About this file
This is a Questions and Answers document containing responses to industry questions regarding a solicitation for logistics services at Fort Huachuca, AZ. The document addresses questions about the Collective Bargaining Agreement (CBA), wage rates, labor categories, workload data, facility locations, safety plans, and evaluation criteria.
Key clarifications include: the current CBA is effective from May 2021 through April 2025; submission deadline has been extended to January 24, 2025; no mission essential services have been identified; no Subsistence Supply Management Office workload is currently projected; and the government intends to award without discussions to the lowest-priced technically acceptable offeror with substantial confidence in past performance. The Q&A also addresses concerns about electronics technician requirements, fuel delivery services, and various facility operating hours.

And "Offerors (including Subcontractors shall use the CBA rates included with the solicitation (Attachment 0008) through the final year of the CBA and shall not include escalation through the remainder of the period of performance. As the CBA expires on 30 April 2025, Offerors (including Subcontractors) will continue to use the last applicable rate(s)in force (without escalating) for the remainder of the period of performance."
Article 1 - Recognition identifies the Union as the sole exclusive collective bargaining agency for all full time and part-time employees employed by the Company on the current Contract Number W52P1j-17-G-0096 for the purpose of work and other conditions of employment at Fort Huachuca, Arizona and whose job classifications are listed in Appendix “A”.
| The disclaimer in Attachment 0016 appears to be in direct conflict with L.5.4.12(a)(2) of the RFP and Article 1 of the CBA. Will the Government remove the language from Attachment 0016, which essentially removes the obligation to utilize the CBA and makes it strictly the offerors decision to chose between using the CBA or SCA when proposing positions? | The USG has provided additional CBA documents and revised applicable documents. |
| RFP L.5.4.2.12(a)(2) |
| Attachment 0008, Collective Bargaining Agreement | RFP L.5.4.2.12(a)(2) | L.5.4.12(a)(2) states, "As the CBA expires on 30 April 2025, Offerors (including Subcontractors) will continue to use the last applicable rate(s)in force (without escalating) for the remainder of the period of performance." The CBA only provides rates that are effective 5/15/2021. Is there a more current version of this CBA or an MOU that provides more current rates for 2024/2025? | The USG has provided additional CBA documents and revised applicable documents. |
| Attachment 0008, Collective Bargaining Agreement |
RFP M.5.3.6 RFP M.5.3.6 Article 13 of the CBA states, "The Company agrees to pay the Bargaining Unit Employees in accordance with the current negotiated pay rates as specified in Appendix A. Effective May 15, 2022, a position’s Wage Rate will be reviewed annually for wage limits that exceed Wage Determination (WD) amounts on the anniversary date of the CBA. The payroll period following May 15, 2021 and for each subsequent annual period the Wage Rate will be the greater of:
• The negotiated Wage Rate for the position as stated in Appendix A, or,
• The Wage Rate for the position as stated in the U.S. Department of Labor’s Service Contract Act WD for Cochise County, AZ where wages or health and welfare fringe benefits exceeds the current CBA rate."
| As the CBA provided with the solicitation documents only contains wages through May 2022, and no MOU or other document has been provided with more current rates, several labor categories in the CBA have wages lower than those in SCA WD. Will the Government confirm that proposal evaluations will ensure compliance with Article 13 of the CBA as stated in M.5.3.6, and that all offerors have complied with the language in the CBA? | The USG has provided additional CBA documents and revised applicable documents. | |
| Attachment 0008, Collective Bargaining Agreement | Article 13 states, "Effective May 15, 2022, a position’s Wage Rate will be reviewed annually for wage limits that exceed Wage Determination (WD) amounts on the anniversary date of the CBA." |
| As a more current version of the CBA, amendment, or MOU has not been provided to date, and there are several wages in the CBA that have been exceeded by the SCA WD, will the Government confirm that no amendment, MOU, or other more current document is in the possession of the incumbent contractor or the Union that should be included as part of this solicitation? | The USG has provided additional CBA documents and revised applicable documents. | |||
| Attachment 0016 CBA/SCA Crosswalk | L.5.4.2.12(a)(2), page 47-57 | There seems to be a discrepancy between RFP W519TC-24-R-0027,page 47-57, L.5.4.2.12(a)(2) and B08 Attachment 0016 - CBA-SCA Crosswalk, "Disclaimer" which states that "Offerors are not obligated to utilize the CBA positions identified on this SCA/CBA Crosswalk document. It is strictly the offerors’ decision on how to bid and what positions to bid in order to meet the requirements of the subject solicitation." Please provide clarification if the offeror is to use the CBA or SCA for those positions. If an offeror chooses SCA positions based on the Service Contract Act (SCA) Directory of Occupations (5th Edition) , but the SCA position is included in the CBA/SCA crosswalk, is the offeror required to use the CBA rate for the direct rate of that position or can the offeror use the WD as the direct rate for the SCA position? | The USG recommends the offeror follow the instruction as defined in the solicitation L.5.4.2.12(a) (2). | |
