NAS Patuxent River, MD

CONTRACTING QUESTIONS & ANSWERS

1. Previous solicitations for services at NAS Patuxent River were set-aside. Given that there were at least three small businesses in attendance at the preproposal conference and site visit.

Q. Is there a reason this solicitation is Full and Open?

A. The decision to solicit this requirement as Full and Open was based on the market research that was conducted prior to the issuing of the solicitation.

Therefore, it was determined the best method for solicitation was to make this requirement full and open competition.

2. Reference Section L, Page 119, Volume III, Wage Determination Paragraph and Joint Strike Fighter Pricing:

Please confirm that Contractors should use the 2024 CBA rates as their basis for pricing beyond 12/31/2024 as stated at the March 28, 2022, Pre-Proposal Conference.

A. Yes, that is correct. Offerors would basically proceed using the final wages for year 2024 as stated in Article 10, Wages and Benefits of the current CBA for option year pricing. See the revised PWS for removal of the reference to the Joint Strike Fighter (JSF) program.

3. Reference Attachment V, CBA.

Please provide Appendix 1 to the current CBA. Article 33 states job descriptions are provided in Appendix 1 however this appendix is not included with the solicitation documents.

A. DLA does not have a copy of Appendix 1. However, the CBA states on page 32 “Upon written request by the Business Representative of the Union to the Project Manager, the Company will provide the Union, within 15 days of receipt of the Union's written request, with a copy of the job description listed in Appendix 1 to this Agreement".

Please confirm the offeror’s prices should reflect the wages and fringe benefits for all years as published in the current CBA, and not just the current rate.

A. Yes, that is correct. Offerors would basically proceed using the final wages for year 2024 as stated in Article 10, Wages and Benefits of the current CBA for option year pricing.

Q. What base wage should bidders use to price the option years of the contract, since the CBA expires in December 2024?

A. Offerors would basically proceed using the final wages for year 2024 as stated in Article 10, Wages and Benefits of the current CBA for option year pricing.

4. The current contract was awarded for a four-year base, with one five-year option plus a potential six- month extension; however, with this procurement it is clear the Government does not intend to exercise the five-year option. After reviewing the PWS for both the current contract and the new procurement, we don’t see any significant changes in the scope of services.

Q. Why is the option not being exercised? Is the current service provider permitted to bid on this new solicitation even though they already hold the contract?

AThe Government declines to answer the question regarding the exercise of the option under the current contract as it is not relevant to this solicitation. As to the second part of the question, the Government will evaluate all responsive proposals submitted by responsible offerors in accordance with the evaluation criteria and terms of the solicitation, the FAR and any applicable policies.

5. Reference Section L - Instructions, Conditions, and Notices to Offerors, Proposal Content, Paragraph f. Subcontracting Plan:

Q. Please clarify if a small business contractor is required to submit a Subcontracting Plan.

A. Please refer to FAR 19.702 (b)(1)

6. Is the contract being re-competed for contractual non-performance by the incumbent?

A. The Government declines to answer the question as it is not relevant to this solicitation. Please refer to the RFP for the requirements and the criteria that will be used to evaluate all responsive and responsible offers received.

7. Is the scope and volume of services the same as the incumbent contract as it will be on this RFP?

A. See the revised PWS for removal of the reference to the Joint Strike Fighter (JSF) program. Notwithstanding the removal of the JSF requirement from this solicitation, there are no significant changes to the scope or volume of services.

Past four-year workload is represented within the PWS, Appendix A.

8. What is the dollar value of the current contract?

A. The value of the current contract is public information. Please utilize the https://www.dibbs.bsm.dla.mil//. Contract number is SPE60318C5071.

9. Why was the current contract terminated and re-competed?

A. The current contract has not been terminated. Services are still required at NAS Patuxent River; MD and the Government has the unilateral right to not exercise the option. For additional information you can submit a request under the Freedom of Information Act.

10. The Motor Vehicle Mechanic classification is identified in the CBA, however the PWS does not identify a Motor Vehicle Mechanic.

Q. Is the contractor required to use the Motor Vehicle Mechanic classification?

A. No. The PWS does not require a Motor Vehicle Mechanic. Every offeror must provide their approach in maintaining contractor-furnished equipment.

11. Reference CBA Article 33 Job Descriptions: The paragraph states the job descriptions are referenced in Attachment 1. Attachment 1 was not provided.

Please provide.

