About this file

This file contains Questions and Answers (Q&A) clarifications for solicitation SPE607-27-R-0200 1.2W SOUTHCOM, a federal contract opportunity for aviation fuel (Jet A-1) into-plane and into-truck delivery services at multiple SOUTHCOM locations across Central America, South America, and the Caribbean.

The solicitation covers an estimated four-year period of performance from January 1, 2027, through December 31, 2030, with 17 contract line items (CLINs) representing delivery locations including Mariscal Sucre International Airport (Ecuador), Philip S. W. Goldson International Airport (Belize), and various other airports across Colombia, Peru, El Salvador, Guatemala, Costa Rica, Panama, and Bermuda. Offerors must submit pricing for all required delivery modes (into-plane, into-plane with FSII, and into-truck) per CLIN. Proposals are due by 12:00 PM Fort Belvoir, Virginia local time on October 23, 2026. Payment will be processed through the Air Card system within NET 30 terms, with DFAS Columbus responsible for payments in U.S. dollars. All fuel pricing must reference Platts Jet Kero 54 USGC Waterborne as the required price escalator publication, with Economic Price Adjustment (EPA) provisions allowing upward and downward price adjustments based on published market price changes. The solicitation specifies Jet A-1 fuel only; alternate products are not acceptable. Offerors may utilize a Refueling Operator (RO) or Fixed-Based Operator (FBO) to perform refueling services but remain fully responsible for contract compliance and fuel quality. Supporting documentation including fully itemized and priced delivery tickets with Air Card holder signatures must be uploaded to the Air Card Electronic Access System within 15 days of transaction submission. Small businesses under NAICS 324110 are exempt from small business subcontracting plan requirements. The Government will not provide historical uplift data, location-specific tax exemption lists, or incumbent contract information; offerors bear responsibility for determining applicable foreign tax requirements and exemptions for each location in accordance with FAR 52.229-6 and DFARS 252.229-7001.

QUESTIONS AND ANSWERS

QUESTION 1:

Can the Government provide historical uplift data for the last three years by airport to assist offerors in assessing demand variability and pricing risk?

GOVERNMENT RESPONSE:

No. The Government will not provide historical data. Offerors shall base their proposals on the estimated quantities and requirements provided in the solicitation. Quantities identified in the solicitation are estimates only and do not represent a guarantee of actual fuel requirements or uplift volumes.

QUESTION 2:

Can the Government provide examples showing how EPA adjustments will be calculated during contract performance?

GOVERNMENT RESPONSE:

Yes. In accordance with the Economic Price Adjustment (Overseas Into-Plane) provision, found in Attachment D, the price payable under the contract will be adjusted upward or downward by the same number of cents, or fraction thereof, that the applicable published market price increases or decreases, measured in U.S. dollars per like unit of measure.

For example, if the award price is $4.00 per gallon and the applicable published market price increased by $.15 per gallon, the adjusted contract price would be $4.15 per gallon. If the applicable published market price subsequently decreases by $.10 per gallon, the contract price would be adjusted downward by $.10 per gallon.

This example is for illustrative purposes only. Actual price adjustments are subject to the applicable market price indicator, publication, adjustment frequency, effective date requirements, EPA ceilings and all other terms and conditions of the Economic Price Adjustment provision. See Attachment D.

QUESTION 3:

Please confirm the applicable payment terms under this contract and the average number of days between invoice acceptance and payment for aviation fuel deliveries.

GOVERNMENT RESPONSE:

NET 30: Payments for Into-Plane fuel deliveries will be processed through the Aviation Into-Plane Reimbursement (AIR) Card® in accordance with the Air Card® acceptance and transaction invoicing instructions contained in the solicitation (see Attachment D).

DFAS Columbus is responsible for making payments in U.S. dollars for Into-Plane contract line items transactions. Payment is subject to the Prompt Payment Act and applicable prompt payment regulations.

The Government does not provide or guarantee an average number of days between invoice acceptance and payment. Payment timing is governed by the applicable contract terms, Air Card® transaction processing requirements, and Prompt Payment requirements.

QUESTION 4:

Please confirm the required supporting documentation for payment. Are signed fuel delivery tickets, aircraft service records, or other proof-of-delivery documents required to accompany invoices?

GOVERNMENT RESPONSE:

Yes. Supporting documentation is required in accordance with the Into-Plane Program- Fuel Deliveries; Air Card® Acceptance; and Transaction Invoicing Instructions contained in Attachment D. The Contractor shall provide a fully itemized and priced delivery ticket for signature by the Air Card® holder and shall upload the fully priced and itemized singed delivery ticket and corresponding priced invoice into the Air Card® Electronic Access System (EAS) within 15 days of transaction submission. The delivery ticket shall contain the applicable data elements identified in the solicitation. Signature exceptions apply as provided in the Air Card® instructions.

