Inspection, Maintenance, and Repair Services for Fire Protection Systems Page 14 of 36

1.0 SCOPE OF WORK

The purpose for this contract is to maintain Fire Protection Systems located throughout the Defense Distribution Center, Susquehanna site in a state of readiness such that if called on in the event of a fire, there is a high level of confidence that these systems will perform their intended function. Fire Protection Systems as used throughout this document refers to either mechanical or electrical systems utilized for the suppression of fires and the notification of fires to building occupants and firefighting personnel.

The basis of all work defined herein is taken from the National Fire Protection Association’s (NFPA), Chapter 25 entitled Inspection, Testing, and Maintenance of Water Based Fire Protection Systems; NFPA 72, National Fire Alarm and Signal Code; and UFC-3-601-02 entitled Operation and Maintenance: Inspection, Testing, and Maintenance of Fire Protection Systems. The Scope of Work shall include two types of service as follows:

1.1 Preventive Maintenance (PM) of fire protection systems includes the periodic inspection and testing to assure operability and reliability of active components in the event these components are called into service. PM is scheduled maintenance and occurs during normal business hours.

1.2 Remedial Maintenance (RM) is unscheduled work that needs to be performed to bring the system back to full performance. This work may be required at any time of day and would typically be in response to a failed or failing component within a fire suppression or fire alarm system.

The Building / Fire Suppression Systems Inventory List (Exhibit 1) is provided to identify each building located on this installation containing sprinklers or other fire suppression systems that will be serviced by this contract. The Building / Fire Alarm Systems Inventory List (Exhibit 2) is provided to identify all buildings that contain fire alarm systems that will be serviced by this contract.

Fire Suppression Systems Maintenance Task Tables (Exhibit 3) are provided to define the preventive maintenance requirements (inspection and testing) and frequency of testing for each fire suppression system identified in Exhibit 1. Fire Alarm Systems Maintenance Task Tables (Exhibit 4) are provided to define the preventive maintenance requirements (inspection and testing) and frequency of testing for each fire alarm system identified in Exhibit 2. The System Inventory Lists and the Maintenance Task Tables described above are subject to change by the Government when component or system addition(s), modifications, and/or deletion(s) are required due to the removal or addition of sprinkler and/or alarm systems resulting from demolition, refurbishment, repurposing of existing buildings, or construction of new buildings.

This is a non-personal services contract to provide Fire Protection Systems Maintenance at the Defense Distribution Center, Susquehanna. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. The Government and the Contractor understand that the services to be provided under this contract by the Contractor are non-personal services and that no employer-employee relationship exists between the Government and the Contractor. The Government may provide technical direction which will assist the Contractor in accomplishing the Statement of Work (SOW); however, the Government will not control the methods used by the Contractor to perform the service requirements set forth in the SOW.

2.0 TECHNICAL DEFINITIONS

As used throughout this contract, the following terms shall have the meaning as set forth below.

2.1 Where "as shown'', ''as indicated", "as detailed'', or words of similar import are used, it shall be understood that reference is made to this SOW and the drawings accompanying this SOW unless stated otherwise.

2.2 Where "as directed", "as required", "as permitted", "approval", "acceptance", or words of similar import are used, it shall be understood that direction, requirement, permission, approval, or acceptance of the Contracting Officer or Contracting Officer Representative is intended unless stated otherwise.

2.3 Contract Line Item Number (CLIN): CLINs serve two purposes: (1) they break the contract down by the commodities being procured (labor hours of services, funding for travel, quantity of product A, quantity of product B, etc.) and (2) they provide for traceable accounting classification citations. 2.4 “Contracting Officer” (KO) is a person with the authority to enter into, administer, and terminate contracts and make related determinations and findings. Only the KO has the authority to change the contract once it is awarded to the contractor. If the contractor agrees to do work outside what it feels is the scope of the contract, and if this order was made by a Government representative other than the KO, the contractor performs this work at its own risk and may not be compensated for doing this additional work.

2.5 “Contracting Officer Representative” (COR) is an authorized person(s) representing the KO acting within the limits of their authority as delegated by the KO. The COR provides technical direction, clarification, and guidance with respect to the contract specifications and SOW.

2.6 The term “Contractor” as used herein refers to both the prime Contractor and any subcontractors. The prime Contractor is responsible for and shall ensure that his/her subcontractors comply with the provisions of this contract.

2.7 Direct Material Costs: The actual vendor invoice charges for materials used for performance of work under this contract. Direct material costs shall include transportation charges when such charges are included on the invoice by the vendor, as well as any discounts allowed for prompt payment and discounts or rebates for core value or salvage value that accrue to the Contractor. When questions arise concerning the cost of materials, material costs shall be based on the lowest of quotes provided by the Contractor from at least three (3) different commercial vendors for these direct material costs. The contractor understands that it is responsible for supporting its purchasing decisions with backup cost data that was relied upon in determining the best purchase on behalf of the Government. The Government retains the right to obtain additional quotes in questionable situations. The lowest price shall be used.

2.8 Facility: An establishment, structure, building, or assembly of units of equipment designated for a specific function.

8.3 The need for RM service by definition is service that is not identified on the maintenance and testing schedule and is therefore unscheduled. The notification of an RM service requirement shall, in most cases, be initiated through a service call from the KO or the COR. The Contractor shall receive the call for RM services in one of two ways as follows:

8.3.1 During Regular Working Hours: The COR will advise the Contractor by phone of any service call requests received during regular working hours as well as the Service Call Classification based on the definitions provided in paragraph 8.4 below. The Contractor shall provide a description of the problem or requested work, date and time received, location, classification, and other appropriate information on a Service Call Work Authorization form (Exhibit 6). A copy of this form shall be forwarded to the KO or COR for written approval. For Routine Service Calls as defined in paragraph 8.4.3 below, the Contractor shall obtain written approval prior to initiating work on the Routine Service Call including the purchase of any required materials or components.

