Questions and Answers for Solicitation SPE600-15-R-0406 2/10/2015
Question: Please clarify if possible the contractual responsibility of the Offeror regarding the proposed Special Notice, Questar’s (LDC) Pending Proposed Transportation Imbalance Charge. Specifically, will the Customer expect that any charges for daily out of tolerance situations imposed by the LDC on the Customer’s invoice be reimbursed by the Offeror?
Response: The contractor should bid on current schedule page(s) and rate conditions with the LDC as the proposed rate condition in question has not been approved. The price submitted by the contractor should not be speculative pricing but based on actual tariff and market conditions. Under the current solicitation, the contractor is responsible for keeping the customer within all specified LDC and/or pipeline tolerances (Refer to pg. 9 in the solicitation, (3) Monthly Order Quantities). DLA Energy is cognizant that tariffs can change as referenced in the solicitation on page 12, SECTION H - SPECIAL CONTRACT REQUIREMENTS; which refers to notification of tariff changes. Once written notification is received and the tariff is actually approved and implemented, DLA Energy will enter into negotiations with the contractor to ascertain the most fair and reasonable course of action to adjust for the new tariff. The contractor may be requested to submit certified cost and pricing data to verify that the contractor did not already account /anticipate a future tariff change and incorporate that in their current adjustment factor.