QUESTION 5:

Kindly note CLIN ‘0003 is not listed in the solicitation- Please review and confirm if this is correct or an amended schedule will be published.

GOVERNMENT RESPONSE:

The omission of CLIN 0003 is intentional. The CLIN numbering and Schedule as published are correct. Offerors shall submit proposals based on the CLINs identified in the solicitation.

QUESTION 6:

Kindly note CLIN 0014-0015 are both listing MZBZ (Belize) as the location with same JETA1 fuel requirement- Different volumes- Is this correct?

GOVERNMENT RESPONSE:

No. CLINs 0014 and 0015 are duplicative. CLIN 0014 will be deleted. CLIN 0015 will remain as the applicable requirement for MZBZ (Belize). The schedule will be revised accordingly by amendment.

QUESTION 7:

Please confirm the volumes listed per CLIN are correct. Some volumes reflect 1000 USG for the performance period of 3 years.

GOVERNMENT RESPONSE:

The Government has reviewed the quantities listed in the Schedule. As addressed in Question 6, CLIN 0014 was included in error and will be deleted. The quantities associated with the remaining CLINs are correct as stated in the Schedule. The Schedule will be revised accordingly by amendment.

QUESTION 8:

Kindly note many of the SOUTHCOM locations provide a posted pricing . Kindly confirm if this would be acceptable.

GOVERNMENT RESPONSE:

Platts is the required price escalator publication for all locations identified in Attachment A. However, where an offeror can demonstrate that Platts is not utilized or available for a specific location, the Government may consider an alternate pricing source. The offeror must provide supporting documentation identifying the proposed alternate pricing source and demonstrating why Platts is not applicable at that location. Acceptance of an alternate pricing source is subject to Government review and approval.

QUESTION 9:

Are the quantities in Attachment A (for example, 451,000 USG for CLIN 0001) totals for January 1, 2027, through December 31, 2030, or annual estimates?

GOVERNMENT RESPONSE:

The quantities identified for each CLIN in Attachment A are estimated quantities for the entire Period of Performance, January 1, 2027, through December 31, 2030. They are not annual estimates. The estimated quantities do not represent a guarantee of actual quantities to be ordered or delivered.

QUESTION 10:

The solicitation lists Attachments 1 through 5 (supplies and price, specification and QAP text, inspection and acceptance, deliveries, and contract administration data). SAM.gov shows only Attachments A through E. Will Attachments 1–5 be posted?

GOVERNMENT RESPONSE:

No. Attachments 1 through 5 will not be separately posted. References to Attachment 1 through 5 have been removed from the solicitation, and the applicable information has been incorporated into the revised Attachments A through F. Offerors shall refer to the revised solicitation and Attachments A through F issued with the amendment.

QUESTION 11:

Attachment A runs from CLIN 0002 to CLIN 0004. Was CLIN 0003 omitted or reserved?

GOVERNMENT RESPONSE:

The omission of CLIN 0003 is intentional. The CLIN numbering and Schedule as published are correct. Offerors shall submit proposals based on the CLINs identified in the solicitation.

QUESTION 12:

The delivery point reads "SEQM – Mitad del Mundo International AP, Quito." Please confirm the delivery airport and ICAO code.

GOVERNMENT RESPONSE:

The correct delivery airport is Mariscal Sucre International Airport, ICAO Code SEQM.

Attachment A has been revised accordingly.

QUESTION 13:

Both list MZBZ (Belize City). What distinguishes the two lines?

GOVERNMENT RESPONSE:

The two CLINs were duplicative. CLIN 0014 has been deleted. CLIN 0015 remains as the applicable requirement for MZBZ (Belize City). Attachment A has been revised accordingly.

QUESTION 14:

The SAM.gov description names nine countries. Attachment A also includes Costa Rica, Panama, and Bermuda. Please confirm that all 17 CLINs in Attachment A are part of this solicitation.

GOVERNMENT RESPONSE:

Yes. All applicable CLINs identified in the revised Attachment A are included in the solicitation requirement. The solicitation has been revised to include Costa Rico, Panama, and Bermuda, which were inadvertently omitted from the original description.

QUESTION 15:

At an airport where a single concession holder performs into-plane service, may an offeror propose product from an independent source while the concession holder refuels? Would one commitment letter from the concession holder satisfy the requirement?

GOVERNMENT RESPONSE:

Yes. An offeror may propose product from an independent source while utilizing the applicable Refueling Operator (RO) or Fixed-Based Operator (FBO) to perform the into-plane refueling operation. The offeror shall identify the source of the product and the RO/FBO in its proposal and comply with all applicable solicitation requirements, including the fuel quality documentation requirements.

