About this file

This is a BEP Waiver Request and Review Form issued by the State of Illinois, Commission on Equity and Inclusion (CEI), applicable to the Illinois Department of Transportation's Freight Data & Forecasting solicitation. The form serves as the official submission vehicle through which bidders and offerors request a full or partial waiver from the Business Enterprise Program (BEP) goal requirements. The solicitation is subject to a 13% BEP goal and a 3% VBP goal. Bidders must complete all ten requirements of the BEP Act in detail to obtain CEI-approved waiver consideration, demonstrating their good faith efforts to identify and solicit participation from certified vendors. The form requires bidders to document their outreach timeline, communications with certified vendors (including dates, times, and methods), negotiation efforts, cost comparisons, and historical use of minority-owned, women-owned, and disability-owned businesses in current and prior fiscal years.

The waiver request process involves multiple review stages, with the bidder completing Section I and II, the purchasing entity providing review and recommendation in Section III, CEI Compliance staff conducting their assessment in Section IV, and the CEI Deputy Director issuing final determination in Section V. Per 30 ILCS 575/7(3), failure to complete and submit a utilization plan with documentation of good faith efforts renders the bid or offer non-responsive. CEI's final determination will consider the justification for the waiver, the prime vendor's demonstrated good faith effort to solicit certified vendors, the total number of waivers previously granted to the prime vendor in current and prior fiscal years, and the vendor's historical utilization of businesses owned by minorities, women, and persons with disabilities. The completed form, including all required signatures and supporting documentation, must be submitted to CEI's BEP Compliance and included in the procurement file.