A. Offerors should propose their staffing in accordance with the requirements under the PWS. The CBA doesn’t dictate the staffing. DLA does not have a copy of Appendix 1. However, the CBA states on page 32 that ”Upon written request by the Business Representative of the Union to the Project Manager, the Company will provide the Union, within 15 days of receipt of the Union's written request, with a copy of the job description listed in Appendix 1 to this Agreement",

12. What was the reason for not exercising the option?

A. . The Government declines to answer the question as it is not relevant to this solicitation. Please refer to the RFP for the requirements and the criteria that will be used to evaluate all responsive and responsible offers received.

13. Are either of the incumbent companies being allowed to bid the re-solicitation?

https://www.dibbs.bsm.dla.mil/

A. The Government will evaluate all responsive proposals submitted by responsible offerors in accordance with the evaluation criteria and terms of the solicitation, the FAR and any applicable policies.

14. If the contract was underbid, and the incumbents could not afford to perform - would that keep them from rebidding?

Based on the price bid by the incumbents (public information) - we're sure they were not profitable which likely resulted in not exercising the option. DLA is setting a dangerous precedent by accepting a bid that should have been obviously too low to the evaluators, not performing price realism, awarding the contract, and then allowing that contractor to reprice their bid rather than exercising their priced option.

A. The Government declines to answer the question as it is not relevant to this solicitation. The Government will evaluate all responsive proposals submitted by responsible offerors in accordance with the evaluation criteria and terms of the solicitation, the FAR and any applicable policies.

15. Will this option be available to the next vendor who decides to submit an unprofitable bid?

A. The Government declines to answer the question as it is not relevant to this solicitation. The Government will evaluate all responsive proposals submitted by responsible offerors in accordance with the evaluation criteria and terms of the solicitation, the FAR and any applicable policies.

16. Request that the proposal submission date be extended to at least 2-weeks past the date the answers to questions are provided.

A. A decision will be made per the Contracting Officer if it is determined more time will be needed via Amendment.

17. The PPQ Reference sheet is a bit confusing.

Q. In the first column, is the Contact Name our contact (TM) or the COR?

Whose information goes in the last 3-columns?

A. The contact name is for the point of contact that may be contacted in reference to contracts listed. Name, email and phone number references- the COR

18. Section L, Proposal Format, page 117- The RFP specifies, “Font shall be 12-point Times New Roman (or similar font style) ….”

Q. Will the Government permit illustrations and drawings to be in a font such as in the Arial family and 9-point size to make diagrams and charts easier to read?

A. All proposals must adhere to the below format (i.e., in their appropriate, relevant volume) as stated in Section L. Failure to provide the information requested in this section may result in a proposal being deemed non-responsive and/or unacceptable.

Proposal Format: The offeror’s proposal should be typed, where possible (signatures excluded). Font shall be 12-point Times New Roman (or similar font style) on an 8 ½” x 11” page with 1” margin. Each page is considered one single-sided 8 ½” x 11” page with 1” margins in 12-point font as Times New Roman (or similar font). Page limits are indicated for such submission element below and shall include all appendices and attachments unless otherwise stated.

19. Just reading through the solicitation info on SAM and saw mention of “several documents” will be posted as “secured.”

Q. Are there in fact some secure documents available for the RFP?

A. Not at this time; however, notification of any secure documents to be provided will occur via amendment.

20. General:

Q. Can you provide the following information on the Incumbent who is currently working on the contract – Name of the Incumbent, Contract Number, Contract Value.

A. All is information is public and can be found on https://www.dibbs.bsm.dla.mil// under contract number is SPE60318C5071.

21. Collective Bargaining Agreement:

Q. If and when a new and/or revised Collective Bargaining Agreement is negotiated with a new contractor must DLA approve the contract before it becomes an acceptable Agreement with both parties?

A. A collective bargaining agreement (CBA) is a written legal contract between an employer and a union representing the employees not DLA. DLA conducts its review of the CBA after it is completed (fully negotiated between the employer and the union and official notice is sent to DLA by the employer).

https://www.dibbs.bsm.dla.mil/

22. Pages 119 Factor Volume III Price, Sub-Factor I Period for Acceptance of offers.

Page 5 Performance Work Statement, Sub-Factor C1.4 Contract Turnover.

Period for Acceptance of Offers state that prices and technical remain firm for 180 days.

Q. Is it DLA’s intention not to award on or before the end of the calendar year, anticipated period of performance list a January 1, 2023, start date?

A. DLA’s intent is to award before the period of performance start date January 1, 2023, however, the award date is subject to change based on the review process of the procurement.

Contract Turnover states “During the ten working days prior to the start of the contractor performance the outgoing Contractor shall permit the incoming Contractor access to the applicable fuel facilities in order to observe their operation.

Q. Are we understand that there will only be a 10-day Transition Period?

A. Yes
