ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS
(OCT 2015)
Paragraph (b) entitled – Submission of Offers tailored to read as follows:
1. PROPOSAL FORMAT:
a) This solicitation will be issued utilizing Full and Open Competition in accordance with FAR 6.1.
Award(s) will be made to the Lowest Priced Technically Acceptable Offer meeting or exceeding the acceptability standards of all non-cost factors. The Government intends to evaluate all proposals submitted. Discussions will be held with all responsible offerors whose proposal is determined to be within the competitive range. All proposals shall be in a written format and submitted in English and US Dollars. This solicitation does not commit the Government to pay any costs incurred in the preparation and submission of a proposal or for any other costs incurred by any firm submitting a proposal in response to this solicitation.
Your proposal must be received no later than 03:00 PM local Fort Belvoir, VA (EST) time on 03 March 2017. Offerors shall clearly mark all envelopes/packages sent in response to this solicitation with the words: "OFFERED UNDER SOLICITATION SPE600-17-R-0509”
b) Offeror’s proposal shall be prepared in three separate volumes and provided in the quantities shown below. Technical proposals shall include all relevant information outlined in the Statement of Work (SOW) as well as the evaluation sub-factors identified in the Technical Evaluation Factors of this attachment. Proposals that do not provide the required information in the prescribed format may be excluded from further consideration.

c) During proposal evaluation, each volume will be reviewed separately. All cost/price information, if required, shall be in Volume I – Offeror’s Submission Package and Price.
d) Proposals will be evaluated for technical capability, past performance, and price reasonableness in accordance with the evaluation criteria outlined in the SOW and in FAR Clause 52.212-2 Evaluation – Commercial Items. The rating methodology will be ACCEPTABLE and UNACCEPTABLE.
e) In order to receive full consideration, firms are encouraged to ensure that the information provided in the Technical proposal is factual and complete. To ensure that an accurate evaluation of the proposal is made, please address the factors in the order in which they appear in the solicitation. Each response shall be titled with the name and number of the factor being addressed.
f) While exceptions/deviations are allowed, a proposal will be considered UNACCEPTABLE for award if it contains deficiencies that preclude award of the contract on the present terms of the proposal, that are not correctable or the corrective action would require essentially rewriting the proposal or require the submission of an approach which would be new or almost entirely different from that previously proposed.
g) Offerors may provide additional technical information that will enhance the proposal. However, overly elaborate proposals that contain information not pertinent to this acquisition are not desired.
Elaborate artwork, expensive paper or bindings, and expensive visual or other presentation aids are neither necessary nor desired. Hasty responses or responses which merely repeat the Statement of Work will not be considered as being responsive to the requirements of this Request for Proposal (RFP).
Failure to provide the information requested may render the proposal UNACCEPTABLE and may lead to a rejection of the offer.
h) Prospective offerors are advised that a proposal meeting the minimum objectives, requirements and technical capability with the lowest price will be selected for award. Offerors should submit their best terms and pricing as the Government reserves the right to issue the award based on receipt of initial proposals.
i) The Government may reject any proposal that is evaluated to be unreasonable in terms of program commitments, including contract terms and conditions, or too high or low in cost when compared to Government estimates, such that the proposal is deemed to reflect an inherent lack of technical competence or a failure to comprehend the complexity and performance requirements of the program.
THE FOLLOWING ITEMS REPRESENT THE "PROPOSAL PACKAGE" THAT SHOULD BE
RETURNED IN RESPONSE TO THIS SOLICITATION:
2. VOLUME I – OFFEROR SUBMISSION PACKAGE/PRICE:
(1) Section I
a) Cover Page –
Offerors shall submit a cover page providing the following information regarding the offeror: (1) RFP Number; (2) Proposal Title; (3) Technical Point of Contact, including name, telephone number, FAX number, e-mail address, and mailing address; (4) Administrative/Contracting Point of Contact, including name, telephone number, FAX number, e-mail address, and mailing address; and (5) if proposing as a team, or sub-contractor arrangement, Offeror MUST provide a summary of the responsibility of each teaming partner, sub-contractor (if any).
b) SF 1449 and Amendments.
SF 1449, Solicitation/Contract/Order for Commercial Items – Offeror should ensure the CAGE CODE and DUNS Numbers are placed in Block 17A and complete blocks 30A, 30B, and 30C. Finally, the offeror should sign and date in blue or black ink while ensuring that all changes made are initialed.
