About this file
This document contains the contract terms and conditions for a Master Agreement between the State of Maine Department of Environmental Protection and a vendor for the supply of sorbent booms. The contract period is one year from the date of award with the possibility of two additional one-year extensions at the Director of Purchases' discretion with contractor consent. The scope of work requires the vendor to furnish sorbent booms to meet the normal requirements of the Department of Environmental Protection. The vendor must deliver products to any of three specified Maine DEP Response Warehouse locations: Bangor, Augusta, or Portland. The contractor is required to provide 24-hour advance notice prior to delivery and must ensure all items arrive in first-class condition. Department of Environmental Protection staff will evaluate specific characteristics of the booms prior to contract award to ensure compliance with specifications.
Pricing for the contract is based on an estimated annual value of approximately $20,000, though the actual contract amount will be determined by quantities ordered during the contract term, whether more or less than the estimate. Contract prices must remain firm for the duration of the agreement and include all transportation charges with FOB destination terms. The State of Maine is exempt from excise taxes and will provide exemption certificates upon request. Vendors must accept the State of Maine Procurement Card as a form of payment with no surcharge allowed regardless of payment method. Invoices must be submitted separately for each order, reference the contract number and Federal ID number, and be issued within 30 days of delivery. The contractor must furnish a detailed yearly purchase summary report to the contract administrator, Terry L. DeMerchant. Additionally, vendors are encouraged to extend contract pricing to political subdivisions and school districts in Maine, and must indicate in their bid submission whether they will accept such orders unconditionally, with conditions, or not at all.