Where the offeror will not perform into-plan refueling operation itself, one commitment letter from the RO or FBO that will perform the refueling operation is sufficient, provided the letter demonstrates the RO’s or FBO’s commitment to support the offeror in performance of the resulting contract in accordance with the solicitation.

QUESTION 16:

Attachment B asks for a DUNS number in Block 17a. May offerors enter their SAM.gov Unique Entity ID instead?

GOVERNMENT RESPONSE:

Yes. Offerors shall provide their SAM.gov Unique Entity ID (UEI) in lieu of a DUNS number. Attachment B has been revised accordingly.

QUESTION 17:

Reference DFARS 252.204-7025(b)(1), RFP page 17. The CMMC level required by this solicitation is left blank. Which CMMC level applies to this procurement?

GOVERNMENT RESPONSE:

The program office or requiring activity did not determine that the contractor is required to have specific CMMC level, therefore it’s not required.

QUESTION 18:

Reference Attachment A and FAR 52.212-2, Factor II (a). Is the estimated quantity shown for each line item the estimate for the full period of performance of January 1, 2027 through December 31, 2030, or an annual estimate? Does “base period” in the price evaluation mean the full period of performance?

GOVERNMENT RESPONSE:

The estimated quantity identified for each CLIN in Attachment A represents the estimated quantity for the entire period of performance, January 1, 2027, through December 31, 2030, and is not an annual estimate. For purposes of the price evaluation, the reference to “base period” means the entire period of performance. FAR 52.212-2, Factor II(a), has been revised to clarify the price evaluation methodology.

QUESTION 19:

Reference RFP page 26. Attachments 1 through 5 and the full text of the QAPs referenced on pages 6 and 7 are not posted on SAM.gov with the solicitation; six files are posted, the RFP and Attachments A through E. Where can offerors obtain them?

GOVERNMENT RESPONSE:

Attachment 1 through 5 will not be separately posted. References to Attachment 1 through 5 have been removed from the solicitation, and the applicable information, including the applicable quality assurance requirements, has been incorporated into the revised solicitation and Attachments A through F. Offerors shall refer to the revised solicitation and Attachment A through F issued with the amendment.

QUESTION 20:

Reference RFP paragraph 12 and Attachment C. For an offeror that is not the refueling operator, does a commitment letter from the refueling operator in the Attachment C format fully satisfy Subfactor B, with no separate letter required from the fuel source?

GOVERNMENT RESPONSE:

Yes. For an offeror that will not perform the into-plane refueling operation itself, a commitment letter from the applicable Refueling Operator (RO) or Fixed- Based Operator (FBO), submitted in accordance with Attachment C, satisfies the commitment letter requirement under Subfactor B. A separate commitment letter from the fuel source is not required. Offerors remain responsible for satisfying all other applicable solicitation requirements regarding the proposed fuel and source of supply.

QUESTION 21:

Reference RFP paragraph 11. May the line item number and ICAO code be shown on an offeror cover sheet attached to the supplier’s COA or COQ, or must they appear on the certificate itself? Is a recent representative certificate from the supplying refinery acceptable at proposal?

GOVERNMENT RESPONSE:

The applicable CLIN and ICAO code shall be identified on the COA or COQ submitted with the proposal, as required in paragraph 11 of the solicitation. Identification of the CLIN and ICAO code solely on a separate offeror cover sheet does not satisfy this requirement.

A recent representative COA or COQ from the proposed supplying refinery is acceptable at the time of proposal, provided it demonstrates that the proposed fuel meets the applicable Government fuel specification and otherwise complies with the requirements of paragraph 11.

QUESTION 22:

Reference RFP paragraph 8 and the Attachment B cover page. The RFP states the closing time as 12:00 PM Fort Belvoir, VA local time, and the OSP cover states Eastern Standard Time. Please confirm that proposals are due at 12:00 PM local (Eastern Daylight) time on October 23, 2026.

GOVERNMENT RESPONSE:

Yes. Proposals are due by 12:00 PM Fort Belvoir, Virginia local time on October 23, 2026. Attachment B has been revised to remove the reference of “Eastern Standard Time” and reflect Fort Belvoir, Virginia local time.

QUESTION 23:

Reference Attachment A delivery modes and Attachment B price sheet lines D through G. Must an offeror offer all delivery modes listed for a line item (into-plane with FSII, truck, into-plane) to be technically acceptable? Is price evaluated on line C or on the total price at line G?

GOVERNMENT RESPONSE:

Offerors shall submit pricing for all delivery modes identified for each applicable CLIN in Attachment A, including Into-Plane, Into-Plane with FSII, and Into-Truck, in accordance with the pricing instructions in Attachment B.

Failure to propose a required delivery mode may result in the proposal being determined technically unacceptable.

