SP451021R0001 - 0002
Amendment 2:
1.The solicitation due date has been extended.
2.The Performance Work Statement has been updated and is listed below. The contractor is now responsible to provide all tools for the performance of MHE maintenance.
3.The price schedule has been updated and is attached. The DBA Insurance separate CLIN has been removed. DBA Insurance is required and shall be included in each labor CLIN.
4.Offeror questions and answers are listed below.
Offeror Questions and Answers:
1.Billable Days:
a.How are the Schedule’s 242 total billable days per year calculated?
Response: 5 days x 52 weeks = 260 - 18 Kuwait/US Holidays = 242 work days. Source for US and Kuwait Local Holidays is Dept of State US Embassy Kuwait website based on CY20.
b.Is it fair to assume that, for example, for a Supervisor that works a full year from 1 March 2021 to 28 Feb 2022, the contractor would end up billing the totality of the CLIN cost as shown for 242 days?
Response: The intent per the PWS is that the Contractor will bill per the # of personnel on ground working per day.
Costs should be built into the bid per CLIN.
c.Does the government intend to disallow the billing of days when staff are sick, or on vacation, or on other excusable or non-excusable days off?
Response: The intent per the PWS is that the Contractor will bill per the # of personnel on ground working per day.
The contractor shall only bill for days employees are onsite. The contractor shall bring in replacement personnel to cover employees that are sick or on vacation.
2.DBA insurance:
a.Is the first task order intended to equate to the Schedule’s Base Option as shown? This is important to determine the base cost of DBA insurance, which is paid in advance for the year, and is non-refundable and increases for any additions and actual salaries paid. This question becomes irrelevant if the DBA CLIN were removed (with DBA costs instead included in each CLIN), as per below.
i.Note/Suggestion:
1.Currently, DBA insurance in the Schedule is set at a fixed cost per person per year. I suggest instead bundling it as part of the price of each position (i.e. “Torch Cutters with DBA insurance”). The reason for this is that the cost of DBA insurance is not fixed per person, but is instead charged as a percentage of each person’s actual pay, which both differs greatly between each position and is affected by the time worked under each contract. Insurers also charge a minimum of $10K per contract to start.
Response: The price schedule has been modified to remove the DBA Insurance CLIN. DBA Insurance is required for all employees and shall be incorporated in the price for each position CLIN.
3.Reduction Notice:
a.As written, PWS 2 appears to state that the government may reduce the contract from 40 staff (“baseline”) to just 4 staff (“10% of baseline”) with 30 days’ notice, an extremely large reduction. However, the contract, as priced for the baseline, would not be economically feasible with only 4 staff. Additionally, local law mandates that all staff be given or paid a full 90-day notice period. Hence, in order to meet the government’s requirement, contractors would need to add significant margins to try to account for this risk, which would otherwise normally be equitably covered by the Changes clause. Could we instead interpret the referenced “drawdown activities” as an event that would happen only following, say, the end of a period of performance, when employees have otherwise received some form of a 90-day notice, or that applies only to the surge staff rather than the baseline? I apologize if I misinterpreted the requirement.
Response: The contract is an IDIQ contract. Each funded task order will list the number of personnel per labor category for a specific period. Reductions on a task order will be processed as a bilateral modification or as a partial termination.
4.Total Evaluated Price:
a.Will the total price as shown in the Schedule (Attachment 7) be used as the Total Evaluated Price in the source selection? Response:
Response: Yes. The total price on the Schedule (Attachment 7) will be used as the total evaluated price in the source selection evaluation.
5.The pricing sheet is only showing for manpower supply, but Scope of work shows the requirement involves management and operation of the DLA yard including processes, controls, QC, Operators for MHE, Maintenance of these MHE, Janitorial, Cleaning and so on. As such where do we price the Operations and Maintenance, plus other indirect costs
PAGE 3 OF 28 PAGES
which is in addition to the cost of providing the required personnel?
Response: All management, operation, any overhead costs, etc should be built into or accounted for in each CLIN cost.
6.To be able to repair and maintain large MHE such as Stackers and high capacity Forklifts we require tools and materials including lifting equipments, specialized tools and original parts list and instructions from manufacturers.
Will these be provided? Can we get a list of such maintenance tools and equipment that are currently available as GFE.
Response: The Contractor should provide all specialized equipment and tools required for maintenance. Government Furnished Property (GFP) should be limited to the appropriate equipment specific manuals and facility related support items (LAMS and ECUs), but no tools. The Contractor shall furnish all equipment to include testing equipment including load banks to test Generators, supplies, materials, parts, supervision, tools, transportation, vehicles, and any other items and services necessary to perform turn-key full service. The Contractor shall be responsible for all GFP and shall maintain work areas in a professional clean and neat manner at all times.
