About this file
This document contains the Contract Terms and Conditions for a Sorbent Pads Master Agreement issued by the State of Maine's Department of Environmental Protection through the Division of Purchases. The contract is a one-year agreement with the possibility of two additional one-year extensions. The scope requires vendors to furnish sorbent pads to meet the Department of Environmental Protection's normal operational requirements. Deliveries must be made to any of three designated Maine DEP Response Warehouse locations in Bangor, Augusta, or Portland, with vendors required to provide 24-hour advance notice prior to delivery. The Department will evaluate specific characteristics of the pads through testing before contract award, with detailed specifications provided separately. The estimated value of the contract is approximately $20,000 annually, though the actual contract value will reflect quantities ordered during the contract term.
Pricing under the contract must remain firm throughout the contract duration and includes all transportation charges with FOB destination terms. The State of Maine is exempt from excise taxes and will provide exemption certificates upon request. Vendors are required to accept the State of Maine Procurement Card as a form of payment with no surcharges permitted. Orders of $5,000 or less are transmitted via email as PDF files, while larger orders require Division of Purchases approval and encumbrance. Contractors must submit separate invoices for each order within 30 days of delivery, referencing the contract number and Federal ID number. Additionally, vendors must indicate their willingness to extend contract pricing to Maine political subdivisions and school districts, either unconditionally, with specified conditions, or not at all. The State reserves the right to cancel the contract with 30 days' written notice or immediately if the contractor fails to conform to terms or changes product specifications.
