Evaluation Factors for Award:

52.212-2 Evaluation – Commercial Products and Commercial Services (Nov 2021)

a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Price Technical, and Past Performance.

Technical and past performance when combined, are worth 60%

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). Options will be used on the Contract for maintenance up to 60 months.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

The evaluation method that will be utilized is Lowest price technically acceptable (LPTA) in accordance with FAR 15.101-2. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. The Government intends to evaluate and make awards without discussions unless discussions are determined to be necessary. The evaluation criteria are as follows: Price, Technical Capability, and Past Performance.

A. Price To ensure fair price analysis, each offerors price, for price analysis purposes, will be determined by taking its grand total offer, as well as comparisons to each offeror’s pricing for the CLIN listed. Any significant concerns of CLIN pricing, may lead to clarification requests.

(See Attachment 4 - CLIN LIST)

B. Technical Capability To be technically acceptable each offer must demonstrate it meets all the Technical Factors (including all subfactors) set forth in the attached PWS. This will be evaluated on an “Acceptable” or “Unacceptable” basis. In order to receive an “Acceptable” rating, the offer must clearly demonstrate the ability to provide and perform all services and technical requirements described in the PWS. An offer that is evaluated as “Unacceptable” for any requirement will not be considered for award.

C. Past Performance A past performance review will be conducted to determine whether the Government has confidence that the offeror can successfully perform the requirements set forth in the PWS.

In conducting its past performance assessment the Government may use both data provided by the offeror and data obtained from other Federal Government sources. Data information has to be within the past 5 years and of similar supplies and services. Past performance will be determined on an “acceptable” or “unacceptable” basis.

Past performance shall be used as an evaluation factor within the LPTA process, unless waived by the Procurement Contracting Officer in accordance with FAR 15.101-2(b).

Past performance shall be evaluated in accordance with FAR 15.305 and DFARS

215.305. However, the comparative assessment in FAR 15.305(a)(2)(i) does not apply.

Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings below.

Acceptable: Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable: Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

D. The Government intends to evaluate and make awards without discussions unless discussions are determined to be necessary. After Technical acceptability and Past Performance acceptability are confirmed, the Pricing of each CLIN will be compared to any other submitted pricing for the same CLIN. If necessary, the vendor will be requested to provide further information about pricing to help determine the LPTA vendor.

System for Award Management:

IAW FAR 4.1102(a), Contractors are required to be registered in the System for Award Management (SAM) database at the time an offer or quotation is submitted in order to comply with the annual representations and certifications requirements. Refer to DFARS 204.1103 for helpful information on navigation and data entry in the SAM database. Registration may be done online at www.sam.gov.

52.212-3 - Offeror Representations and Certifications-Commercial Products and Commercial Services Contractors are required to include a copy of the FAR provision 52.212-3 - Offeror Representations and Certifications-Commercial Products and Commercial Services with their proposal. Failure to include or to complete the certifications on the internet may result in elimination from consideration for award. See Attachment 2 - Full Text Provisions (Vendor COMPLETION Required)
