Industry Day Questions ‐ W52P1J‐17‐R‐0066

1. When you state that some of the assets may have Comp A3 or Comp A5 fill rather than Explosive D, are you referring to different fill for the same DODIC?

Answer: Yes, it is possible that there are identical DODICs with different fills.

2. Can you specify which assets on the list have Comp A3 or Comp A5?

Answer: The U.S. Government is currently assessing the situation and plans to be able to identify which assets have which fill prior to award. However, due to the age and condition of these items, it is possible for the contractor to receive different fills than originally identified. These situations will be handle through a Report of Discrepancy.

3. We recommend that the USG consider setting aside an MGQ rather than an MGA, so that non‐ recurring costs associated with developing new processes and acquiring new tooling\equipment will only be charged once to the USG.

Answer: At this time, the U.S. Government believes the MGA is the best option due to many of the unknown factors (such as quantities and explosive fill) at this time.

4. Would it be more effective to segregate CLIN groups or perhaps an additional pricing tranche for the type of explosive fill (yellow D vs. pressed)?

Answer: One of the reasons the U.S. Government is holding the Industry Day is to gain input and suggestions on how to request pricing. From a contractor’s perspective, what do you propose as the best option?

5. Can we assume that a Small Business can compete for CLIN 1 and/or CLIN 2 considering that the USG intends to include a small business reserve for CLIN Group 3?

Answer: Yes, small businesses can submit proposals for any and all of the CLIN Groups. However, CLIN Group 3 is the only one that has a small business reserve.

6. Does the maximum Dollar amount (See Page 3, A.10) include the Minimum Guarantee Amount MGA from A.5 Page 2?

Answer: Yes, the MGA is included in the maximum dollar amount.

7. Metal Pallets: Does the USG have an approximate number of the assets being shipped on metal pallets, and if so, which DODICs would be shipped on metal pallets?

Answer: The U.S. Government does not know how many pallets will be metal and this information most likely will not be known until shipment occurs. However, when/if contractors receive metal pallets they shall notify the Contracting Officer and request disposition.

8. Past Performance Contract References: page 72 (L.1.2.b) allows for 5 and page 75 (L.3.1.b) for 3 contract references. Please clarify.

Answer: It should be three contract references in both places.

9. The Site Safety Plan (CDRL A003) is due 30 days after contract award. Page 77 (L.4.1.2. Safety Sub‐factor) requires that the offeror in the oral presentation submit a detailed Safety Site Plan demonstrating understanding and compliance with the applicable contractual and regulatory safety requirements.

a. Can we assume that the Oral Presentation shall address the understanding of the Site Safety Plan, but that the formal submittal is not due until 30 days after contract award (ACA)?

Answer: Offeror’s will be required to demonstrate they understand the requirements and processing of a Safety Site Plan through its oral presentation. A Safety Site Plan will not be required to be submitted until after contract award.

10. Oral presentation L.4.1.3. Environmental Sub‐factor. Page 77 (L.4.1.3. Environmental Sub‐ factor) requires that the offeror in the oral presentation submit a plan demonstrating the ability to comply with all International, Federal, State, and Local Environmental Regulations.

a. Can we assume that the Oral Presentation shall outline and address the understanding of the Environmental Regulations as described in L4.1.3, but is not required to submit a plan within the slide limit of the oral presentation?

Answer: This assumption is correct.

11. Why are there three CLIN groups that could result in potentially four contractors to manage? Is this feasible? Why setup multiple contractors and pay duplicate non‐recurring expenses and/or start up costs?

Answer: The U.S. Government wants to encourage competition and attempt to award to a small business. This is achieved by potentially awarding multiple contracts and by including a small business reserve. The U.S. Government believes there is sufficient quantity to satisfy multiple contractors and avoid a single point failure. However, it is possible for one contractor to be awarded all CLIN groups resulting in one or two contractors total.

12. Regarding CLIN Group 1, do you anticipate split awards for follow‐on ordering periods (after MGA) or will one contractor be selected?

Answer: At this time we do not know if follow on orders will be single award or split award, it depends on the requirement at that time. However, it will be identified in the contemplation letter if the U.S.

Government intends to make a split award or a single award.

13. Slide 17, based on the Acquisition Schedule on slide 24, is it possible to have the review/technical information sooner than October?

Answer: No, at this time the U.S. Government does not anticipate having the results until October at the earliest. Information will be provided as soon as possible.

14. Why does the U.S. Government have to do the shipping?

Answer: The assets are owned by the U.S. Government until the Certificate of Demilitarization (COD) is signed. Therefore, the U.S. Government handles all shipping until COD is signed for liability reasons.

15. If only one contractor wins CLIN Group 1, will the MGA increase to $6M?

Answer: No, the MGA will not increase if a single award is made. However, it is possible (on any of the CLIN Groups) that Delivery Order 0001 can be awarded at an amount higher than the MGA. At this time all the U.S. Government is guaranteeing is the MGA.

16. Can MIDAS information be provided in Microsoft Excel format at RFP release?

Answer: No, the U.S. Government intends on releasing the MIDAS information in PDF but will not be converting the information to Microsoft Excel.

17. Regarding the Small Business Reserve for CLIN Group 3:

a. What Small Business rules apply?

Answer: Offeror must be registered in System for Award Management (SAM) as a Small

Business for NAICS 332993

b. Does a Small Business have to perform more than 50% of the work?

Answer: Yes, a Small Business must perform at least 50% of the work.

c. Can a Small Business be prime and subcontract the majority of the work?

Answer: No, a Small Business must do at least 51% of the work. They may subcontract some of the work out as long as they are completing at least 51% of the work.

d. Will cost adjustment be made for a Small Business preference?

Answer: No, cost adjustments will not be made.

18. Is there a veteran set aside?

Answer: No, there is not a veteran set aside.

19. Are there specific Small Business percentage goals?

Answer: Yes, the Small Business goals are outlined on page 89 of the draft RFP.

20. Where can the DOD Regulations be found?

Answer: All DOD regulations can be found at the following link:

http://www.dtic.mil/whs/directives/corres/pub1.html. Under the “issuance” tab enter the DOD Instruction, DOD manual, or DOD regulation you are looking for.

21. Clause 52.232‐16, Progress Payments, paragraph (d)(4) on page 50 states, “The contractor may sell any scrap resulting from production under this contract without requesting the Contracting Officer’s approval, but the proceeds shall be credited against the costs of performance.” Based on this statement, does the U.S. Government expect scrap proceeds to be refunded to the U.S. Government?

Answer: No, the U.S. Government does not expect to be provided any scrap proceeds after contract award. However, it is anticipated that the cost savings based on scrap proceeds is reflected in the offeror’s proposed unit prices.

22. Can subcontractors present at the oral presentations as Subject Matter Experts (SMEs)?

Answer: Yes, if the offeror wishes to have the subcontractors present at the oral presentations as SMEs that is acceptable. However, if an offeror chooses to bring a subcontractor along but not have them present, this will count against the limitation for non‐presenters who are allowed to attend the oral presentations.

23. The Integrated Master Schedule (IMS) and Integrated Master Plan (IMP) are to be submitted as separate documents from the PowerPoint Slides. However, should these be discussed during the oral presentations?

Answer: The U.S. Government encourages all offeror’s to discuss the IMS and IMP during the oral presentations on a top level. The IMS and IMP will be evaluated separately.
