ITEMS

GENERAL INSTRUCTIONS

Questions/Comments for the RFQ must be submitted via email to kaiti.williams@bep.gov no later than August 6, 2025, at 2:00 PM ET to ensure Government consideration.

a. When submitting questions and comments, please refer to the specific text of the RFQ in the following format:

Subject: RFQ No. 2031ZA25Q00197 Reference: RFQ Section ______, Paragraph(s)______, Page(s)_____.

b. Answers to questions will be provided to all quoters being solicited, giving due regard to the proper protection of proprietary information.

2. This portion of Instructions to Quoters provides general information preparing the quote.

a. The Quoter’s quote must include all data and information requested herein and must be submitted in accordance with these instructions.

b. The Quoter’s quote shall be clear, concise, and include sufficient detail for effective evaluation of the Quoter’s capabilities to perform the requirements outlined in the

PWS.

c. Quoter is advised that their quote should agree to hold the prices in its quote firm for 90 calendar days. Provision 52.212-1, paragraph (c) is hereby tailored to extend the 30-day response period out to 90 days.

3. This section provides specific instructions on the format and content of the quote. Each section shall be a “stand alone” document and be complete by itself. All quote documents shall use 12-point font in either Arial, Calibri, or Times New Roman fonts. Page limits are listed with each Section and are not-to-exceed; each Section must be submitted as separate files (preferably PDF).

Each quote shall consist of three (3) separate documents:

• Factor 1 – Technical Approach

• Factor 2 – Past Performance

• Factor 3 – Price

FACTOR 1 – Technical Approach (15 Page Limitation)

Quoter shall submit a written response of their proposed solution for meeting or exceeding the Government’s requirements set forth in the PWS. The BEP shall determine whether the quoter has consistently demonstrated the required expertise and a commitment to customer satisfaction and timely delivery of services through an assessment of the quoter's quality of work, timely performance, effectiveness of management, and compliance with labor and safety standards. The quoter shall submit no more than 15 pages demonstrating the quoter’s capability to meet the requirements as stated in the attached PWS.

TECHNICAL ASSUMPTIONS

No Assumptions, Conditions, Exceptions are permitted. Any response containing Assumptions, Conditions, or Exceptions will be rejected and ineligible for award.

FACTOR 2 – Past Performance (No Page Limitation)

Quotes will be evaluated based on the quoter’s past performance in carrying out projects for Government agencies or commercial entities that are similar in scope to the requirements of the PWS. The quoter will provide no more than three examples of projects that were carried out within the last five years. Each example will include the following project information:

• Contract Title and Number

• Period of Performance

• Name and contact information of the client (for Government agencies, provide the name of the agency and either the Contracting Officer or the Contracting Officer’s Technical Representative)

• Approximate number of personnel, by major position and skill category, used on each project

• Approximate dollar value of each project

• A synopsis of work carried out under each contract that describes the key tasks carried out and an explanation of how that effort is comparable to the requirements of the PWS and how the successful completion of that contract will facilitate the Offeror’s ability to carry out the requirements of the PWS and perform all tasks at a level that consistently meets or exceeds performance standards.

The Government will assess the degree of success of quoter’s recent and relevant past performance. References will be asked to comment on items such as business relations, timeliness, quality of work, and cost. The Government will give an acceptable rating to documented successful outcomes that are supported by outside source confirmation (e.g.

but not limited to telephone interviews with points of contact identified in the quote, agency performance databases such as Contractor Performance Assessment Reports (CPARS), offeror furnished references, or personal knowledge). Successful outcomes are defined as having received a rating of satisfactory or better, or the equivalent. If the Government does not obtain past performance information and cannot establish a past performance record for the quoter through other sources, or if the quoter has no past performance record, past performance will be rated neither favorably nor unfavorably and considered neutral. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

FACTOR 3 – Price (No Page Limitation)

Quoters shall complete a Schedule/Supplies table (see Supplies or Services and Prices/Cost, Section 2, page 4) and attach this page separately. Quoters must quote prices for all service line items to be considered for award. All pricing shall be inclusive of all quoter’s direct cost (labor, training and travel), indirect costs, and profit. Quoter shall provide a full break down of all cost. (Please refer to Performance Work Statement).

The price quote will be evaluated (but not scored) based on total price reasonableness.

The quoter’s quote is presumed to represent the quoter’s best efforts in response to the solicitation. Any inconsistency, whether real or apparent, between promised performance, and cost or price, shall be explained in the quote.

Quoters shall not include any price data in the technical quotes.