| Attachment 0026 - TD-02 Workload and Density List | Is it the Government’s intention that the Estimated Productive Hours provided on Attachment 0026 – TD02 Workload Data and Density List is what bidders should use as the Minimum hours to bid in each functional area to level the playing field? | The USG provided estimated functional hours not minimum hours. The offeror should proposed based on L.5.2.1.1(c) (6) (v) and M.5.1.2(c) (1). | ||
| ATT0021 | We noticed that there was no Attachment 0021 is not included in the solicitation documents. Will the Government confirm that PWS Annex E is part of this solicitation? If it does apply, will the Government please provide Attachment 0021. | Document was uploaded to SAM.gov on 12/10/24 and ALL BOA Holders were informed of this on 12/10/24 via email. | ||
| ATT0027 TD-03 | We noticed that TD-03 Supported Organization document is password protected and bidders cannot open it. Will the Government provide an unprotected TD-03. | Document was NOT password protected, there was a "sensitivity" setting that needed to be changed. This was changed and the updated attachment was provided with Amendment 0001. | ||
| ATT0032 TD-11 | We noticed that TD-11 Fuel Delivery to Emergency Back-up Generators and Vehicles is not included in the solicitation documents. Will the Government confirm that PWS TD-11 is part of this solicitation? If it does apply, will the Government please provide TD-11. | Attachment 0032, TD-11 Fuel Delivery to Emergency Back-up Generators and Vehicles was provided via DoD SAFE to all BOA holders. | ||
| ATT0005 Cost Price Matrix | We noticed the Cost Price Workbook was unable to refresh and could not update values from a linked workbook that is not accessable by bidders. When clinking on Tab 1a, it appears that the workbook is password protected. Please correct Attachment 0005. | Attachment 0005 Cost Price Matrix is, and will remain, password protected. The ONLY cells offerors need to input information into are those cells highlighted in blue, all others are inaccessible to offerors. Refer to RFP L.5.4.2.3, L.5.4.2.3.1(d) | ||
| RFP | L.5.3.5.1 | Will the Government conider allowing past incumbents to use their Past Performance from EAGLE FT Huchuca. Under the current instructions and evaluation criteria, we can not use it. Our logic is the contract period is 5 years in duration, no prior incumbent's past performance would be deemed 'recent' under the current instructions. We believe this is extremely restrictive since we were the prior incumbent and our experience/past performance is relevant and recent. We are asking the Government to allow previous incumbent's to use their past performance or defining recent as 'within the past 5 years.' | The Government does not intend to modify the EAGLE Evaluation Criteria in this manner, at this time. | |
| RFP | M1.1 | The Government expects to award a single combination Cost Plus Fixed Fee/Firm-Fixed Price (Transition-In CLIN and PMO CLINs only) task order with 1, 12-month base period, to include a 30-day transition, 4, 1-year evaluated option periods, and 1, 6-month evaluated | ||
| option period with this RFP. The Government will make an award to the responsible Offeror (IAW FAR 9.1) whose proposal complies with the RFP requirements and is determined to be the lowest total evaluated (fair and reasonable) priced proposal that is determined to be Technically Acceptable with Substantial Confidence in Past Performance. If a company elects to not submit Past Performance and receives a 'Neutral' rating, can they still be awarded the contract since M1.1 states with 'Substantial Confidence in Past Performance.' | An Offeror not providing any past performance references does not necessarily dictate a "Neutral Confidence" rating. Per M.5.2.1 of the RFP the Government will asses "...other information available from sources other than those identified by the Offeror..." | |||
| RFP, SF33, Block 9 | Given the possibility of additional information as it pertains to the CBA and when industry may receive responses to submitted questions, will the Government consider extending the submission deadline by one week? | Submission deadline is extended until 24 January 2025, per amendment 0003. | ||

| Attanchment 0026 TD-02 | Attachment 0026 has two (2) Maintenance "Non-ASC" tabs: CLIN 3BA - Non-ASC ATEC-EPG and CLIN 3CA - Non-ASC ISEC. The Maintenance Indirect Tab repeats and confirms these CLINs; however, Attachment 0005 lists CLIN 3BA as "ASC FSE Equipment" and CLIN 3CA as "Non-ASC-EPG." Further, FSE does not appear to be in the PWS. Will the Government please clarify the requirement and corresponding attachments? | Attachment 0005 was updated | ||
| RFP, page 1, block 9 | Upon receiving answers to questions and any other revised solicitation documents, would the Government please allow offerors to have at least three (3) weeks to review and incorporate all Amendment changes by way of an extension to the proposal submission date? | Submission deadline is extended until 24 January 2025, per amendment 0003. | ||
