About this file

This is a Purchasing Affidavit form issued by the State of West Virginia Purchasing Division that establishes eligibility requirements for vendors seeking to contract with the state and its political subdivisions. The affidavit mandates that no contract or renewal may be awarded to any vendor or related party that is a debtor in an amount exceeding one thousand dollars in the aggregate or that is in employer default, with limited exceptions for vendors who have contested taxes, workers' compensation premiums, or permit fees and remain current on any established payment plans.

The affidavit requires the vendor's authorized signatory to affirm under penalty of law that neither the vendor nor any related party owes qualifying debts or is in employer default as defined in West Virginia Code 5A-3-10a. "Related party" is defined broadly to include any individual, corporation, partnership, or entity related to the vendor through blood, marriage, ownership, or contract where the party receives or controls a benefit or profit meeting or exceeding five percent of the total contract amount. The form must be notarized and signed by the vendor's authorized representative before submission to the state.

PURCHASING AFFIDAVIT

MANDATE: Under W. Va.