PRICE ASSUMPTIONS

No additional Assumptions, Conditions, Exceptions are permitted. Any response containing Assumptions, Conditions, or Exceptions will be rejected and ineligible for award.

52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(NOV 2021)

The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

• Factor 1 -Technical Approach

• Factor 2 – Past Performance

• Factor 3 – Price

Basis of Award

The Government intends to make an award to the responsible quoter(s) whose quote(s) is based on the Lowest Price Technically Acceptable (LPTA) procedures in accordance with FAR Part 12 and 13 as supplemented. Award will be made to the acceptable quoter(s) with the lowest evaluated price, which is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), 13.106-2 Evaluation of Offers, and whose quote conforms to the solicitation requirements. The Government will not award a contract on the basis of an unacceptable quote.

Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s). The Government will calculate any six (6) month extension, exercised under FAR 52.217-8 Option to Extend Services, based on the average price of the last six (6) months of the final Contract Line Item Number (CLINs) with a period of performance ending in 2030.

A written notice of award or acceptance of a quote, emailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Selection of a Quoter for contract award will be based on evaluation of quotes against the factors identified in this section. Principles and procedures of Subpart 15.3 do not apply.

The Government reserves the right to make an award based on initial quotes received, without discussion of such quotes in accordance with FAR provision 52.215-1, or the Government may make award after clarifications of some aspects of the quote.

Accordingly, the Government reserves the right to do any or all of the following:

a. Award on initial quotes, without discussion.

b. Ask clarifying questions during the question-and-answer period if needed. Clarification questions may include asking quoters to clarify their written technical quotes. As a result, the Government may have communications with some, but not all, quoters;

these communications, however, will be clarifications and not discussions. In these situations, the Government will consider the quoter’s clarifying response(s) without allowing quote revisions.

c. Have communications; ask clarifying questions, request corrections relative to minor errors in the written quote or request substantiating documentation to facilitate the

Government’s final evaluation with one or some quoters. These communications, clarifications, or requests for corrections or substantiating documentation will not materially change the quoter’s quote in terms of conformance to RFQ requirements, constitute discussions such as the removal of an unacceptable assumption.

Quotations shall set forth full, accurate, and complete information as required by this solicitation package (including Attachments). The penalty for making false statements in quotations is prescribed in 18 U.S.C. 1001.

TECHNICAL EVALUATION CRITERIA

The Government will evaluate technical quotes based on the following factors:

Factor 1 – Technical Approach The Government will evaluate quotes for technical acceptability. Quotes will be evaluated using an Acceptable or Unacceptable rating approach. The following ratings standards shall be used:

Rating Standard for Factor 1: Technical Approach

ACCEPTABLE UNACCEPTABLE

Quote meets the requirements of the solicitation as described in the Performance Work Statement.

Quote does not meet the requirements of the solicitation as described in the Performance Work Statement.

Factor 2 – Past Performance will be evaluated using an Acceptable, Unacceptable, or Neutral rating approach. The following ratings standards shall be used:

Rating Standards for Factor 2: Past Performance

ACCEPTABLE UNACCEPTABLE NEUTRAL

Based on the quoter’s performance record, the Government has a reasonable expectation that the quoter will successfully perform the required effort, or the quoter’s performance record is unknown.

Based on the quoter’s performance record, the Government does not have a reasonable expectation that the quoter will be able to successfully perform the required effort.

No recent/relevant past performance record is available; a meaningful assessment rating cannot be assigned

PRICE QUOTE EVALUATION

Factor 3 – Price The quoter’s price quotation will be evaluated to assess for price reasonableness in accordance with FAR 13.106-3(a). Specifically,

1. The principal basis for evaluating cost/price for award under this solicitation will be an evaluation of the fair and reasonableness of the quoter’s quoted price in response to Section 2, Supplies or Services and Prices/Costs on page 4 of this solicitation.

Cost/price quotes will be evaluated for completeness, accuracy, and reasonableness and to ensure that the quoter’s understand the scope of the work included in the solicitation. Quotes containing inaccurate pricing information will be deemed ineligible for an award and will not be further evaluated.

2. Cost/price quotes will not be rated adjectivally or scored. The cost/price that will be evaluated is the quoter’s “total proposed cost/price.” As such, the Government will use any combination of the quote analysis techniques stipulated under FAR Subpart

15.404 or FAR 13.106-3 to aid in the price evaluation process.

3. The Government will calculate any six (6) month extension, exercised under FAR 52.217-8 Option to Extend Services, based on the average price of the last six (6) months of the final Contract Line Item Number (CLINs) with a period of performance ending in 2030.

The Government reserves the right to reject any quotation that includes overtime or extended hours billing practices.
