About this file
This is a Request for Quote (RFQ) solicitation for riparian cut-stump herbicide application services for saltcedar treatment at the Bureau of Land Management's Socorro Field Office in New Mexico. The solicitation is designated as a Women-Owned Small Business (WOSB) set-aside with 100% reservation for women-owned small businesses. The requisition number is 0044057645, solicitation number is 140L1726Q0056, and the offer due date is September 6, 2026, at 0800 Mountain Daylight Time. Quotations must be submitted in two parts: Part I (non-price factors) and Part II (pricing proposal), both in PDF format to scott_voigt@ios.doi.gov. The period of performance runs from September 25, 2026, to November 24, 2026, with delivery required by November 24, 2026. Questions must be submitted within seven calendar days of the solicitation issuance date (August 28, 2026), and all quotes must remain valid for a minimum of 120 days.
Evaluation will consider technical factors (contractor experience with riparian cut-stump herbicide application services, detailed work plan, and past performance) weighed equally with each other but collectively less important than price. Contractors must provide a list of at least three completed or ongoing projects from the past five years, with at least one completed in the past five years, including project name, dates, description, location, owner contact information, and dollar value. The government will conduct price analysis comparing quoted pricing against independent government estimates and historical market data. The NAICS code is 115310 (Support Activities for Forestry) with a size standard of $11.5 million. Payment will be made electronically through the Invoice Processing Platform (IPP) system. The contract incorporates standard FAR clauses including service contract labor standards (GS-0400-05 at $16.51/HR), small business limitations on subcontracting (50% for service contracts), and prohibitions on racially discriminatory DEI activities. All attachments include project maps, access information, herbicide guidance documents, and a detailed Statement of Work for the saltcedar treatment project.

(b) Definition. Similarly situated entity, as used in this clause, means a first-tier subcontractor, including an independent contractor, that-
(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status); and
(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.
(c) Applicability. This clause applies only to-
(1) Contracts that have been set aside for any of the small business concerns identified in 19.000(a)(3);
(2) Part or parts of a multiple-award contract that have been set aside for any of the small business concerns identified in 19.000(a)(3);
(3) Contracts that have been awarded on a sole-source basis in accordance with sections 19.105, 19.106, 19.107, and 19.108;
(4) Orders expected to exceed the simplified acquisition threshold and that are set aside for small business concerns under multiple-award contracts, as described in 8.4 and 16.5;
(5) Orders, regardless of dollar value, that are set aside in accordance with sections 19.105, 19.106, 19.107, and 19.108 under multiple-award contracts, as described in 8.4 and 16.5; and
(6) Contracts using the HUBZone price evaluation preference to award to a HUBZone small business concern unless the concern waived the evaluation preference.
(d) Independent contractors. An independent contractor shall be considered a subcontractor.
(e) By submission of an offer and execution of a contract, the Contractor agrees that in performance of a contract assigned a North American Industry Classification System (NAICS) code for-
(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded.
When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract;
(2) Supplies (other than procurement from a nonmanufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded.
When a contract includes both supplies and services, the 50 percent limitation shall apply only to the supply portion of the contract;
(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 85 percent subcontract amount that cannot be exceeded; or

Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 75 percent subcontract amount that cannot be exceeded.
(f) The Contractor shall comply with the limitations on subcontracting as follows:
(1) For contracts, in accordance with paragraphs (c)(1), (2), (3) and (6) of this clause-
[Contracting Officer check as appropriate.]
[ ] By the end of the base term of the contract and then by the end of each subsequent option period; or
[X] By the end of the performance period for each order issued under the contract.
(2) For orders, in accordance with paragraphs (c)(4) and (5) of this clause, by the end of the performance period for the order.
(g) A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (e) of this clause will be performed by the aggregate of the joint venture participants.
(1) In a joint venture comprised of a small business protégé and its mentor approved by the Small Business Administration, the small business protégé shall perform at least 40 percent of the work performed by the joint venture. Work performed by the small business protégé in the joint venture must be more than administrative functions.

