C-1.0 General Description: This Statement of Work (SOW) is established to identify the Contractor responsibilities for the period of performance identified in the solicitation or applicable contracting documents distributed by the Contracting Officer. Contractor will be responsible for the laboratory testing of government-owned petroleum products, aerospace liquid/gaseous products in accordance with the standards as described herein, transportation of samples from specified locations to laboratory, third party witnessing and sampling (surveyor) of petroleum storage tanks/vehicles/vessels/barges. Government-owned products mentioned in this SOW located in other regions can be shipped to the contractor’s laboratory for testing, however the contractor will not provide transportation unless requested by DLA- Energy separately. The Middle East Region is defined as the following countries: Kuwait, United Arab Emirates (UAE), Qatar, Jordan, Bahrain, Oman, Iraq and Afghanistan.

C-1.0.1 Service Locations: The Contractor shall be able to provide requested service of this SOW to the requiring locations listed in the table below. Other locations may be added by future modification. The Contractor shall have a facility in the Middle East Region to provide the services required in this SOW. The Contractor does not need to have a facility in the same country as the requiring location, but must still meet turn-around times listed in C-5.5. However, due to accessibility constraints for the countries of Afghanistan and Iraq, Contractor laboratories located in these countries can only service the in-country requirements and cannot be a centrally located laboratory for other countries.

C-1.1 Specifications, Standards and Handbooks: Contractor shall maintain all of the required specifications, standards, test methods, handbooks, etc., per this SOW and contract and perform services in accordance with said requirements. Military Specifications referenced for petroleum product types can be obtained at http://quicksearch.dla.mil or https://assist.dla.mil but can also be supplied by the Contracting Officer or Contracting Officers Representative (COR)

C-1.2 Facilities: The Contractor shall have facilities in accordance with paragraph C-1.0.1 and provide the locations of facilities where the product shall be tested, testing capabilities and contact information. If testing of products requirements cannot be accomplished locally i.e. in the same location or origin, contractor shall submit an exemption request with a detailed plan on where the samples shall be tested and how the location shall meet coordinated turn-around times identified in section C-5.5.

C-1.3 Scheduling of Services: Contractor shall be notified by a DLA Energy representative to coordinate the tests to be performed, the product(s) grade and the quantity of tests requested. Contractor shall not perform petroleum testing without first contacting Quality Assurance Representative if prior contact was not made.

C-2.0 Contractor Detailed Plans (Deliverables): All deliverables shall be submitted to the Contracting Officer for review and acceptance in the Offer’s Submission Package (OSP). Deliverables/plans shall be kept current for the life of the contract. The Government reserves the right to request changes or modifications to any detailed plans at any time throughout the contract performance period. Plans shall be made available for Government review upon request at any time during the contract performance period.

C-2.1 Contract Compliance Plan: The Contractor is responsible for ensuring compliance with all contract performance requirements. The Contractor shall develop an inspection system acceptable to the Government for monitoring overall contract performance. ISO 9001 and/or ISO/IEC 17025 can be considered acceptable with proper certification. The Contract Compliance Plan (CCP) shall include performance requirements for all of the services and specific tasks listed in this SOW and the Contractor’s own performance based plans. The CCP shall include time specific checklists for evaluation of all operational requirements. The CCP shall address procedures for corrective actions including the resolution of any Corrective Action Requests (CAR) and Quality Deficiency Reports (QDR) generated by the Government. Contractor laboratory facilities and personnel and equipment shall be vetted by a DLA Energy Quality representative prior to or during the first order of the performance period unless laboratory was vetted under a previous DLA Energy contract. Periodic site visits will be performed to ensure contract compliance. Contractors which have to sub-contract certain test methods or tasks out, due to whatever circumstances, must inform the contracting officer during the offer period, request for an exception, deviation or waiver (EDW) for that particular task, and have the DLA Energy representative in the region vet that/those processes before or during the first order. The contractor is responsible for all actions taken by any sub-contractor they utilize under this contract.

C-2.2 Contract Contingency Plan: The Contract Contingency Plan shall outline Contractor actions to ensure there is no significant interruption of services resulting from labor disputes, catastrophic failure of equipment, or the effects of natural disasters/emergencies. The plan shall provide specific details regarding labor issues as may result from potential strike actions, military contingency and war time manning requirements, subcontracting as may be required to meet emergent manning requirements, and the replacement of equipment anticipated to be out of service for more than 48 hours.

C-2.3 Contract Training Plan: The Contractor shall provide a detailed plan that identifies employee training requirements and procedures necessary to maintain proficiency. The plan shall identify length of training, training sources and a brief description of courses such as safety, environmental protection and job qualification training. The Contractor is responsible for ensuring all individual training requirements are accomplished. Contractor must demonstrate current participation in a proficiency program or suitable means to verify laboratory performance.

