About this file
This document is Addendum 6 for Request for Proposal (RFP) NSP7149 Z1 issued by the Nebraska State Patrol (NSP), addressing questions and answers related to a Computer Aided Dispatch (CAD) and Mobile Data System procurement. The RFP seeks a comprehensive technological solution to support statewide dispatch operations, with proposals due on July 22, 2024, at 2:00 PM CST. The contract term is five years, with potential renewals for five additional one-year periods. The system must integrate with over 20 existing interfaces, including Active Directory, AVL systems, body-worn cameras, crash reporting, eCitation, E911, emergency management, and various law enforcement databases.
The procurement covers approximately 482 sworn and 240 civilian staff, with an expected 350 mobile users across multiple communication centers. While specific budget details are not disclosed, the RFP requires comprehensive pricing for software/subscription fees, interface software, professional services, and third-party integrations. Seven vendors have submitted bids, including ProPhoenix Corporation, SmartCOP, Inc., Tyler Technologies, Inc., Motorola Solutions, Inc., 10-8 Systems LLC, Central Square, and 22nd Century Technologies. The evaluation process allocates 25 points for Corporate Overview, 65 points for Technical Approach, and 10 points for Cost Proposal, totaling 100 points without oral interviews and potentially 120 points with interviews. The state reserves the right to contract for similar services from other sources, indicating the contract is not exclusive.

Can you clarify/define what you are requesting to see
in this section. (It is not self explanatory and we do not want to assume what should be added here.
Answer: The bidder’s Development Approach is defined as refers to the method used to create and evolve a product, service, or result during a project’s life cycle. For example, does the bidder use any of these developmental approaches to engineering the CAD/MDS solutions: Agile? Iterative? Incremental? Hybrid?

Paragraph 9.
“the State of Nebraska reserves a royalty-free, nonexclusive, and irrevocable right to copy, reproduce, publish, post to a website, or otherwise use any contract, proposal, or response to this Request for Proposal for any purpose, and to authorize others to use the documents.
Any individual or entity awarded a contract, or who submits a proposal or response to this Request for Proposal, specifically waives any copyright or other protection the contract, proposal, or response to the Request for Proposal may have; and acknowledges that they have the ability and authority to enter into such waiver.”

Can the State provide some further clarification as to
why it is needs and requires a perpetual irrevocable license to copy, reproduce, publish, post to a website, or otherwise use any contract, proposal, or response to this Request for Proposal for any purpose, and to extend those rights, and further, to authorize others to use the documents. Additionally, can it provide clarification as to why it is requiring the proposers or contract awardees to waive any and all copyrights in any submissions to this RFP. The potential proposer understands and acknowledges that its submissions may be subject to freedom of information obligations, but these requirements seem to go beyond facilitating public postings, and granting rights in what could be considered its intellectual property (such as screenshots, which are not just pictures, but representations of the look, feel, and content of any proposer’s software), not just to the Agency, but to any person who has access to the information for whatever purpose they have.
Answer: The paragraph exists in regards to our State Public Records Laws that state all expenditures involving public funds are to be liberally construed to allow for the public to have the full right and access to the information on the public finances of the government and it’s agencies. The language makes clear that the contract, proposal, or response to this solicitation may be used by the State of Nebraska and authorizes use by others, which includes public record requests, and that the documents may not be shielded under exceptions by contract law or statute.
This addendum will be incorporated into the solicitation.