Proposals will be evaluated in accordance with the lowest priced, technically acceptable offeror criteria established in the solicitation.

QUESTION 24:

Reference the Attachment B price sheet (“If the incumbent, state your contract number”). Will the Government identify, for each line item, whether there is an incumbent contract and, if so, the contract number?

GOVERNMENT RESPONSE:

No. The Government will not identify incumbent contract information for each CLIN.

The instruction in Attachment B applies to an offeror that is the incumbent contractor. If applicable, the incumbent offeror shall provide its current contract number in the space provided.

QUESTION 25:

Reference Attachment A, escalator P5GCSWJ54T. Please provide the full Platts publication and assessment name for this code (PL JK54 SPOT WB PWA EFF TUES), and confirm that the Base-Price of 2.854980 is the value to enter on line A of the price sheet for the June 30, 2026 reference date.

GOVERNMENT RESPONSE:

The applicable Platts assessment for escalator P5GCSWJ54T - PL JK54 SPOT WB PWA EFF TUES is Jet Kero 54 USGC Waterborne. “PWA EFF TUES” means Prior Week Average, Effective Tuesday.

The Base Price identified in Attachment A for the June 30, 2026, reference date is $2.854980 per gallon. Offers shall enter $2.854980 on Line A of the applicable Attachment price sheet.

QUESTION 26:

Reference Attachment A delivery addresses. Item 0001 lists a military ramp as the delivery address. For the other line items, are deliveries made on the commercial ramp, a military ramp, or both, and are there access or badging requirements for the refueling operator?

GOVERNMENT RESPONSE:

Offerors shall provide refueling services at the applicable commercial airport locations identified in Attachment A and in accordance with the delivery requirements in the solicitation.

As provided in Attachment D, SUPPLIES AND ESTIMATED QUANTITIES TO BE FURNISHED (INTO-PLANE) paragraph (c), offerors must have authorization from the appropriate airport authorities for access to the airport property where refueling will be performed. The Contractor is responsible for obtaining any access, badging, credentialing, or other airport- specific authorization necessary to perform the required refueling services.

QUESTION 27:

Reference DFARS 252.229-7001 and the Attachment D note on Foreign Taxes. For which line item locations does the U.S. Government hold a host-nation tax exemption for fuel purchases?

GOVERNMENT RESPONSE:

The Government will not provide a location-specific list of host-nation tax exemptions.

Offerors are responsible for determining the applicable foreign tax requirements and exemptions for each location for which they submit a proposal. Proposed prices shall exclude taxes for which the U.S. Government is exempt and shall comply with the applicable tax provisions and clauses of the solicitation, including FAR 52.229-6, DFARS 252.229-7001, and Foreign Taxes instructions in Attachment D.

QUESTION 28:

Reference DFARS 252.219-7003. Please confirm that a small business subcontracting plan is not required from an offeror that is a small business under NAICS 324110.

GOVERNMENT RESPONSE:

Confirmed. An offeror that qualifies as a small business under the solicitation’s assigned NAICS code, 324110, is not required to submit a small business subcontracting plan in accordance with FAR 19.702(b)(1).

QUESTION 29:

Reference RFP paragraph 8 and the Attachment D note on E-Mail Proposals. If a proposal exceeds 10 MB, may it be sent in several numbered emails, and which email’s receipt time controls for timeliness?

GOVERNMENT RESPONSE:

Yes. Offerors may submit proposals exceeding 10 MB in multiple emails, provided that each individual email does not exceed the 10 MB limitation established in Attachment D, E-MAIL PROPOSALS, paragraph (e). Each email shall clearly identify the solicitation number, offeror’s name, and submission sequence (e.g., Part 1 of 3, Part 2 of 3).

All portions of the proposal must be received at the Government-designated email address by the solicitation closing date and time. Timeliness of the complete proposal will be determined by the Government’s receipt of the final email containing the remaining portion of the proposal, subject to the applicable solicitation provisions governing late submissions.

QUESTION 30:

For locations where an offeror performs through an authorized local agent, commissionaire, or agency arrangement, does the Government permit proposal submission and contract performance under such a structure, provided the offeror remains fully responsible for contract compliance, fuel supply, quality requirements, and performance obligations?

GOVERNMENT RESPONSE:

The solicitation permits offerors to utilize a Refueling Operator (RO) or Fixed-Based Operator (FBO) to perform Into-Plane refueling services. Offerors utilizing an RO or FBO must comply with the applicable commitment letter requirements and all other terms and conditions of the solicitation.

The offeror remains fully responsible for contract compliance, fuel supply, quality requirements, and performance obligations. Other agency arrangements are not authorized under the solicitation.

