Notification of Opportunity Defense Commissary Agency (DeCA), Fort Lee, VA Energy Savings Performance Contract (ESPC) Task Order

1. Notice: Defense Logistics Agency (DLA) Energy on behalf of DeCA of Fort Lee, VA plans to award an ESPC task order using the Department of Energy (DOE) Super ESPC indefinite-delivery, indefinite-quantity (IDIQ) contracts. DLA Energy invites the current 16 ESPC holders to submit a written response to this Notice of Opportunity (herein called the ‘Notice’) for our consideration. Only those 16 DOE ESPC awardees are eligible for award. Offerors shall comply with Section L and Section M, attached, when preparing their response.

2. Authority: The DLA Energy authority is in accordance with the Federal Acquisition Regulation (FAR) 23.205 “Energy-savings performance contracts,” Energy Policy Act of 1992 (EPAct), and DOE Final Rule, 10 CFR 436 Subpart B – Methods and Procedures for Energy Savings Performance Contracting and Energy Policy Act of 1992 (EPA, April 10, 1995).

3. Project Scope: The project scope includes DeCA commissary buildings in the eastern region of the United States. There are 100 available facilities at different locations in the eastern region with a total gross area of 6,794,671 square feet and the fiscal year (FY) 2010 total utility expenditure was $25,409,821. Note: The number of buildings included in the final project scope will be dependent on the results of the Energy Saving Company (ESCO) specific evaluations and consideration. Following is a breakdown of the individual utilities consumptions for DeCA:

DeCA’s purpose for pursuing an ESPC project is to reach its mandated 2015 conservation and renewable goals. Based on the FY 2010 consumption data, the proposed project scope should consider achievement of a 23% energy intensity reduction; a renewable electric energy production of 5.8% of site delivered energy and a potable water reduction of 8.7%. Following is a breakdown of the desired outcome for this project:

A complete listing of the commissary buildings available to be included in the final Investment Grade Audit (IGA) can be found at Attachment A.

4. Project Approach: This acquisition will support the request from DeCA of FT Lee, VA for energy conservation efforts under a DOE IDIQ ESPC. In achieving their energy goals, DeCA is interested in any energy conservation measure (ECM) defined in Attachment J-3 of the DOE ESPC IDIQ basic contract along with any operational improvements. All ECMs will have the Operation and Maintenance (O&M) performed by the selected ESCO.

In accordance with the task order selection process of the DOE ESPC IDIQ contract, the Government will be using the ESCO down selection approach to determine best value to the Government. The interested ESCO will submit the requirements of this Notice along with a proposed project scope, based on the sample building data provided in Attachment B, which reflects the most advantageous energy savings to support DeCA’s energy goals. The Government directed sample commissary is considered typical for all 100 DeCA commissaries. This sample project development is for evaluation purposes only in the selection of a successful offeror. However, it should be noted that ESCOs will not be permitted to deviate substantially from the Measurement and Verification (M&V) approach, Commissioning Requirements and Quality Control Approach proposed in the response to the Notice and that proposed in the final IGA unless authorized by the Contracting Officer.

The index rate, escalation rate and utility rates that are to be utilized in the development of the sample project are provided in Attachment C. The contractor shall use the Davis Bacon Wage Determination, Attachment F, and Service Contract Act Decision, Attachment G, as provided. A site visit for this effort will not be necessary nor conducted. ESCO are provided as-built drawings of the sample facility from which to propose.

The Government will assess responses to this Notice to determine each ESCO’s capability to perform a project of this magnitude. Responses to this Notice will be evaluated against the following evaluation factors:

Factor 1: Technical Capability

Subfactor 1 – Proposed Scope of Work
Subfactor 2 – Energy Savings Achievement
Subfactor 3 - M&V Approach

Subfactor 4 – Commissioning Requirements Subfactor 5 – Quality Control Approach Factor 2: Past Performance Factor 3: Cost/Price

There are five subfactors under the Technical Capability: 1) Proposed Scope of Work, 2) Energy Savings Achievement, 3) M&V Approach, 4) Commissioning Requirements, and 5) Quality Control Approach. Technical capability subfactors are listed in descending order of importance. Each technical capability subfactor of Factor 1 is more important than Factor 2, Past Performance. When the non-cost factor and subfactors are combined, they are significantly more important than Factor 3, Cost/Price.

The selection will focus on an ESCO’s illustration of technical expertise and of conservation and renewable goal achievement, ability to perform previous projects of this magnitude and planned approach to various basic contract requirements for energy projects of this nature. The Government’s assessment will be based on an ESCO’s likeliness to successfully perform the project considering its submissions in response to this Notice.

The Government may select one contractor to perform a preliminary assessment (PA) as described in paragraph H.4, Preliminary Assessment Content Requirements for Task Orders of its DOE ESPC. Upon acceptance of the PA, the selected contractor may be issued a Notice of Intent to Award at which time that contractor will begin the IGA process as described in paragraph H.5, Investment Grade Audit for Task Orders.

The resultant task order will be awarded to the offeror that provides the best technical approach for achieving energy conservation and renewable goals, and that efficiently and effectively represents the greatest level of savings using an achievable strategy.

5. Procedures /Process: Interested DOE ESPC contractors shall comply with this Notice, its attachments, along with Section L, Instruction to Offerors, Attachment H, for the offeror’s submission requirements. Also attached is Section M, Evaluation of Offers, Attachment J, which defines the evaluation criteria that will be used in determining the offer that represents the best value to the Government.

6. A pre proposal conference and site visit for this project will be conducted on 05 Apr 2012 at 0800 hours EST to present proposal requirements, view the sample commissary and address questions. ESCOs are encouraged to review the Notice of Opportunity and its attachments prior to attending the pre proposal conference and site visit. Be advised that attachment B, Sample Site Data, is not included in this Notice. A disc has been prepared containing these drawings and will be furnished to each ESCO at the pre proposal conference. Each ESCO will be permitted to have only two people in attendance. It is not mandatory to attend the pre proposal conference to submit a proposal. Should an ESCO not participate in the pre proposal conference, the disc will be mailed via US Postal Service immediately following the event. The pre proposal conference will not be made available by telephone or video. Please notify DLA Energy – AP, Cynthia Obermeyer, Contracting Officer, 703-767-5167 or cynthia.obermeyer@dla.mil, no later than 30 Mar 2012 to make necessary arrangements to attend the pre proposal conference.

7. Submission Requirements: All interested ESCOs should provide the required information to DLA Energy no later than 11 May 2012, 4:00 PM. EST. Emailed or facsimile offers in response to the Notice of Opportunity are not acceptable.
