B.2 Labor Hour Rate Schedule At the time of contract award, the Labor Hour rate schedule set forth in B.2 represents fully burdened hourly labor rates for the respective year of the contract performance period for work to be performed. The rate schedule can be used on FFP, Labor Hour and Time-and-Materials task orders. Refer to FAR 52.232-7, payments under Time-and-Materials and Labor Hour Contracts (Aug 2012) for the definition of Labor Hour rates. Fully burdened hourly rates are Not-to-Exceed ceiling rates; however, the Contractor is encouraged to propose lower hourly rates when responding to the request of a task order proposal.

B.3 Labor Category Descriptions
(a) The labor categories and descriptions set forth in Attachment J.2(a) represent the Agency’s best estimate of the personnel required to successfully perform the requirements under this contract. Upon award, Attachment J.2(a) will be incorporated in this contract as an addendum to Section B.
(b) The Government recognizes that ExPRESS operations require a wide variety of specialized skill sets ranging from Service Center personnel, benefits specialists, data processing, to information systems and technology specialists. The technology currently being introduced into the Service Center market place is revolutionary rather than evolutionary. The flexibility of the Contractor to respond to new technologies and processes is both appropriate and necessary.
(c) The Contractor is required to map from internal company labor categories to Agency prescribed categories for proposal preparation purposes. During performance, the Contractor may be allowed to map new internal company labor categories should the need arise. The request shall be made to the Contracting Officer for the new labor categories to be mapped during task order proposal. A fair and reasonable determination will be made by the Contracting Officer prior to approval of new labor categories.
B.4 Payment Provisions
(a) The Agency will make reimbursements in accordance with the invoice instructions prescribed in Section G.1. All payments made are governed by applicable clauses set forth in Section H and Section I. No over-time premium or shift differentials are allowed, only straight-time wages will be reimbursed.
(b) Fixed Fee will be amortized respective to each period of performance for reimbursements on allowable costs only. The Agency has the right to withhold and/or reduce the amount of fixed fee reimbursement for performance insufficiencies. The Contracting Officer reserves the right to negotiate and convert fee reimbursement from fixed fee to incentive or award fee for subsequent periods of performance.