QUESTION 31:

a. Attachment A identifies two separate line items at MZBZ (Philip S. W. Goldson International Airport):

i. CLIN 0014 – 1,000 U.S. Gallons

ii. CLIN 0015 – 113,000 U.S. Gallons

b. Aside from quantity, the line items appear to contain the same location, product, and performance requirements. Please clarify the intended distinction between CLINs 0014 and 0015 and confirm whether they represent separate requirements that must be priced independently.

GOVERNMENT RESPONSE:

CLINs 0014 and 0015 are duplicative and do not represent separate requirements.

CLIN 0014 will be deleted from Attachment A, and CLIN 0015 will remain as the applicable requirement for MZBZ Philip S. W. Goldson International Airport, Belize.

Offerors shall submit pricing for CLIN 0015 only. Attachment A will be revised accordingly through a solicitation amendment.

QUESTION 32:

Attachments A through E have been uploaded to SAM.gov. However, the solicitation also references the following attachments, which do not appear to be available:

• Attachment 1 – Supplies or Services and Price/Cost

• Attachment 2 – Description/Specification/Statement of Work

• Attachment 3 – Inspection and Acceptance

• Attachment 4 – Deliveries or Performance

• Attachment 5 – Contract Administration Data

Would you mind confirming where we can access Attachments 1 through 5, or whether these will be uploaded to SAM.gov separately?

GOVERNMENT RESPONSE:

Attachments 1 through 5 will not be separately posted to SAM.gov. References to these attachments have been removed from the solicitation, and the applicable information has been incorporated into the revised solicitation and Attachments A through F.

Offerors shall refer to the revised solicitation and Attachments A through F issued with the amendment.

QUESTION 33:

Where applicable, will DLA accept actual refinery prices or government-established prices as the basis for the applicable fuel pricing?

GOVERNMENT RESPONSE:

Offerors shall utilize the applicable reference price, reference date, and price escalator identified in Attachment A, and submit their proposal pricing in accordance with the OFFER PRICE BREAKDOWN SHEET provided in Attachment B.

Platts is the required price escalator publication for locations where an applicable Platts reference is identified. Actual refinery prices or government-established prices will not automatically be accepted as an alternative pricing basis.

Where an offeror demonstrates that Platts is not utilized or available for a specific location, the Government may consider an alternate pricing source, subject to Government review and approval, in accordance with Note 13, PRICE ESCALATOR PUBLICATION, of the solicitation.

QUESTION 34:

For locations where taxes are not waived, including El Salvador, Guatemala, Peru, and Ecuador, please clarify how applicable taxes should be reflected in the proposed pricing and how DLA intends to evaluate those taxes as part of the offer.

GOVERNMENT RESPONSE:

Offerors are responsible for determining the applicable foreign tax requirements and exemptions for each location for which they submit a proposal. Proposed prices shall exclude taxes from which the U.S. Government is exempt.

In accordance with the Foreign Taxes instructions in Attachment D and FAR 52.229-6, Offerors shall include applicable nonexempt foreign taxes, duties, fees, or other foreign government-levied charges in their proposal prices and identify the specific name and amount of such charge. Separate invoicing of foreign taxes and duties are not authorized.

Prosed pricing will be evaluated in accordance with the price evaluation criteria established in the solicitation.

QUESTION 35:

Was there an Item No. 3 included in the original solicitation or any solicitation attachment? We would like to confirm that contractors have received the complete solicitation package and is not missing any item or attachment.

GOVERNMENT RESPONSE:

CLIN 0003 is intentionally omitted from the Solicitation and does not represent an outstanding requirement. The omission does not indicate a missing line item or attachment. Offerors shall submit proposals based on the CLINs and attachments identified in the solicitation, as revised by the amendment.

QUESTION 36:

Please provide a detailed explanation of how DLA expects offerors to complete the Offer Submission Package (OSP) price sheet, particularly where multiple pricing components (i.e. ITP, ITT, w/FSII and w/o FSII) are requested for the same location. We want to ensure that all required pricing fields are completed correctly and that the pricing structure is consistent with DLA’s intended evaluation methodology.

QUESTION 37:

If the solicitation provides only one estimated volume for each location, and that volume is not specifically divided among:

o Into-Plane (ITP) versus Into-Truck (ITT);

o Jet A-1 without FSII versus Jet A-1 with FSII; and o Standard versus rapid refueling, How will DLA incorporate and evaluate the additional prices requested for FSII, into-truck, and rapid refueling?

Offerors shall submit pricing for all delivery modes identified for each applicable CLIN in Attachment A, including Into-Plane, Into-Plane with FSII, and Into-Truck, in accordance with the pricing instructions in Attachment B.

Failure to propose a required delivery mode may result in the proposal being determined technically unacceptable.

QUESTION 38:

If an offeror provides the lowest base price for Jet A-1 ITP but does not provide a price for one or more of these additional requirements, will the offeror be considered nonresponsive, technically unacceptable, or otherwise disadvantaged in the price evaluation?

