About this file
This document is the Supplementary Conditions of the Construction Contract (EJCDC C800, 2018 edition) prepared by the National Society of Professional Engineers, American Council of Engineering Companies, and American Society of Civil Engineers, applicable to the Brennaaleen Cedar Detention Pond Project - Phase III in Texas. The supplementary conditions amend and supplement the EJCDC C700 Standard General Conditions and establish specific requirements for the construction project, which involves reclaiming paving and installing new stormwater lines, inlets, and manholes along Cedar Drive to provide drainage relief to the Cedar Heights and Greenbriar Subdivisions. The document does not specify a response due date, site visit requirements, or bidder's conference details; however, it establishes regular working hours as Monday through Friday, 8:00 am to 5:00 pm, with Owner's legal holidays recognized as Federal holidays. The contract includes provisions for performance bonds (EJCDC C610 form), payment bonds (EJCDC C615 form), and a warranty bond equal to 15 percent of the final Contract Price (EJCDC C612 form), all to be issued by the same surety.
The supplementary conditions establish comprehensive insurance requirements for the Contractor, including workers' compensation with statutory limits, commercial general liability with a general aggregate minimum of $500,000, automobile liability with combined single limits of $500,000, umbrella or excess liability of $250,000 per occurrence, pollution liability of $100,000 per occurrence, and professional liability (if applicable) of $500,000 per claim. Weather-related delays are addressed through a specific methodology using National Oceanic and Atmospheric Administration (NOAA) data with predetermined monthly adverse weather delay days ranging from four to eight days depending on the month. The contract permits Owner to suspend work without cause or terminate for convenience with seven days' written notice, or to terminate for cause immediately upon written notice if Contractor fails to perform in accordance with Contract Documents, fails to comply with material terms, disregards applicable Laws or Regulations, or shows repeated disregard for Owner or Engineer authority. All disputes shall be resolved in a Court of competent jurisdiction in Hidalgo County, Texas, with Owner entitled to recover reasonable attorneys' fees and costs if Owner files any matter for final resolution. Unit price work adjustments are permitted when an extended price amounts to 5 percent or more of the Contract Price and the quantity variation exceeds 15 percent, provided Contractor's unit costs have changed materially and significantly as a result.
