Specification 070150.19 Section 1.6 Quality Assurance Section B Reroofing Conference subpart 2 (k) calls for a review of a shut down of the fire-suppression, protection, and alarm detection systems. Should the contractor anticipate the gov’t wanting the fire suppression system shut down during the duration of construction activities?

RFI 16

We have a question regarding some of the language in the solicitation document (W50S8R-25-B- A001) that looks a little bit different than what our proposal coordinator is used to seeing. I believe what it is asking us to do is acknowledge or include:

• FAR 52.212-3(c) Representation completed and signed.

• FAR 52.219-1(c) Representation completed and signed.

• SBA Mentor-Protégé Agreement attached.

• SAM registration confirmation included.

• SBA size determination (if applicable) included.

One of the requirements in the solicitation is Pro Forma Documents, an executed copy of the Joint Venture Agreement and then it says a small business JV must submit a certain FAR clause. Please see language below. Is this asking us to submit something separate than our reps and certifications? If so, can you please specify exactly what document we are supposed to fill out in order to comply with the language below? In our past experience, we have just had to acknowledge all of the FARS referenced in the solicitation by a signature on the solicitation. Is that what this is asking us to do?

This is the language I am referring to, that I have copied, highlighted, and pasted below, straight from the solicitation.

5. Joint Venture Requirements

(a) Parties wishing to propose as a joint venture must submit, with the Pro Forma documents, an executed copy of the joint venture agreement. The joint venture agreement shall be executed in accordance with FAR 4.102(d). Each joint venture partner shall submit evidence satisfactory to the Contracting Officer that its Board of Directors has approved its participation in the joint venture or by an instrument of similarly binding character in the case of an unincorporated entity. Offerors are reminded that to obtain an award the awardee, to include a joint venture, must be registered in the System for Award Management (SAM) database. Applicable to set-aside solicitations: Joint Ventures must meet applicable size standards (See FAR Subpart 19.1). Submit with the proposal any size determination for the Joint Venture entity received from the Small Business Administration. A Joint Venture where-in one party is not a small business maybe referred to the Small Business Administration (IAW FAR 19.302 (b)) to determine eligibility. All questions regarding Joint Ventures must be directed to the Small Business Administration (SBA) and not the Contracting Officer.

(b) A small business joint venture offeror must submit, with its offer, the representation required in paragraph (c) of FAR solicitation provision 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services, and paragraph (c) of FAR solicitation provision 52.219-1, Small Business Program Representations, in accordance with52.204-8(d) and 52.212-3(b) for the following categories:

(A) Small business;

(B) Service-disabled veteran-owned small business;

(C) Women-owned small business(WOSB) under the WOSB Program;

(D) Economically disadvantaged women-owned small business under the WOSB Program; or

(E) Historically underutilized business zone small business

RESPONSE: If you are submitting as a joint venture (JV), then Yes, it says what you need to submit, and those documents you will need to submit (ensure you are paying attention to all instructions related all other documentation/information necessary to submit a complete bid package). When completing 52.219-1, completion of that representation will verify your business meets the size standard for applicable NAICS code for this project. If the SBA Mentor-Protégé documentation has signatories of the required parties (as listed in instructions), then verify that document meets the requirements. Proof of SAM registration is not required to be submitted, as that shall be verified by the Contracting Officer after bid closing (it states to ensure your company is registered). Note Section 00 10 00 Notes, part 4(d), regarding completion and submission of applicable representations and certifications.

RFI 17

Is steel acceptable for the guardrail fall protection? The specs differ from what is called out on the drawings a bit. Are rails acceptable or pipe and fitting only? Is the government open to going to a more cost-effective guardrail system that sits on the roof rather than being installed to the deck as the drawings stand?

RESPONSE: Both the specifications (Section 05 52 13 2.4) and drawings (Sheet A504, Guardrail Details) specify aluminum, not steel, for the guardrail system. Clarification is required, as to what is meant by “Are rails acceptable or pipe and fitting only?” Sheet A504 has the details for the guardrails.

RFI 18

Is the governments intent on the fall protection lines to be horizontal lifelines or just anchors?

RESPONSE: Reference drawing sheet A103, Fall Protection Diagram, fall protection anchor points and guardrails are both included in this project.

File details come from the government source that posted it. Updated .