GOVERNMENT RESPONSE:

Offerors shall submit pricing for all delivery modes identified for each applicable CLIN in Attachment A, including Into-Plane, Into-Plane with FSII, and Into-Truck, in accordance with the pricing instructions in Attachment B.

Failure to propose a required delivery mode may result in the proposal being determined technically unacceptable.

QUESTION 39:

Conversely, if these additional services are not included in the estimated quantities or are not part of the evaluated requirement, please clarify how DLA intends to use the corresponding prices submitted by offerors.

QUESTION 40:

Item 0005 (MSLP) lists an estimated quantity of 4,411,000 USG, and Items 0014 and 0015 (MZBZ) list 1,000 USG and 113,000 USG, all against a period of performance of 1 Jan 2027 – 31 Dec 2030. Based on DLA Energy's published delivered-volume data for contract SPE60724D-0011, MSLP deliveries from January to August 2026 total 2,670,126 USG (approximately 334,000 USG per month), so the Item 0005 quantity would be consumed in roughly 13 months at the current run-rate. This does not appear consistent with the quantity being a total estimate for the four-year period. For each item, please confirm whether the quantity is an annual estimate or the total estimate for the four-year period, and whether any minimum or maximum quantity applies under the requirements contract.

GOVERNMENT RESPONSE:

The quantities identified in Attachment A represent estimated quantities for the entire period of performance, January 1, 2027, through December 31, 2030, and are not annual estimates.

In accordance with Attachment D, Supplies and Estimated Quantities to Be Furnished (Into-Plane), paragraph (a), the quantities are estimates only.

CLIN 0014 is duplicative and will be deleted. CLIN 0015 will remain as the applicable requirement for MZBZ. Attachment A will be revised accordingly through a solicitation amendment.

QUESTION 41:

Items 0014 and 0015 (MZBZ) both specify Jet A-1 for the same airport. Please clarify what distinguishes the two-line items (e.g., delivery points, customers, ordering offices) and whether offerors may propose different unit prices for each.

GOVERNMENT RESPONSE:

CLINS 0014 and 0015 are duplicative and do not represent separate requirements.

CLIN 0014 will be deleted from Attachment A, Schedule, through a solicitation amendment. CLIN 0015 will remain as the applicable requirement for MZBZ.

QUESTION 42:

Items 0005, 0014 and 0015 specify Turbine Fuel, Aviation, Jet A-1 (NSN 9130-01-305- 4096, QAP C16.08-2). Would DLA Energy consider an offer of Jet A (NSN 9130-01-305- 4097, QAP C16.08-3) for these items, or is Jet A-1 a mandatory requirement at MSLP and MZBZ? If Jet A may be offered, please confirm it would be evaluated on the same basis and identify any additional requirements.

GOVERNMENT RESPONSE:

Offerors shall submit proposals and pricing for the fuel product specified for each applicable CLIN in Attachment A, Schedule. Only the fuel products identified in the solicitation will be considered acceptable for the respective CLINs. Alternate fuel products will not be accepted.

QUESTION 43:

For each location, please provide the expected volume split among into-plane with FSII, into-plane without FSII, and into-truck deliveries, if possible.

GOVERNMENT RESPONSE:

The Government does not provide separate estimated quantities by delivery mode. The estimated quantities identified in Attachment A, Schedule, represent the total anticipated requirements for each applicable CLIN over the entire period of performance.

Offerors shall submit pricing for all required delivery modes identified for each applicable CLIN in Attachment A, in accordance with Attachment B, Offer Submission Package (OSP).

QUESTION 44:

Is there any provision to adjust non-indexed price components (differential, freight, into-plane fee) during the four-year period of performance?

GOVERNMENT RESPONSE:

Please refer to DFARS 252.243-7002 REQUESTS FOR EQUITABLE ADJUSTMENT (DEC 2022). Requests for adjustments to non-indexed price components, including differentials, freight, and into-plane fees, may be submitted to the Contracting Officer with supporting documentation and justification. Such requests will be reviewed on a case-by-case basis and subject to Contracting Officer approval. Any approved adjustments will be incorporated through a bilateral contract modification.

QUESTION 45:

Attachment A lists the escalator for all items as "P5GCSWJ54T – PL JK54 SPOT WB PWA EFF TUES". Please confirm whether this escalator refers to the Platts assessment USGC Jet 54 Waterborne Mean (symbol PJABM00).

GOVERNMENT RESPONSE:

Confirmed. The escalator identified in Attachment A, Schedule, as P5GCSWJ54T – PL JK54 SPOT WB PWA EFF TUES utilizes the Platts Jet Kero 54 U.S. Gulf Coast Waterborne assessment (Platts code PJABMOO), based on the prior weekly average, updated on Tuesdays.

