(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6 of the Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
(ii) This solicitation is issued as a Request for Proposal (RFP).
(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-05.
(iv) This procurement is set aside for total small business. The NAICS code is 221310 - Water Supply and Irrigation Systems and the Small Business Size Standard is $41.0M.
(v) Schedule of Items/Price Schedule

Schedule Notes: The bidder must bid on all items. Only unit prices to the nearest $0.01 will be accepted. Where extended unit prices do not agree with totals or subtotals shown by the bidder, the unit price governs except as provided under the Federal Acquisition Regulations (FAR) 14.407, Mistakes in bids. The Government reserves the right to request additional information as required to fully understand the contractor’s pricing structure and determine its reasonableness.
(vi) Description of Requirement
• This is for the acquisition of professional water system operation and maintenance services for eleven water systems owned by the USDA Forest Service, Pike and San Isabel National Forests, Cimarron and Comanche National Grasslands (PSICC). The PSICC is responsible for the safe and legal operation of various water systems across the Forest. Contractor shall be the Operator in Responsible Charge (ORC) for all water systems within this contract. The Operator in Responsible Charge shall have a minimum level “B” water treatment license and level “1” distribution license valid for the duration of the contract in the state of Colorado. Contractor and/or their employees shall perform the duties of Water Treatment Plant Operator for the water treatment systems.

FAR 52.212-1 Instructions to Offerors – Commercial Products and Commercial Services (SEP 2023) (Provision) Addenda to Provision FAR 52.212-1 paragraph (b) Submission of Offers:
1) Offerors must have an active entity registration in the System for Award Management in order to submit an offer. https://www.sam.gov/SAM/
2) Offers submitted in response to this solicitation shall include a technical proposal and a price proposal, and contractor representations and certifications.
a) Technical Proposal – The technical proposal shall address the evaluation factors in FAR 52.212-2. At a minimum technical proposal shall include:
1) Past Performance. Page Limit: No more than 3 pages. Furnish a list of three (3) projects of similar magnitude completed by the firm within the last three (3) years.
The list should include work similar in nature and complexity to that required by this solicitation. Include contracts with the Federal Government, agencies of state, local governments, and commercial customers. For each project cited, provide the following:
o Name and location of the project.
o Project Point of Contact’s name, phone, email address, and fax numbers.
o Total cost of the project.
o A brief narrative of the project (include size, i.e. acres, square feet; date of start, and completion or anticipated completion date).
2) Experience/ Key Personnel. Page Limit: No more than 3 pages. The offeror shall provide a detailed summary of experience with work similar to the type of work required under this project. Provide a list of personnel with job titles and years of experience.
b) Price Proposal:
1) The completed Schedule of Items from Section B of this solicitation. All blocks must be completed by the offeror. All base and optional items must be priced.
2) Acknowledgement of any amendments to this solicitation by following the instructions that accompany the amendment(s).

FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) (Provision)
(a) Proposals will be evaluated using the Tradeoff Process as defined in FAR 15.101. This process permits tradeoffs among price and non-price factors and allows the Government to consider award to other than the lowest priced offeror or other than the highest technically rated offeror. Evaluations will be conducted in accordance with FAR 15.305 Proposal Evaluation. The Government will evaluate proposals and assess their relative qualities solely on the evaluation factors specified in this solicitation. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. Past performance and technical capability, when combined, are approximately equal to price.
The following factors shall be used to evaluate offers:
Factor 1. Past Performance
The Government will evaluate the Contractor’s past performance based on recency (work performed within the last three years) and relevancy (work performed within the same scope, magnitude, and complexity). “Administrative proceeding” means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at FAR 52.215-2, Audit and Records- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services.
Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
