WESTPAC SOLICITATION SPE602-22-R-0707
QUESTIONS & ANSWER SET #1
1. Q: Solicitation Note 7 identifies that all JA1 bid line proposals may not be evaluated to Qatar. In the past, DLA Energy has allowed offerors to submit documentation from the origin countries’ export authority that DLA Energy cargoes will be allowed to be exported to Qatar. Since the embargo has ended, why is this note in the solicitation?
A: DLA Energy acknowledges that the embargo has ended and does not anticipate any issues that would prevent a shipping point in UAE or other GCC countries to be evaluated. However, should the export situation change, DLA Energy reserves the right to not evaluate proposals from UAE or GCC countries to Qatar.
2. Q: Is this solicitation open to new bidders or a continuation of the old contract?
A: This solicitation is open to new offerors. Offerors do not need to have a current DLA Energy contract to participate.
3. Q: What is the likelihood of extending contract length from 1 year to 2 years?
A: DLA Energy has no plans on issuing 2-year contracts for WESTPAC.
4. Q: Will DLA Energy be interested to consider a DESTINATION offer for Guam instead of FOB ORIGIN on TANKER delivery mode?
A: DLA Energy is not soliciting any FOB DESTINATION Tanker offers.
5. Q: Is there a possibility for DLA to sub-lease one of their JET storage tanks at TRISTAR Terminal to a contractor?
A: No, DLA Energy does not have the authority to own real property interests so we cannot lease tanks.
6. Q: Would a cost evaluation for an FOB Destination pipeline delivery give credits to account for storage cost and the security of supply?
A: No, evaluation factors for other than FOB Origin Tanker will be applied in accordance with M41.04 EVALUATION OF OFFERS INVOLVING OTHER THAN F.O.B. TANKER (BULK) (DLA ENERGY
JUL 2010).
7. Q: Noticed that Oman is not listed as a Free Trade Agreement country. However, Oman is listed in the list of countries that has a FTA with United States on this US government website:
https://ustr.gov/trade-agreements/free-trade-agreements. Will Oman be included as a qualifying country going forward?
A: Per DFARS 225.003, “Free Trade Agreement country” does not include Oman. Oman will not be considered a qualifying country in this solicitation.
8. Q: Where can I obtain specs for JA1, F76, and JP5 requirements?
A: Please see QAP C1.02 ASSIST (DEC 2016) for instructions on how to access specifications.

9. Q: Can replenishment though the contract period be agreed beforehand?
A: No, DLA Energy does not commit to delivery dates before award due to the Indefinite Quantity, Indefinite Delivery nature of this solicitation and resulting contracts.
10. Q: Can the nomination period of 120 days non-binding and 15 days binding be followed?
A: DLA Energy provides a 120 day, non-binding forecast for orders on contracts awarded through this program. However, final orders will be placed in accordance with F1 DELIVERY CONDITIONS FOR TANK CARS, BOXCARS, TRUCKS, TRANSPORT TRUCKS, TRUCKS AND TRAILERS, TANK WAGONS, PIPELINE, AND LIGHTERS (DLA ENERGY JAN 2012) and F52 TANKER
DEMURRAGE AND LOADING CONDITIONS (DLA ENERGY JAN 2012).
11. Q: For end location Hachinohoe2, is it acceptable for the JA1 to be the same quality as the JA1 the Japanese Self Defense Force (JSDF) uses?
A: The JSDF does not have the same specifications as JA1 being solicited for this line item. All JA1 must meet end location additization requirements and quality specifications, which may be found in the schedule and QAP C1.02 ASSIST (DEC 2016) respectively.
12. Q: Can an offeror change escalators after initial offers? Can an offeror propose alternative escalators?
A: Yes, and offeror may change amongst escalator titles until Final Proposal Revisions, but an offeror cannot request a new title escalator for DLA Energy's consideration after Interim Proposal Revisions. Also, an offeror can submit multiple "either/or" bid lines against alternate escalators, but it please see M3.03 EVALUATION OF OFFERS WHERE ALTERNATE ESCALATORS ARE USED (BULK) (DLA ENERGY JUN 2021) for information on evaluation of alternate escalators, and FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS (NOV 2021), which states that Interim proposal revisions are the last chance to propose alternate escalators.