There may be instances where the Contractor identifies an RM requirement as a result of his inspection or testing activities. In these cases, the Contractor shall complete the Service Call Work Authorization form and submit the completed form to the COR for approval prior to initiating any work on this Service Call Work Authorization form.

8.3.2 After Regular Working Hours: The Contractor shall receive service call requests directly from the KO or COR after regular working hours, on weekends, and holidays. Calls received after normal working hours shall be classified by the COR as Urgent or Emergency in accordance with the definitions provided in paragraph 8.4 Service Call Classification below.

8.3.2.1. For urgent or emergency service calls, the Contractor shall be authorized under the direction of the KO or COR, to make immediate required repairs to a Fire Suppression or Fire Alarm system. The Contractor’s authorization is limited to the amount initially discussed between the Contractor and the KO or COR. If, in the opinion of the Contractor, initial costs set forth appear to be inadequate during remedial repairs, contact the COR and provide a revised estimate of the projected costs for the repair. The Contractor shall not exceed the verbal cost limit set by the KO or the COR without authorization.

8.3.2.2. Urgent and Emergency repairs and their associated labor costs shall continue until completion of the repair. The duration of this service call classification continues regardless of the time of day.

8.3.2.3. Upon completion of the urgent or emergency remedial repairs, the Contractor shall fill out and complete the Service Call Work Authorization form. This form shall be submitted to the COR for approval. Maintain an approved copy of this form in the Contractor’s record under the system that the repair was made to.

8.4 Service Call Classification

Remedial Service call classifications shall fall into one of three categories. The call classification shall be determined through the following definitions:

8.4.1 Emergency Service Calls: Service calls will be classified as emergency at the discretion of the KO or the COR. Generally, emergency calls will consist of correcting failures which constitute an immediate danger to personnel, threaten to damage property, or threaten to disrupt activity operations and/or training missions. Examples include, but are not limited to, outages in fire protection systems which support training equipment or provide other vital services, discharging sprinkler system, broken or serious leakage of piping, faulty instrumentation or devices, damaged fire control panels (lightning strikes), etc. These service calls can occur at any time of the day or night.

8.4.2 Urgent Service Calls: Service calls will be classified as urgent at the discretion of the KO or COR. Generally, urgent calls will consist of providing services or correcting failures which do not immediately threaten personnel, property, or activity missions but which would soon inconvenience and/or affect the health or wellbeing of personnel, lead to property damage, or lead to disruptions in operational and/or training missions. Examples include, but are not limited to, nuisance alarms, outages in fire protection systems which support vital facilities and which occur after regular working hours. Calls will also be classified as urgent when the service or failure has upper level or command/management attention. These service calls can occur at any time of the day or night.

8.4.3 Routine Service Calls: Service calls will be classified as routine when the work does not qualify as an emergency or urgent call. Examples include routine repairs to sprinkler systems, fire pumps, water lines, etc. These service calls will occur only during normal working hours.

8.5 Completed Calls: Within one working day after completion of each service call, the Contractor shall add the following information to the Service Call Work Authorization form and return to the COR:

8.5.1 Description of work actually completed.

8.5.2 Brief description of material and parts used, including quantities.

8.5.3 Date and time work began.

8.5.4 Date and time work was completed.

8.5.5 Hours of labor (by trade) expended.

8.5.6 CLIN to charge work against.

8.5.7 Signature or initials of the Contractor's craftsman performing the work (or supervisor), indicating that the work has been completed.

8.6 The Contractor shall maintain sufficient off-the-shelf materials and equipment on hand to support service call work requirements. Lack of availability of materials or equipment shall not relieve the Contractor of the requirement to complete the service call work within the time limits specified in paragraph 9.1, Response Time below.

8.7 If the Contractor determines that repairs need to be performed off-site, the Contractor shall notify the KO or COR in writing providing the make, model, serial number and estimated date for return of the equipment. The Contractor shall be reimbursed for actual transportation costs to and from the remote work location. The Contractor will begin repairs only after approval by the KO or COR.

8.7.1 The Contractor shall comply with all applicable laws, regulations and requirements regarding over-the-road permits. The Contractor shall be responsible for obtaining all necessary permits required to transport Government owned equipment to and/or from the repair facility.

8.7.2 In the event of damage/wreckage to Government owned equipment during transportation, the Contractor shall be liable for the total cost of repairs and/or replacement of damaged or destroyed equipment.

8.8 If repairs are more extensive or cost more than originally estimated or are determined to exceed seventy (70) percent of the value of a new and identical piece of equipment, the Contractor shall obtain the approval of the KO or COR before continuing work.

9.0 PERFORMANCE SCHEDULE

The Contractor shall have adequate procedures for receiving and responding to service calls 24 hours per day, seven days a week, including weekends and holidays. The Contractor shall provide primary and secondary local or toll free telephone numbers for receipt of all service calls. All telephone calls shall be answered by an individual fully familiar with the Contractor's work control procedures and the terms and conditions of this contract. Service calls shall be considered received by the Contractor at the time and date the telephone call is placed by the COR or KO. This includes leaving a voice message on an answering machine.
