About this file

This document comprises two tax-related documents from the University of Colorado at Boulder (UCB) and the City of Boulder, detailing tax exemption status and prepaid tax estimate requirements for contractors. The first document is a tax exemption certificate from the University of Colorado, which confirms the institution's exemption from federal excise taxes and Colorado state and local government sales and use taxes, with specific tax exempt certificate numbers provided, including FEIN Number 84-6000555 and Boulder Tax Exempt Number 0-03282.

The second document is a City of Boulder Sales/Use Tax Division form for contractors working on construction projects not requiring a city permit. The form outlines specific tax calculation requirements, mandating that contractors are considered the consumers of materials and must prepay estimated use tax prior to project start. The tax calculation involves multiplying the full contract price by 0.50, then multiplying that result by the tax rate of 3.86%. Contractors must remit the estimated tax to the City of Boulder before project commencement and are required to file a Form 15 at project completion using either an estimated materials cost approach or actual materials cost documentation. The form provides a structured template for contractors to calculate and report their prepaid sales/use tax obligations.

Tax Exempt Status of the University of Colorado

The University of Colorado, as a public institution of higher education of the State of Colorado, is exempt from all federal excise taxes under Chapters 32 and 33 of the Internal Revenue Code and from all Colorado State and local government sales and use taxes (see C.R.S. 39-26-114(a) and 203).

The University's tax exempt status applies only to purchases made for the exclusive use of the University and using a University purchase order or University purchasing card (MasterCard). The fraudulent use of this tax exempt memo to secure exemption from the payment of taxes will subject all guilty parties to a fine of not more than $10,000, or to imprisonment for not more than five years, or both, together with costs of prosecution.

Vendors are hereby notified that when materials are purchased for the benefit of the State (i.e., the University), such exemptions apply except that in certain political subdivisions (for example - City of Denver) vendors may be required to pay sales or use taxes even though the ultimate product or services is provided to the State. These sales or use taxes will not be reimbursed by the University.

Prepaid Tax Estimate for Contractors Working on Construction Projects Not Requiring a City Permit

To all Contractors working within the City of Boulder:

Under Boulder’s Revised Code, the contractor is deemed to be the consumer of materials used in the construction project. Contractors may not avoid payment of the City of Boulder sales or use tax by placing provisions in a construction agreement or by using the name of a tax-exempt entity on an invoice or purchase order, regardless that the contractor is indicated thereon as the agent of a tax-exempt entity. No exemption certificate issued by the Colorado Department of Revenue or any other taxing authority shall be recognized as a basis for exemption from sales or use taxes.

Estimated use tax must be remitted to the City of Boulder prior to the start of the project. The tax is computed on the full contract price of the project. Follow these steps to compute and remit the sales/use tax to the City:

1. Multiply the full contract price by 0.5 and then multiply this result by the tax rate of 3.86% (0.0386). This is the tax that is due to the City prior to the start of the project.

2. Remit the tax to the attention of Amy Hildebrandt, Sales Tax Department, P.O. Box 791, Boulder, CO 80306 along with a copy of this completed form.

3. At the completion of the project the construction company is required to file Form 15 using one of the two options listed below for closing out the project with the city.

• Use the formula in (1.) above to compute the final tax due based on the final contract price (including all change orders). Remit the additional tax due or file a request for refund with the City; or

• Use the actual materials cost. Please provide documentation supporting the actual materials cost on construction project.

Contact Amy Hildebrandt at 303-441-3053 or hildebrandta@bouldercolorado.gov to inform the City of which option you have chosen.
