(2) Schedule contract provision. The offeror shall insert its proposed unit prices for each line item in the spaces provided in ATTACHMENT 3 REQUIREMENTS SCHEDULE, or as specified in the solicitation.
(3) Offeror Submission. The offeror shall complete the representations and other statements of offerors contained in this solicitation.

(5) Exceptions.
(i) Any exceptions the offeror takes to the terms and conditions of the solicitation must be submitted with the offer. Only exceptions detailed in the offer will be treated as exceptions to the terms and conditions of the solicitation. Any exceptions taken by the offeror will be considered by the Government and either accepted or rejected. Exceptions that are accepted by the Government will be incorporated into any resultant contract; exceptions that are rejected by the Government must be withdrawn by the offeror or the offer will be rejected.
(ii) If the offeror does not take any exceptions, completion of Blocks 12, 17 through 24, and 30 of the SF 1449 signifies the offeror’s agreement to the terms and conditions contained in the solicitation.
(b) TECHNICAL CAPABILITY/RISK SUBMISSION. In addition to its offer, each offeror must provide a response to the following three (3) Technical Capability/Risk subfactors. The proposal shall not simply restate or rephrase the Government’s requirements, but rather provide convincing rationale to address how the offeror intends to meet these requirements. Offerors shall assume that the Government has no prior knowledge of their facilities and experience, and will base its evaluation on the information presented in the offeror’s proposal.
(1) READINESS PLAN. Provide a plan describing the offeror’s effectiveness and efficiency in rapidly responding to the Government’s requirements after Task Orders have been placed. The offeror must also provide a response to ATTACHMENT 1 TECHNICAL PROPOSAL QUESTIONNAIRE as a part of their Readiness Plan. The plan and Attachment 1 should address the offeror’s understanding of all aspects of the effort to be performed, and how it will succeed in meeting the Government’s requirements as identified in the Section C, Performance Work Statement.
(2) RESPONSE AND SUSTAINMENT PLAN. Provide a plan describing the offeror’s effectiveness and efficiency in responding to and sustaining the Government’s requirements after Task Orders have been placed. Address the offeror’s ability to maintain a high level of performance for a span of time. Address the offeror’s capability to swiftly react to a situation.
(3) EQUIPMENT. Identify the offeror’s equipment which is required to load at DFSPs and discharge at FSBs.
(c) PAST PERFORMANCE SUBMISSION.
(1) In addition to its offer, each offeror must complete the applicable past performance information and submit a separate description of any past efforts to subcontract with small businesses, veteran-owned small business, HUBZone small businesses, small disadvantaged businesses, and women-owned small businesses identifying highly successful efforts or any regulatory or subcontracting plan noncompliance. The contracts and/or subcontracts submitted on the Contractor Performance Data Sheet (CPDS) should be similar in nature to the solicitation requirements and completed within the last 3 years. All contracts/subcontracts submitted should have a minimum of one year’s performance history. The Government reserves the right to consider contracts still in progress and to consider contract and/or subcontract information outside the specified time periods.
The contracts may include efforts undertaken on behalf of the Defense Logistics Agency Energy (DLA Energy), other Federal agencies (including those performed for non-DoD activities), quasi-government organizations, State or local governments, and/or private industry. By submitting the CPDS, the offeror agrees to permit the Government’s representatives to contact the references listed and inquire as to the past performance of the offeror.
PAGE 4 OF 8 PAGES
(2) If the offeror determines that it has not performed any contracts or subcontracts for the same or similar work required by the solicitation, the offeror should indicate this on the CPDS by marking the appropriate box.
(d) SOCIOECONOMIC PLAN SUBMISSION (APPLICABLE TO LARGE, SMALL, VETERAN-OWNED SMALL, HUBZONE SMALL, SMALL DISADVANTAGED, AND WOMEN-OWNED SMALL BUSINESSES). If this procurement is for a domestic location, the offeror must provide a description of its efforts to ensure that: small businesses;
HUBZone businesses; women-owned small businesses; veteran-owned small businesses; service-disabled veteran-owned small businesses (SDVOSB); economically-disadvantaged, women-owned small businesses (EDWOSB); and historically-black colleges/universities or minority institutions (HBCUs/MIs) will have an equal opportunity to compete for subcontracts under any resultant contract. The description should include any partnering arrangements with such companies and include specific names to the extent they are known.
52.212-02 EVALUATION - COMMERCIAL ITEMS (OCT 2014) FAR
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. This acquisition will be evaluated using the best value continuum tradeoff process in accordance with FAR 15.101-1 to select the contractor whose proposal represents the best overall value to the Government. The following factors shall be used to evaluate offers:
Factor 1: Technical Capability/Risk Subfactor 1: Readiness Plan Subfactor 2: Response and Sustainment Plan Subfactor 3: Equipment
Factor 2: Past Performance Subfactor 1: Quality of Service Subfactor 2: Schedule Subfactor 3: Business Relations Factor
Factor 3: Price
Factor 4: Socioeconomic Commitment
Offerors may submit offers for one or more zones; however, offers must include a unit price break down for all line items within each zone. Each delivery zone will be evaluated and awarded on a zone by zone basis. Awardees may be awarded multiple zones.
