52.212-2 Evaluation — Commercial Products and Commercial Services (Nov 2021) (DEVIATION Mar 2026)

(a) Evaluation factors: The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

(i) price; Low Price - The Government will evaluate quotes in groups of three (3), beginning with the lowest‑priced quotes and proceeding upward in price increments until an awardee is identified. Once a responsible, lowest‑priced offeror is selected from within any group, the evaluation process will stop, and award will be made to that offeror. Although price is the sole evaluation factor, the apparent lowest‑priced offeror must first undergo a responsibility determination in accordance with FAR 9.104‑1. This determination will assess the offeror’s financial resources, ability to meet the required performance schedule, past performance record, integrity and business ethics, organizational and technical capability, and the availability of—or ability to obtain—the necessary equipment, facilities, and controls. The Government may use any appropriate methods to conduct this assessment, including review of financial information, past performance systems, integrity and eligibility databases, pre‑award surveys, and evaluations of technical and organizational capacity. Award will be made to the lowest‑priced offeror found to be responsible within the evaluated group.

Prime contractors who submit quotes but are not registered under NAICS code 561730 as a small business will be deemed nonresponsive and will not be considered for award in accordance with FAR 19.501(e), FAR 19.102(a)(3), FAR 10.102, 13 CFR 121.201, and 13 CFR 121.404

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an https://www.sam.gov/ https://www.napex.us/ https://www.napex.us/ https://www.apexaccelerators.us/#/

AWARD SELECTION PROCESS

The Government will evaluate quotes in groups of three (3), beginning with the lowest‑priced quotes and proceeding upward in price until an awardee is identified. Once a responsible, lowest‑priced offeror is selected within any group, the evaluation process will stop, and award will be made to that offeror. For award purposes, the Government will evaluate offers by adding the total price for all option periods to the total price for the basic requirement. The Government may determine an offer unacceptable if the option prices are significantly unbalanced; however, evaluation of options shall not obligate the Government to exercise any option. Although price is the sole evaluation factor, the apparent lowest‑priced offeror must undergo a responsibility determination in accordance with FAR 9.104‑1. This determination will assess the offeror’s financial resources, ability to meet required delivery or performance schedules, past performance record, integrity and business ethics, organizational and technical capability, and the availability of or ability to obtain the necessary equipment, facilities, and controls. The Government may use any appropriate methods for this assessment, including review of financial information, past performance systems, integrity and eligibility records, pre‑award surveys, and evaluations of technical and organizational capacity. Award will be made to the lowest‑priced offeror found to be responsible within the evaluated group.

Quotes will receive a preliminary review to determine whether the quote contains sufficient information, as required by the solicitation, to allow the government to perform a meaningful evaluation. If the results of this preliminary review indicate that the quote lacks sufficient information to allow a meaningful evaluation to be conducted, the Contract Specialist/Contracting Officer may eliminate the quote from further evaluation and consideration for an award.

Prime contractors who submit quotes but are not registered under NAICS code 561730 as a small business will be deemed nonresponsive and will not be considered for award in accordance with FAR 19.501(e), FAR 19.102(a)(3), FAR 10.102, 13 CFR 121.201, and 13 CFR 121.404.

52.217-8 Option to Extend Services (Nov 1999)

These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15-calendar days before the period of performance end date.

(End of clause)

52.217-9 Option to Extend the Term of the Contract (Mar 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 calendar days before the period of performance end date; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 15 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension.

Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.