C-2.4 Testing Requirements: The Contractor shall maintain detailed plans regarding the required characteristic tests as presented in attachments 2 and 3 below. Contractor shall maintain all of the necessary testing standards and specifications, as noted in paragraph C-1.1 above. If the contractor is unable to provide certain specification tests, as listed in the maintained standards and specifications, the contractor must request an exception, deviation or waiver (EDW) during the solicitation process and after award if any changes have occurred. EDW request should be detailed with the cause of such request and the contractor’s means of correcting the deficiency. If the contractor plans on using a sub-contractor to perform certain tests

Page | 3 and/or functions, the contractor must provide that information in their plan and to the DLA Energy contracting officer for vetting and approval. The contractor must also ensure they either possess or have access to all referee methods described in the various specifications. If the contractor plans on using another laboratory for either normal sample testing as prescribed in this SOW or for referee method support, the contractor must be able to adhere to the turnaround times listed in C-5.5 below.

C-2.5 Safety Plan: The Contractor shall provide a detailed plan outlining the policy, procedures and actions necessary to maintain a safe working environment for employees and visitors. The plan shall cover the products stored, handled, Safety Data Sheets (SDS) and guidelines regarding the safe handling of such products and shall be maintained and updated over the course of the contract.

C-2.6 Transportation Plan: Contractor is required to submit a plan for review to transport the petroleum samples to an approved laboratory for testing or shipping (contractor supplied transport, third party delivery service, etc.) and how they plan on tracking the chain of custody to the contractor’s facility. Product quality must be preserved and not altered by shipment. DLA Energy or its subcontractor(s) do not have the ability or certification to ship or package fuel samples.

C-3.0 Operating Hours: The Contractor shall be responsible for adjusting hours of operation to avoid overtime and still provide highest level of service to meet workload demands.

C-3.1 Staffing: The Contractor shall provide sufficient staffing to accomplish all functions and tasks to include simultaneous operations. The Contractor’s staff shall be able to communicate in English and flexible and fully capable of meeting the demands of written orders or oral requests made by DLA Energy representatives. Contractor shall provide the contact information for Laboratory Manager or Assistant Laboratory Manager if the laboratory is not manned 24 hours, seven days a week.

C-3.1.1 Labor Reporting: The contractor shall report all contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Defense Logistics Agency via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address:

C-3.1.1.1 Reporting Inputs: The reporting shall be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. C-3.2 Knowledge and Skills: The Contractor shall ensure that personnel assigned to all tasks have the requisite knowledge and skills to meet the performance standards for those tasks and comply with all applicable Country, Federal and state laws, regulations and codes. All supervisors and key employees shall be able to read and understand English so they can understand and follow oral or written instructions directions, directives, regulations, operating procedures and be capable of writing in English to compose required detailed reports.

C-4.0 Information and Records Management: The Contractor shall maintain records evidencing all services performed containing a complete description held or generated by the Contractor. Records shall be open and readily available to DLA Energy for inspection, review and audit for the duration of the contract and any subsequent and contiguous contract periods. In addition, special reports may be requested for audits, inspections, reviews and research. On expiration of the contract, all records except personnel files, training records, equipment records and non-proprietary company management records shall be deemed the property of the government and turned over to the Government.

C-4.1 Monthly Reporting: The Contractor shall report monthly to the contracting officer the number of laboratory tests performed, what testing was included and location.

C-4.2 Invoicing: The Contractor shall provide a copy of test performed for the invoicing period. Each invoice shall be submitted via iRAPT (WAWF) and according to the terms and conditions specified by the Contracting Officer. At the minimum the Contractor shall upload test results performed during the invoiced period. Additionally, the description within iRAPT (WAWF) for each invoice of shall include sample type, date Range of testing, and laboratory location. Attached documentation that includes list of test performed (and unit price for each) and sample identification number.

C-5.0 Laboratory Performance Requirements: The Contractor shall maintain records evidencing all analysis performed under this contract. All samples tested shall be documented with a detailed report which reflects standardized American Petroleum Institute / Institute of Petroleum (API/IP) format. Reports not written in this format shall be returned for correction without prior approval.

C-5.1 Testing Capabilities: Contractor must keep DLA Energy Contracting Officer apprised of any changes to services and proficiencies in regard to this contract. Annually Contractor shall provide contracting officer with a list of testing capabilities, locations testing can be completed and a point of contact.

C-5.2 Access: Contractor shall allow DLA Energy Representatives to witness testing or sampling and provide applicable information for access, provide follow-up to obtain access (for personnel and vehicles) to all facilities that product is tested or sampled. For areas that require special admission the Contractor will assist gaining access.

C-5.3 Laboratories: The laboratories shall have a system of calibration equivalent to ISO 10012-1 or 17025. All testing shall be performed in accordance with the appropriate, international or local test methods that have been approved for use by DLA Energy and listed in this SOW. Laboratories are required to have the listed referee test methods as referenced in the product specifications and international test methods (ASTM, IP, etc.).

