About this file

This is a Veterans Business Program (VBP) Waiver Request and Review Form established under the Illinois Procurement Code and administered by the Illinois Department of Transportation (IDOT) in conjunction with the Commission on Equity and Inclusion (CEI). The form is designed to document good faith efforts by prime vendors to solicit and negotiate with certified veteran-owned and service-disabled veteran-owned businesses when such participation cannot be achieved. The state of Illinois has established a statutory goal of awarding not less than 3% of total state contract dollars to VBP-certified vendors, and bidders requesting a waiver from this requirement must provide comprehensive documentation of their outreach and negotiation attempts.

The waiver request process requires prime vendors to demonstrate multiple compliance elements, including evidence that certified vendors were given sufficient time and information to respond to solicitations, documentation of good faith negotiations with VBP-certified firms identifying specific vendors approached and reasons agreements could not be reached, and confirmation that efforts were made to break work into economically feasible units suitable for veteran-owned business participation. Completed forms must include prime vendor authorization statements, purchasing entity reviews and recommendations submitted to the assigned Compliance Officer, and final CEI Deputy Director determinations. Failure to complete and include a VBP Utilization Plan with adequate documentation may render a bid or offer non-responsive. The form applies to procurements under the Chief Procurement Office for Capital Development Board and Chief Procurement Office for Higher Education, with final approval and filing managed through CEI.