The order of importance of Evaluation Factors/Subfactors (in descending order) are Technical Capability/Risk, Past Performance, Price, and Socioeconomic Commitment. Technical and past performance, when combined, are significantly more important than Price. Socioeconomic Commitment will be rated on an Acceptable/Unacceptable basis.
Factor 1: Technical Capability/Risk will be evaluated utilizing the following subfactors: Readiness Plan, Response and Sustainment Plan, and Equipment. Each subfactor will be rated independently.
Technical Capability/Risk Subfactors will be rated as follows:
TECHNICAL CAPABILITY/RISK EVALUATION RATINGS
Color Rating Description
Blue Outstanding Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses.
Risk of unsuccessful performance is very low.
Purple Good Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.
PAGE 5 OF 8 PAGES
Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
Yellow Marginal Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.
Red Unacceptable Proposal does not meet requirements and contains one or more deficiencies. Proposal is unawardable.
Factor 2: Past Performance will be evaluated utilizing the following sub-factors: Quality of Service, Schedule and Business Relations. An overall integrated assessment rating will be assigned for Past Performance.
The Government will review the offeror’s recent and relevant past performance. Recent past performance is defined as having occurred within three (3) years prior to the solicitation issuance date. Relevant past performance is defined as past performance that is similar in scope, complexity, and dollar value to the subject procurement. Past performance information submitted may include that for performance still in progress; however, it should have a minimum of one year performance history. The assessment of the offeror’s past performance will be used as a means of evaluating the offeror’s ability to meet the solicitation requirements. A record of poor performance may be considered an indication that the offeror has failed to conform to contract requirements and/or to standards of good workmanship, adhere to contract schedules, including the administrative aspects of performance; provide reasonable and cooperative behavior and commitment to customer satisfaction; and/or display a business-like concern for the interests of the customer.
Offerors shall be afforded an opportunity to address adverse reports of past performance, and the offeror’s response, or lack thereof, will be taken into consideration. Recent contracts may be examined to ensure that corrective action measures have been put in place to prevent the recurrence of past performance problems. Prompt actions taken to correct performance problems may be considered a reflection of management concern for customer satisfaction; however, such action may not mitigate all negative performance trends.
The Government reserves the right to consider any information available to it in evaluating an offeror’s past performance. This includes information obtained from the offeror’s references, past and present customers, subcontractors, and any other sources that may have useful information. However, the Government reserves the right not to contact all of the references listed by the offeror. The Government also reserves the right to assess the offeror’s past performance based solely on the offeror’s performance under an existing DLA Energy contract, or a previous DLA Energy contract for work similar to that required by the solicitation.
Past Performance will be rated as follows:
PAST PERFORMANCE RELEVANCY RATINGS
COLOR RATING DESCRIPTION
Blue Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Purple Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Green Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
PAGE 6 OF 8 PAGES
Red Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
PAST PERFORMANCE CONFIDENCE RATINGS
COLOR RATING DESCRIPTION
Blue Substantial Confidence
(SAC)
Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Purple Satisfactory Confidence (STC) Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Green Limited Confidence (LIC) Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
Yellow No Confidence (NOC) Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will successfully perform the required effort.
Red Unknown Confidence (UNC) (Neutral) No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
Factor 3: Price will be evaluated evaluate prices at the line item level per Delivery Zone by performing a price analysis in accordance with FAR 15.404-1(b)(2). The evaluated price per Delivery Zone will be calculated by multiplying the estimated quantity for each line item by the offered unit price for each line item. The results of the price analysis will be incorporated into the Prenegotiation Briefing Memorandum (PBM).
Offerors must offer on the entire quantity to be delivered, as listed for each line item, per Delivery Zone. Offers for less than the entire requirement will not be considered for award.
With regard to evaluating the options, as stated in Solicitation Provision FAR 52.212-2, paragraph (b), the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement per Delivery Zone. The Government may determine that an offer may not be awarded if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options.
Factor 4: Socioeconomic Commitment will be evaluated by reviewing the information submitted by potential vendors to evaluate their proposals demonstrating support of socioeconomic programs and small business concerns. DLAD Provision 52.215-9002 Socioeconomic Proposal defines the information each offeror is to submit and will be used for the evaluation of this Factor.
Socioeconomic Commitment will be rated as follows:
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

2. Amendment 0004 does not extend the closing date of the solicitation per FAR 15.206(c) as its purpose is only for clarification purposes.