C-5.3.1 Epoxy Lined Sample Cans: Contractor shall maintain a supply of 10 unused epoxy lined fuel sample shipping containers to be provided to DLA Energy personnel per request at all locations. Sample containers shall be stored to ensure they are clean and free from all substances that might contaminate the product being sampled. Containers must meet the following specifics: Complies with ASTM D-4306, height not to exceed 9 inches, diameter not to exceed 7 inches, capacity 1 USG, Bung Plug ¾” with lock-wire hole, carrying handle able to be shipped as hazardous material.

C-5.4 Product Testing: Employees must follow all mentioned, laboratory related reference materials listed in this SOW attachments. Samples which fail initial testing shall be retested immediately and prior to submission of any test results. The Contractor shall immediately report any delays to the Contracting Officer, Quality Assurance Representative (QAR) or the Contracting Officer Representative (COR) for resolution.

C-5.5 Turnaround Times Defined: Turnaround time(s) are defined in two separate categories as follows of transportation turn-around time(s) (para C-5.5.1) and sample testing turnaround time(s) (para C-5.5.2).

C-5.5.1 Transportation Turnaround Times: Transportation of samples is defined as when the Contractor takes possession of the sample from locations described in paragraph C-1.0.1 to when the samples are received at the Contractor’s facility. (Testing time of the sample does not apply)

C-5.5.2 Sample Testing Turnaround Times: Testing turn-around times are defined as when the Contractor receives the sample at the laboratory and submits the test reports to the responsible office. All testing requested, per order, shall be completed within the turn-around time listed below. If testing cannot be completed within the turn-around time due to an unusually long processing time as stated within the test method or some other issue which evolves during the process, the contractor will immediately notify the QAR and/or COR. The contractor will specify the problem and the estimated completion date and time.

C-5.6 Retain samples: Samples shall be retained, after analysis, for a minimum of 45 days. In the event of a suspected quality issue or dispute a longer sample retention period may be requested by DLA Energy. The Contractor shall be responsible for disposal of excess fuel samples and sample containers.

C-6.0 Third Party Independent Evaluator Performance Requirements: Contractor shall act as "third party witness" and surveyor as detailed in subparagraphs. Contractor will report to DLA Energy Middle East Region with a detailed report within 24 hours highlighting all facts, figures, positive and negative performance indicators.

C-6.1 Sampling Performance Requirements: The Contractor shall be capable of petroleum product sampling IAW API MPMS and/or ASTM D4057 when requested of vessels, barges, tank trucks, storage tanks or any containers that may hold fuel. Contractor shall supply all equipment and material need to perform task.

C-6.2 Witnessing Performance Requirements: The Contractor shall be capable of supplying "third party witness" and report findings to DLA Energy Middle East Region. Personnel must have the technical expertise and to evaluate operations such as tank trucks uploads/downloads, storage tanks, bulk containers, conversion calculations and laboratory testing procedures via proper ASTM. DLA Energy Middle East Region will supply general written instructions when request is made. Contractor must clearly provide evidence of qualified personnel.

C-7.0 Transportation Performance Requirements: The Contractor shall be responsible for packing and transporting all petroleum samples from job site to the laboratory in accordance with state or federal regulations or laws.

When sample transportation is not required contractor shall be notified (sample delivered to laboratory by another person).

DLA Energy or its subcontractors do not have the ability or certification to ship or package fuel samples.

C-8.0 Joint Contingency Contracting System (JCCS) Requirement: All non-U.S. offerors and all proposed non- U.S. subcontractors must be registered online in the JCCS website (https://www.jccs.gov/).

C-9.0 Special Fuels Performance Requirements: Due to mission demands, DLA Energy Contracting Officer, Quality Assurance Representative (QAR) or the Contracting Officer Representative (COR) may request special petroleum sampling, handling and testing for distinguished visitors which matches the scope of work described in this SOW.

Laboratory testing must be within local area. Specifics shall be given as guidance if a requirement is requested. See sections C 5.5.1 and C 5.5.2 for transportation and sampling turn-around times for these special fuel requests.

Attachment 3: Individual Testing Requirements

Listed below are characteristic tests, by name and method, that may be required to be performed, depending on the product and order, on petroleum products at the contractor’s laboratory in accordance with the requirements set by this SOW.

Contractor must see paragraph C-2.4 for instructions on how to incorporate and indicate if they cannot perform authorized method or a plan where the testing will be done. Tests will be requested by a DLA Energy Quality Representative or COR, through an order, either verbally or via an email request, with either individual, specific characteristic tests or by the series listed in attachment 3, as the situation warrants. The estimated annual quantity of each test is also provided but these quantities are estimates only.

Note: Tests are grouped by physical or chemical property and do not imply equivalency. Verify that the test is appropriate to the product specification prior to analysis.