Offerors shall utilize the escalator and applicable base reference information identified in Attachment A when preparing their proposals.

QUESTION 46:

In order to arrive at a price that better reflects market movements over the four-year period, would DLA Energy be open to considering, for Item 0005 (MSLP), a price adjustment formula with two Platts-based variables, in place of a single Platts escalator with fixed non-indexed components? The two variables would be: (i) a product component indexed to Platts USGC Jet 54 Waterborne Mean (PJABM00), calculated as the average of the previous week (Monday to Friday); and (ii) a freight component, applied as a freight surcharge indexed to Platts Clean USGC–West Coast Central America 38kt MR Lumpsum (TCUWB00), converted to USD/USG. If DLA Energy is open to this, please describe the process and timing for proposing and approving such a formula, and whether it must be submitted with the initial proposal.

GOVERNMENT RESPONSE:

The Government will not consider an alternative price adjustment formula for CLIN 0005. Offerors shall utilize the applicable price escalator identified in Attachment A, Schedule, and submit pricing in accordance with Attachment B, Offer Submission Package (OSP).

Price adjustment during contract performance shall be governed by the applicable Economic Price Adjustment (EPA) provisions of the solicitation. Separate freight-based escalation formulas are not authorized under the solicitation

QUESTION 47:

Attachment E (MIL-STD-1548H) provides for Type I (ATA 103) and Type II (JIG 1) operations. Please confirm that into-plane operations conducted in accordance with Type II (JIG 1) are acceptable to DLA Energy at both MSLP and MZBZ.

GOVERNMENT RESPONSE:

Type II (Jig 1) into-plane refueling operations are acceptable at MSLP and MZBZ, provided all applicable requirements of Attachment E, MIL-STD-1548H, and the solicitation are satisfied.

Offerors are responsible for ensuring that the proposed refueling operator complies with the applicable technical, safety, and fuel quality requirements.

QUESTION 48:

For each location, does DLA Energy consider the supply to be exempt from local taxes (including VAT/sales taxes) under a bilateral agreement or other arrangement? If so, please identify the legal basis and the documentation DLA will provide, including whether DLA will issue the awardee a vendor verification letter for presentation to local authorities. If there is any determination by the local authorities on these purchases, please share it.

GOVERNMENT RESPONSE:

The Government will not provide location-specific determinations regarding foreign tax exemptions or the legal basis for such exemptions. Offerors are responsible for determining the applicable foreign tax requirements and exemptions for each location for which they submit a proposal.

Proposed prices shall exclude taxes from which the U.S. Government is exempt and shall comply with the applicable tax provisions and clauses of the solicitation, including FAR 52.229-6, DFARS 252.229-7001, and the Foreign Taxes instruction in Attachment D.

QUESTION 49:

How should offerors reflect local taxes in the offered price (clause 252.229-7001), and what contractual provision governs a price adjustment if the local tax treatment is confirmed or denied after award?

Offerors shall determine the applicable foreign tax requirements and exemptions for each location and submit pricing in accordance with FAR 52.229-6, DFARS 252.229- 7001, and the Foreign Taxes instructions in Attachment D.

Proposed prices shall include applicable nonexempt foreign taxes and duties and exclude taxes from which the U.S. Government is exempt.

Any qualifying post-award adjustments resulting from changes in applicable foreign taxes or duties shall be governed by FAR 52.229-6, Taxes- Foreign Fixed-Price Contracts, and other applicable contract terms and conditions.

QUESTION 50:

Foreign taxes – FAR 52.229-6 and Attachment D (Foreign Taxes; Substantiation of Local Taxes)

a. Exemption and documentation. Our understanding is that the exemption under the U.S.–host-country agreement is not applied automatically to a contractor's sale and requires documentation from the U.S. Government to be presented to the host-country tax authority. Please confirm whether DLA intends to present such documentation, in what time frame, and whether it will do so for sales made through a reseller. What documentation will DLA provide to the awardee (e.g., the vendor verification letter), and what evidence of "all reasonable action" under para (i) does DLA expect from the contractor?

b. Price basis. Until an exemption is in effect, please confirm that offerors are to include the applicable tax in the offered price, list it by name and amount in paragraph (a) of the Foreign Taxes section, and that offers will be evaluated on that basis. Because the tax is percentage of a price that moves with the index, please confirm that stating it as a percentage of the total price is acceptable.

c. After-relieved tax (para (e)). If an exemption or refund is obtained after award, please advise the effective date of the price decrease and the treatment of amounts already invoiced.

d. After-imposed tax (para (d)(1)). If an exemption is later revoked or reduced, please advise how the price increase will be documented and invoiced.