7.For the number of Equipment/s listed in the solicitation the number of personnel shown as operators and mechanics is very small, any specific reason for this?
Response: All the equipment is not used at the same time, some has only occasional use. In addition, the contractor performs maintenance on equipment that is stored in a pre-positioning status.
8.The solicitation states that upon award the contractor should be able to mobilize the personnel within 7 days.
Current Kuwait ministry work schedule may not allow for this short transition and also please note that the ASG- Kuwait gate passes have been put on hold for an uncertain period. Only certain special category are issued installation passes, so will DLA be assisting in gate passes if this situation continues until March 1st, 2021 which is the proposed start date of the contract.
Response: The Contractor will provide a mobilization plan within seven days of award. The Contractor will mobilize within 30 days of award. The USG will assist with Base Access requirements. The Contractor will be solely responsible for all work visa requirements in accordance with host nation labor laws.
9.The solicitation states the USG may request for 90 percent reduction in staffing or 100 percent increase in staffing at a short notice but in Kuwait a work contract has to be issued for a minimum period of 1 year and there are penalties for premature termination of contracts. So can we claim for such costs in the event of sudden reduction of staff for no fault of the contractor?
Response: The contract is an IDIQ contract. Each funded task order will list the number of personnel per labor category for a specific period. Reductions on a task order will be processed as a bilateral modification or as a partial termination.
10.Who is the current vendor performing this contract and what was the previously awarded contract value?
Response: This requirement will replace three contract in Kuwait; SP451019P0014 Al-Tahouna, SP451020P0002 Gulf Civilization, SP451020P0003 Gulf Civilization.
11.Will US government will provide documentation for the project visa for this contract?
Response: The contractor is responsible to obtain worker visas.
12.Kindly confirm, if the incumbent is using the work permits issued by USG. If so, will USG provide an instruction to the incumbents to provide release to the current employees who would like to join with the new contractor for this project.
Response: The contractor is responsible for hiring staff and obtaining all necessary visas, work permits, or any other documentation required by local labor law.
13.Scale Calibration : please provide the scale specifications in order to ascertain the calibration cost.
Response: The two in-ground (permanent) scales are a Fairbank model MT402, and a Fairbanks VT 300.
14.Scale Calibration : pricing template mentioned the quantity as 4 for scale calibration, where as the Solicitation documents listed 2 scales, please clarify.
Response: There are two permanent scales, and two portable scales for expeditionary situations, or deployments, or as backup to the permanent.
15.Please clarify if we need to give the replacement employee in case of sick and the vacation of the employee in each positions.
Response: The contractor shall have to provide replacement personnel in the event of employee sick / vacation days.
16.The pricing sheet is only for manpower supply, but Scope of work includes Management and Operations of the DLA disposition activities including but not limited to processes, controls, QC, Operators for MHE, Maintenance of these MHE, Janitorial services and so on. As such, how do we price the Operations and Maintenance costs, plus other costs which is in addition to the cost of providing the required personnel?
Response: Costs need to be included in the each CLIN for Operations, Maintenance and any other overhead type costs associated with the Contract.
PAGE 4 OF 28 PAGES
17.To be able to repair and maintain almost 200 Equipment that includes a range of MHE such as Stackers/Container handlers, High Capacity Forklifts, Loaders Excavators, Weighing bridge etc in addition to DG's, ECU's and NTVs we require many specialized repair equipments and tools. Will these be provided? Can we get a list of such maintenance tools and equipment that are currently available as Government Furnished Equipment (GFE).
18.For the number of Equipment/s listed in the solicitation the number of personnel shown as operators (7) and mechanics (6) is very small any specific reason for this? Is there any record of the current condition/ status of these equipment?
Response: All the equipment is not used at the same time, some equipment is only occasionally used. In addition, this contract maintains some equipment that is prepositioned in reserve stock. The equipment is currently in operational status.
19.The solicitation states that upon award the contractor should be able to mobilize the personnel within 30 days.
Current Kuwait ministry work schedule will make this short transition a big challenge and also please note that the ASG- Kuwait gate passes have been put on hold for an uncertain period. Only certain special contracts are issued installation passes, so will DLA be able to fast track installation access, if required.
Response: The COR will assist with the base access process.
20.The solicitation states the USG may request for 90 percent reduction in staffing in 30 days or 200 percent increase in staffing for surge in 60 days, but in Kuwait a work contract has to be issued for a minimum period of 1 year and there are penalties for premature termination of contracts. So how can we be compensated for such costs in the event of sudden reduction of staff for no fault of the contractor? Is there a staffing history of the past few months/years for estimation?
Response: The contract is an IDIQ contract. Each funded task order will list the number of personnel per labor category for a specific period. Reductions on a task order will be processed as a bilateral modification or as a partial termination.