| RFP L.5.3.1.1(c); L.5.3.1.2 | IAW L.5.3.1.1(c) the definition of a Subcontractor for the Past Performance Factor states, "Subcontractor(s), as used in the Past Performance factor, means those who are expected to perform 20% or more of the Offeror's total estimated dollar value as found in column F of the Offerors Cost Price Matrix (Attachment 0005, Tab 2-Teaming Matrix) or who are expected to perform a critical performance task." Using this definition, to ensure compliance with L.5.3.1.2 and L.5.3.1.2 (d), should offerors only provide a Letter of Consent, Attachment 0004, for those subcontractors performing 20% or more of the Offeror's total estimated dollar value or a critical task, or should offerors provide a Letter of Consent for all subcontractors, regardless of their work percentage and tasks? | All offerors shall provide a letter of consent for all subcontractors performing 20% or more. | ||
| RFP L.5.3.1.1(c); L.5.3.5; L.5.3.5(c)(4) | IAW L.5.3.1.1(c) the definition of a Subcontractor for the Past Performance Factor states, "Subcontractor(s), as used in the Past Performance factor, means those who are expected to perform 20% or more of the Offeror's total estimated dollar value as found in column F of the Offerors Cost Price Matrix (Attachment 0005, Tab 2-Teaming Matrix) or who are expected to perform a critical performance task." Using this definition, to ensure compliance with L.5.3.5 and L.5.3.5(c)(4), should offerors only provide a Performance Questionnaire, Attachment 0003, for those subcontractors performing 20% or more of the Offeror's total estimated dollar value or a critical task, or should offerors provide a Performance Questionnaire for all subcontractors, regardless of their work percentage and tasks? | Offerors should provide a Performance Questionnaire for all subcontractors regardless. As stated in Section M.5.2.6 Past performance for parent/sister companies or other corporate entities may be evaluated only if these companies or entities are listed as subcontractors on |
the Offerors Attachment 0005-Cost Price Matrix, Tab 2-Teaming Matrix and are expected to perform 20% or more of the total value of column F in the Offerors Attachment 0005-Cost Price Matrix, Tab 2-Teaming Matrix.
| RFP, L.1.2 | L.1.2 states, "In accordance with (IAW) FAR 52.215-1, Instructions to Offerors - Competitive Acquisition (Jan 2017), the Government intends to award a contract without discussions. Offerors are cautioned to examine this RFP in its entirety and to ensure that proposals contain all necessary information, provide all required documentation, and are complete in all respect. The Government is not obligated to make another request for the required information nor does the Government assume the duty to search for data to cure problems it finds in proposals." As the Government has opened discussions with offerors on all recent EAGLE solicitations, changing its intent to award without discussions, would the Government update Section L and M language to appropriately reflect its intent to conduct discussions? | The intention is to award without discussions; however, if opening discussions is determined to be in the best interest of the Government, the Government reserves the right to open them. The Government will not update Section L language regarding discussions at this time. | ||
| RFP, L.1.2 | L.1.2 states, "In accordance with FAR 15.306(c)(2), if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. Any Offeror eliminated from further consideration will be notified in writing." The Government appears to have moved toward a trend of opening discussion on all EAGLE RFPs regardless of the size of the effort. Will the Government consider revising this language to state its true intentions? | Each Solicitation is unique, and discussions are opened at the discretion of the Government. Section L Language will not be updated at this time. | ||
| RFP, L.1.2 | If technical evaluations are pass/fail, can the Government clarify how it determines the "most highly rated proposals"? | IAW M.4.1, Technical Evaluations are conducted on an Acceptable/Unacceptable basis. See M.5 on Evaluation Criteria. | ||
| RFP, L.1.2 | Will the competitive range be established after reviewing all proposals to determine technical acceptability and then identifying the "highly rated" proposals, or will a down-select process occur before this analysis? | |||
| Competitive Range is established if and when the Government determines opening discussions is in the Governments best interest. See M.3.2, M.4.4.1 and M.4.4.2 regarding Evaluation factors. | ||||
| RFP, L.1.2 | If a down-select process is conducted, how will the Government ensure that only the most highly rated proposals are included in the competitive range? | |||
| See M.3.2, M.4.4.1 and M.4.4.2 regarding Evaluation factors. | ||||
| RFP, L.1.2 | What measures are in place to prevent Offerors from understaffing to be included in the down-select numbers despite not being among the most highly rated after a full review of all proposals? | See M.3.2, M.4.4.1 and M.4.4.2 regarding Evaluation factors. | ||
| RFP, L.1.2 | FAR 15.306 - Competitive range. (1) Agencies shall evaluate all proposals in accordance with 15.305(a), and, if discussions are to be conducted, establish the competitive range. Based on the ratings of each proposal against all evaluation criteria, the contracting officer shall establish a competitive range comprised of all of the most highly rated proposals, unless the range is further reduced for purposes of efficiency pursuant to paragraph (c)(2) of this section. | |||
