About this file

This is a Vendor Preference Certificate form issued by the State of West Virginia that outlines eligibility criteria for vendors seeking preferential consideration in state procurement processes. The certificate is applicable to all procurement types except construction contracts and allows qualifying vendors to request preference at the time of bid submission based on their residency status or business characteristics. The preference is applied solely as an evaluation method to the cost bid in accordance with West Virginia Code 5A-3-37, with the Purchasing Division responsible for determining vendor preference eligibility and applicability.

The document establishes seven distinct preference categories with varying preference percentages: a 2.5% preference for resident vendors or partnerships with four years of continuous West Virginia headquarters operations; a 2.5% preference for vendors certifying that at least 75% of project employees are West Virginia residents with two years of continuous state residency; a 2.5% preference for nonresident vendors with West Virginia affiliates or subsidiaries employing a minimum of 100 state residents meeting the 75% employee residency requirement; a 5% preference for vendors meeting multiple requirement categories; a 3.5% preference for individual resident veteran vendors with four years of continuous West Virginia residency; a 3.5% preference for resident vendor veterans with 75% resident employee representation; and preference eligibility for nonresident small, women-, and minority-owned businesses certified by the Purchasing Division. Bidders must certify under penalty of perjury that all information provided is accurate and agree to notify the Purchasing Division immediately of any changes during contract performance. The Secretary of Revenue may reject bids or assess penalties up to 5% of the bid amount if bidders fail to maintain preference eligibility requirements.