e. Notification (para (j)). To whom, and in what form, should the contractor give notice of tax matters that may change the price?

g. Order of precedence. If FAR 52.229-6 and DFARS 252.229-7001 differ, or either differs from any other tax provision in the solicitation, which governs?

a. Exemption and documentation: Offerors are responsible for determining applicable foreign tax requirements and exemptions for each location. In accordance with FAR 52.229-6(i), contractors shall take all reasonable action to obtain applicable tax exemptions or refunds. Any Government-provided documentation supporting such exemptions will be subject to the applicable requirements and coordination with the Contracting Officer.

b. Price basis. Offerors shall include applicable nonexempt foreign taxes and duties in their proposed prices and exclude taxes from which the U.S. Government is exempt, in accordance with FAR 52.229-6 and DFARS 252.229-7001, and Attachment D.

Applicable taxes shall be identified by name and amount as required by the Foreign Taxes instructions. Proposals will be evaluated in accordance with the solicitation’s established evaluation criteria.

c. After-Relieved Tax: Any qualifying post-award tax relief or refund shall be addressed in accordance with FAR 52.229-6(e). Applicable contract price decreases and treatment of previously paid amounts will be determined in accordance with the clause and the circumstances of the tax relief.

d. After-Imposed Tax: Any qualifying post-award imposition or increase of foreign taxes shall be addressed in accordance with FAR 52.229-6(d). The Contractor shall submit supporting documentation to the Contracting Officer for review. Any applicable contract price adjustment wil be processed in accordance with the contract terms and conditions.

e. Notification: In accordance with FAR 52.229-6(j), contractors shall promptly notify the Contracting Officer of matters relating to taxes or duties that may result in an increase or decrease in the contract price.

g. Order of Precedence: FAR 52.229-6, DFARS 252.229-7001, and the applicable Foreign Taxes instructions shall be interpreted together in accordance with the solicitation’s governing contract terms and conditions. Any identified inconsistencies shall be referred to the Contracting Officer for clarification.

QUESTION 51:

The solicitation currently specifies the same Platts Jet Kero 54 USGC WB PWA reference for all airports. However, in several markets, the actual fuel price is based on a regulated, refinery-posted, supplier-posted, or airport-posted price, which more accurately reflects the applicable local market pricing.

Based on our local supplier and market information, will DLA please review the location-specific escalation bases identified below and confirm whether the solicitation will be amended to reflect the applicable market escalator for each airport?

GOVERNMENT RESPONSE:

Platts is the Government’s recommended price escalator. However, if a particular location utilizes an alternate price escalator, offerors may submit their proposals identifying the applicable escalator used at that location.

The Government will review the information submitted and may contact the offeror if additional information or clarification is required. Acceptance of an alternative escalator is subject to Government review and approval.

QUESTION 52:

For the applicable locations in Guatemala, Costa Rica, Peru, Panama, El Salvador, Belize, and Brazil, where Jet A is the commercially applicable product, will DLA please confirm whether the fuel requirement can be amended from Jet A-1 to Jet A for these locations?

GOVERNMENT RESPONSE:

The fuel requirements identified for each applicable CLIN in Attachment A, Schedule, remain unchanged. Offerors shall submit proposals and pricing for the fuel product specified for each applicable CLIN.

Alternate fuel products will not be accepted. Any changes to the required fuel products will be communicated through a formal solicitation amendment.

QUESTION 53:

Attachment A lists both CLIN 0014 and CLIN 0015 for MZBZ – Philip S. W. Goldson International Airport, Belize, with different quantities. Can DLA please confirm whether both CLINs are intentional requirements, or whether one of the CLINs has been duplicated?

CLINs 0014 and 0015 are duplicative and do not represent separate requirements.

CLIN 0014 will be deleted from Attachment A, Schedule, through a solicitation amendment. CLIN 0015 will remain as the applicable requirement for MZBZ (Philip S.

W. Goldson International Airport, Belize).

Offerors shall submit pricing for CLIN 0015 only, in accordance with the revised Attachment A.

QUESTION 54:

We understand that the U.S. Government is exempt from certain taxes in the solicited countries. Can DLA please confirm whether DLA Energy will provide the necessary assistance and supporting documentation, including any required tax-exemption certificates, where local law or the applicable airport/supplier requires such documentation in order for the U.S. Government tax exemption to be applied?

GOVERNMENT RESPONSE:

Offerors are responsible for determining the applicable foreign tax requirements and exemptions for each location in accordance with FAR 52.229-6, DFARS 252.229-7001, and the Foreign Taxes instructions in Attachment D.

Requests for Government documentation necessary to support an applicable tax exemption may be submitted to the Contracting Officer for review and coordination, as appropriate. The availability of such documentation will depend on the applicable requirements and circumstances.
