About this file
This is a Vendor Preference Certificate issued by the State of West Virginia in accordance with West Virginia Code 5A-3-37, applicable to non-construction contract opportunities. The certificate establishes a framework for qualifying vendors to request residency-based preference at the time of bid submission. The document does not specify particular products, services, quantities, response dates, or award timelines, as it serves as a general application form for vendor preference eligibility rather than a specific contract solicitation.
The certificate outlines multiple preference categories and corresponding preference percentages awarded based on vendor qualifications. Vendors may apply for 2.5% preference if they are individual residents with four continuous years of West Virginia residency, or if they are partnerships, associations, or corporations with four continuous years of headquarters or principal place of business in West Virginia, or if 80% ownership is held by qualifying resident vendors. An additional 2.5% preference applies to resident vendors certifying that at least 75% of project employees are West Virginia residents with two years continuous residency. Nonresident vendors may qualify for 2.5% preference if they employ a minimum of one hundred state residents or maintain an affiliate or subsidiary in West Virginia meeting employment thresholds. Veterans qualify for 3.5% preference under specified residency and employment conditions. Vendors meeting multiple criteria may receive up to 5% preference. Additionally, non-resident small, women- and minority-owned businesses certified by the Purchasing Division may apply for preference. The Secretary of Revenue may impose penalties up to 5% of the bid amount against vendors who fail to maintain preference eligibility during contract performance.