| While the RFP language and FAR provide the Government the ability to reduce the number of proposals in the competitive range, recent EAGLE discussions suggest that the competitive range may be expanding. Could the Government clarify how many offerors it intends to include in the competitive range and how this approach aligns with the goal of promoting efficient competition? | Each Solicitation is unique, which means the establishment of a competitive range is unique to each specific situation. | |||
| M.4.4.1 and M.4.4.2 | M.4.4.1 and M.4.4.2 state that discussions will be conducted "IF AND ONLY IF" specific conditions are met. Can the Government clarify under what circumstances discussions are most likely to occur and whether there are any scenarios where discussions might be conducted at the Contracting Officer's discretion? | If discussions are to occur, a competitive range will be established based on ratings of each proposal against the evaluation criteria. | ||
| M.4.4.1 and M.4.4.2 | As the FAR requires that only the most "highly rated" proposals be included in the competitive range, could the Government provide clarification on how the Step process will proceed if discussions are conducted? | Discussions, as needed, can be conducted while in Step 1, Step 2 or both during the evaluation process. | ||
| M.4.4.1 and M.4.4.2 | Will the Government revisit the compliance check, evaluate all Offerors for compliance, and review all technical proposals before establishing the competitive range? | Competitive Range is established before revisiting strict compliance check to any revision to an offeror's proposal. Subsequently followed by another round of Step 1 evaluations. | ||
| M.4.4.1 and M.4.4.2 | Given that "Cost/Price proposals will not be assigned an adjectival rating," can the Government explain how the process outlined in M.3.1 aligns with FAR requirements? | When proposals are received, USG lists Offerors lowest to highest total proposed price. Followed by a Strict Compliance Review. IAW M.3.2 five or 20% (whichever is greater) will move forward to Step 1. | ||
| M.4.4.1 | M.4.4.1 indicates that only Offerors deemed Technically Acceptable will proceed to Step 2 evaluations. With this pass/fail methodology, will the Government clarify how a technically unacceptable offer can be included in the competitive range and be authorized to receive discussion questions? | IAW M.4.1 the lowest three total proposed offerors move onto Step 2. If, there is not sufficient competition due to Offerors being found Technically Unacceptable, all Offerors who have passed the Strict Compliance Review and moved onto Step 1 will receive discussion letters. Offerors with identified deficiencies will receive Evaluation Notices to address deficiencies in order to maximize competition. | ||
| M.4.4.2 | M.4.4.2 explains that the competitive range determination after Step 2 evaluations will be based on qualitative confidence ratings for Past Performance and price reasonableness for Cost/Price factors. Can the Government clarify what level of Past Performance confidence rating (e.g., "Satisfactory" or above) will generally be considered "highly rated" for inclusion in the competitive range? | |||
| Per the RFP a Substantial Confidence rating. | ||||
| M.4.4.2 | As an award will be made "to the Offeror determined to be responsible IAW FAR subpart 9.1 whose proposal conforms to the RFP requirements and is determined to be the lowest evaluated (fair and reasonable) priced proposal that is determined Technically Acceptable with Substantial Confidence in Past Performance" will past performance be included in the "highly rated" proposals for the competitive range? | |||
| Competitive Range is established if and only if discussions are conducted. Confidence Ratings are assigned for Past Performance during Step 2 evaluations for lowest three technically acceptable offerors that were moved on from Step 1. | ||||
| M.4.4.2 | M.4.4.2 mentions that proposals not requiring a major rewrite will remain in the competitive range. Could the Government provide examples or criteria for what constitutes a "major rewrite" versus acceptable minor revisions? | The Government cannot provide examples. Decision if something is a major or minor rewrite is made on a case by case basis. | ||
| M.4.4.3 | M.4.4.3 defines deficiencies, significant weaknesses, and uncertainties. If a proposal has minor uncertainties or weaknesses that do not rise to the level of a deficiency, will the Government provide Offerors the opportunity to address these issues during discussions, should discussions occur? | Depends on the weakness/uncertainty, falls into a case-by-case basis. IAW FAR 15.306(d)(3) the Contracting Officer is not required to discuss every area where the proposal could be improved. | ||
| RFP Section M | How will the Government ensure consistency in the application of qualitative ratings for Past Performance and the evaluation of Cost/Price factors, given the absence of adjectival ratings for the latter? | The Government will only award to an Offeror that recieves a substantial confidence in Past Performance with the lowest Total Evaluated Price. |