Offerors shall provide a signed copy of the SF 1449 and all posted amendments in this section.
c) Exceptions –
Unless you specifically state otherwise, your offer is assumed to accept all Terms and Conditions of this solicitation. Any exceptions to any part of this solicitation in MUST be specifically identified in a cover letter to your proposal. If no exceptions are being taken to the Terms and Conditions of the Solicitation, offerors shall state so in an affirmative statement in this section.
d) Representations and Certifications –
Please review your offer thoroughly, ensuring all of the following: (a) Representations and Certifications are all complete.
Offerors shall include a completed copy of the FAR provision at 52.212-3, Offeror Representations and
Certifications – Commercial Items. This provision is a part of the Offeror’s Submission Package.
(2) Section I (includes Pricing information) – Price
The offeror is required to submit a price proposal for Contract Line Items as stated in the Statement of Work under Contract Provision B-0001-B34.01 Services to be Furnished and Prices (DLA ENERGY FEB 1991). Review your offer thoroughly, ensuring that prices and extended prices have been inserted and are correct. DO NOT SUBMIT PRICING ON YOUR COMPANY LETTERHEAD. For additional information, see FAR 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (OCT 2016).
3. VOLUME II, TECHNICAL CAPABILITY PROPOSAL:
a) The technical proposal shall demonstrate the offeror’s ability to meet the Government’s requirements as set forth in this solicitation. An offeror’s Technical Management proposal shall provide, at a minimum, the information requested in Clause 52.212-1(b), INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS and 52.212-2, EVALUATION – COMMERCIAL ITEMS (OCT 2014).
Failure to provide the information requested by any of the evaluation factors may be considered a “no response” and a rating of “UNACCEPTABLE” given to the applicable factor, sub-factor, element or sub-element.
b) You are required to prepare and submit your proposal aligned with the evaluation factors listed below. Each of your individual responses shall cite the applicable factor and sub-factor and paragraph to which you are responding. Continuation sheets shall clearly identify the solicitation number and your firm’s name on each page.
c) A Technical proposal shall be submitted in response to this RFP. Technical proposals in this RFP shall be limited to 75 single sided, 8 ½” x 11” pages, including Appendices and Attachments. Proposals less than 75 pages are permitted provided all required material is covered. Additional pages beyond 75 will not be considered in the evaluation. The Table of Contents, specific API tank inspection data, and Section I - Exceptions (required) will NOT be considered in the page limit. Type font shall be 12 point Times New Roman with 1” margins around the page. The Non-Price Proposal shall contain two sections: (1) Technical Capability and (2) Past Performance.
(1) Section I – Technical Capability
The Technical Proposal, which consists of eight sub-factors, will demonstrate the offeror’s approach and ability to provide services as referenced in the Statement of Work for lab services.

(2) Section II – Exceptions to SOW
Section II shall state any exceptions taken to the Statement of Work. If no exceptions are being taken to the Statement of Work, offerors shall state so in an affirmative statement in this section.
4. VOLUME III – PAST PERFORMANCE:
The offeror shall demonstrate that their firm has performed services of similar scope and complexity.
The offeror shall at a minimum provide:
a) A list of a minimum three (3) and maximum five (5) contracts representing the offeror’s relevant (similar work experience) and recent past performance, (within the last three (3) years with at least one year of performance), using the attached Past Performance Questionnaire (Attachment 3). Completed Past Performance Questionnaires must be submitted by the REFERENCE. Offerors may elect to consider data from other sources; however, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror. References shall provide Past Performance Questionnaires directly to the Government contract specialist listed on the SF1449 and on the Past Performance Questionnaire.
Note: Offerors who have submitted a proposal for similar services within the last 12 months do not have to submit a questionnaire, but must provide the solicitation number and location of their offer.
b) To receive credit for past performance by a subcontractor, or work which the prime contractor previously performed as a subcontractor to another prime, the Past Performance Questionnaire provided must state in detail the nature of the work performed as a subcontractor, the total percentage of the overall contract performed as a subcontractor and the total amount of work performed as a subcontractor.
To receive credit for past performance by a Joint Venture, the Past Performance Experience Form provided must state in detail the nature of the work performed by either of the Joint Venture partners, the total percentage of the work performed by either of the Joint Venture and the total amount of work performed by either of the Joint Venture.
c) The total dollar value of each contract referenced.
The Government may supplement past performance information provided with any other information it may obtain from any other source including its own experience with your firm.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a) (2) (iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability, “Unknown” shall be considered ACCEPTABLE.
There are two aspects to this Past Performance evaluation: 1) a determination of relevance of other contracts performed to the requirements of the solicitation and 2) a determination of how well the contractor performed on these prior contracts. These two aspects above, when combined, will result in the contractor’s overall performance confidence assessment rating of either ACCEPTABLE or
UNACCEPTABLE.
