 Projectiles CLIN 2 20,311 Projectiles

U.S. Government Response to Question 13: As stated above, the maximum dollar amounts are being removed. Yes, the U.S. Government intends to award the full quantity for CLIN Groups 1 and 2 as the MGA (pending availability of funds).

Question 14: In that case for clarification the expectation by the USG is for the contractor to build the necessary facilities and develop processes and procedures to accomplish demil of all 4032 Projectiles in CLIN 1 for a maximum dollar amount of

$967,155.84 and the 20,311 projectiles in CLIN 2 for a maximum dollar amount of $5,169,906.56, is that right?

U.S. Government Response to Question 14: The maximum dollar amounts are being removed. The offeror’s price proposal shall include all necessary cost in its proposed unit prices.

Question 15: If there is an award in August 2018 paragraph A.10. Indicates that the first ordering period is Award date - day 364. Considering that the USG is giving the contractor an up to 18 month facilitation period with a demil start date of January 2020 why doesn't the paragraph show the 2 year demil performance period starting in January of 2020 for 2 years?

U.S. Government Response to Question 15: The Ordering Periods and Period of Performance are separate time frames. Ordering periods are when the U.S.

Government is able to execute additional orders. Period of Performance is how long the contractor has to complete the work for that order. However, the Ordering Periods are being changed to the following:

OP1 - Award date - 730 Days after Award (DAA)

OP2 - 731 DAA - 1095 DAA

OP3 - 1096 DAA - 1460 DAA (only applicable to CLIN Group 3) OP4 - 1461 - 1825 DAA (only applicable to CLIN Group 3)

Question 16: It will be necessary to receive clarification to these questions to be able to build the IMP and IMS and have that submitted IAW L.3.1.a as part of the submissions for CLIN 1 and CLIN 2 by 15 February 2018. Accomplishing that plan and schedule correctly based on your responses will have great impact on production requirements and our cost analysis for correct pricing on Volume 3. Would the government consider a 30-day extension for CLIN 1 and 2 submissions based on this very narrow window for response?

U.S. Government Response to Question 16: The Proposal submission date for CLIN Groups 1 and 2 is hereby extended to 2 March 2018 at 1:00PM CST. The due date for CLIN Group 3 remains 15 May 2018 at 1:00PM CST.

Question 17: If a contractor ultimately submits a proposal for CLIN Groups 1 and 2 and another proposal for CLIN Group 3 and since there is such a long time period from the orals for the first proposal (CLIN Groups 1 and 2) to the second proposal (CLIN Group 3). Would the USG consider giving the contractor 1.5 hours for each set of orals in that case? We do not believe that a total of 2.5 hours aggregate time is sufficient to allow for presentation concerning the different techniques needed to deal with the four munitions calibers of CLIN Group 2 and the completely different methodology imposed by the size of the 16" projectiles of CLIN

3.

U.S. Government Response to Question 17: Offeror’s will be allotted 1.5 hours per CLIN Group. If an offeror is proposing on CLIN Groups 1 and 2, they total allotted time will be 3 hours.

Question 18: Can the USG provide some sample pictures of the various items in current storage configuration? The level of effort in un-packaging and un-crating could have significant implication on manpower and costs.

U.S. Government Response to Question 18: The U.S. Government is working on getting pictures to provide. Once the pictures are available, another amendment will be completed and the pictures will be uploaded to FBO. Our goal is to provide the pictures no later than 21 February 2018.

Question 19: When will the restricted TDP's or Export Controlled TDP's be available? I have signed in and checked FBO and there is no new or additional link associated with the munitions items themselves only the GFM data and blueprints for the site visit help previously in Minnesota.

U.S. Government Response to Question 19: The TDPs were uploaded to the FBO link on 21 Aug 2017. The title is “PR #: 17R0066 17DML” and the zip file is called “17DML”. Access must be requested through FBO. Once access is granted offeror’s shall be able to download and view the technical information.

Question 20: Paragraph A.14 (renumbered as A.13) indicates that the GFM from Attachment 2 will commence 90 to 120 days after the approval of the Site Safety Plan. It is understood that all GFM received has to be destroyed I demiled within 12 months of receipt at the contractors facility. Shouldn't delivery of the GFM more closely tie into the start of Demil in January of 2020?

U.S. Government Response to Question 20: Paragraph A.14 will be changed to state the following: “The U.S. Government will initiate shipment of GFM within 90 to 120 days after approval of the Ammunition Demilitarization and Disposition Plans

(ADDP).”

Demil shall be started no later than Jan 2020. Once a contractor has the ADDP approved, history has shown demil shall be able to start within 90 to 120 days following.

Question 21: Section L.4.1.2 (Safety Sub-factor), under the submission instructions for the 50 slide Technical Volume, indicates, "The offeror shall submit a detailed Safety Site Plan." Is the intent of this that the offeror actually submit a Safety Site Plan included within the 50 slide limit? That the offeror submit a Safety Site Plan as a separate document? Or that the offeror simply demonstrate within their 50 slide Technical

Volume their understanding of and ability to comply with the requirements as stated in this section, with the actually Safety Site Plan due 30 days ACA per the CDRLs?

U.S. Government Response to Question 21: No, we do want a Safety Site Plan submitted. That will be required 30 days ACA IAW the CDRLs. Paragraph L.4.1.2, Safety Sub-factor, is hereby changed to the following:

“The offeror shall demonstrate its understanding of and ability to comply with the requirement to produce a Safety Site Plan in compliance with the applicable contractual and regulatory safety requirements including but not limited to the current DOD 4145.26 M and DODI 4140.62 (including International, Federal, State, and Local regulatory guidance) for the proposed CLIN Group, which is consistent with the proposed technical approach. Offeror will identify Safety Person(s) and a description of, indicating qualifications and experience (to include those relative to ammunition and explosives (AE)). Offeror will identify safety and AE-related training planned or completed consistent with the technical approach.”

Question 22: It appears there is conflicting information in the RFP regarding the number of contract references, which are allowed with each proposal. Section L.1.2.b states "up to five (5) contract references" while Section L.3.1.b states "up to three contract references." Can you please confirm whether the maximum allowable number of references is three (3) or five (5)?

U.S. Government Response to Question 22: Paragraph L.3.1.b should state “up to five contract references.” These contract references shall be submitted in accordance with paragraph L.4.2.2.g (up to three project/contract references based on its own performance and up to two additional project/contract references for each Joint Venture, partnership, or proposed major subcontract).