52.219-28 Postaward Small Business Program Rerepresentation. (JAN 2025) (Deviation JAN 2026)
(a) Definitions. As used in this clause-
Long-term contract means a contract of more than five years in duration, including options.
However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern-
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in its field of operation, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
(b) If the Contractor represented that it was a small business concern, a small disadvantaged business concern, or a joint venture that was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts-
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards.
(d) The small business size standard for a Contractor providing an end item that it does not manufacture, process, or produce itself, for a contract other than a construction or service contract, is 500 employees, or 150 employees for information technology value-added resellers under NAICS code 541519, if the acquisition-
(1) Was set aside for small business and has a value above the simplified acquisition threshold;
(2) Used the HUBZone price evaluation preference regardless of dollar value, unless the Contractor waived the price evaluation preference; or
(3) Was an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation(s) required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting officer in writing within the timeframes specified in paragraph (b) of this clause, that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.

the payment requested is properly due in accordance with this contract; the supplies deliverable or services due under the contract will be delivered or performed in accordance with the contract; and there has been no impairment or diminution of the Government's security under this contract.
(b) Special terms regarding termination for cause. Upon receipt of adequate security, financing payments shall be made, including all previous payments to which the Contractor is entitled, in accordance with the terms of the provisions for contract financing. If at any time the Contracting Officer determines that the security provided by the Contractor is insufficient, the Contractor shall promptly provide such additional security as the Contracting Officer determines necessary. In the event the Contractor fails to provide such additional security, the Contracting Officer may collect or liquidate such security that has been provided and suspend further payments to the Contractor; and the Contractor shall repay to the Government the amount of unliquidated financing payments as the Contracting Officer at his sole discretion deems repayable.

(f) Limitation on frequency of financing payments. Contractor financing payments shall be provided no more frequently than monthly.
(g) Dates for payment. A payment under this clause is a contract financing payment and not subject to the interest penalty provisions of the Prompt Payment Act. The designated payment office will pay approved payment requests within 30 days of submittal of a proper request for payment.
(h) Conflict between terms of offeror and clause. In the event of any conflict between the terms proposed by the offeror in response to an invitation to propose financing terms (FAR 52.232-31) and the terms in this clause, the terms of this clause shall govern.

52.212-2 Evaluation-Commercial Products and Commercial Services. (NOV 2021) (Deviation Effective Date)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
1. Provide your quotation in two parts: PART I (Non-price factors) PART II (Pricing Proposal). All proposals documents shall be provided in pdf format. No other formatting limitations exist.
2. Send quotation to scott_voigt@ios.doi.gov no later than the suspense date. Late quotes will not be considered.
3. Questions are to be submitted to scott_voigt@ios.doi.gov within seven calendar days of the issuance of the original solicitation. Any questions will be responded to via RFQ amendment to the vendor pool.
4. Quotes shall be valid for not less than 120 days.
5. Although the government does not currently anticipate a need for discussions, the government reserves the right to conduct discussions if necessary.
Evaluation Criteria: Each proposal will need to be divided into two parts, Pricing and Non-pricing. The non-pricing section should cover information such as the timeframe of project completion, company¿s experience, contact information and other such evaluation factors.
These factors will be weighed equally with the exception of price. When combined, non-price factors are less important than price. The contract will be given to the party who can provide the U.S. BLM with the best value to the government.
Technical Evaluation Factor: Experience Provide a list of three or more completed or ongoing projects in the past five years in which you served as a contractor or sub-contractor, with at least one of the projects taking place in the past 5 years, in which you completed riparian cut-stump herbicide application services. Each job entry must have the following information:
¿ The name of job ¿ The job start and end dates ¿ A brief description of services provided and the location of the job ¿ The owner of the job ¿ The owner¿s contact information ¿ The total dollar value of the job
The government will evaluate experience to ensure that the contractor has adequate institutional and workforce knowledge to accomplish the task. The government will assign a adjunctive rating to support a comparative analysis leading to the award decision.
Technical Evaluation Factor: Work Plan The contractor will provide a detailed narrative of how it plans on accomplishing specified tasks including planning, preparation, execution, quality control, and closeout.
The government will evaluate the work plan to assess the contractors project management skill and ability to reduce risks to cost, schedule, and quality. The government will assign a adjunctive rating to support a comparative analysis leading to the award decision.
Past Performance Evaluation Factor The government will query past performance information systems including the System for Award Management (SAM) and Contractor Past Performance Assessment Reporting System (CPARS) to assess the business risks associated with the contracts ability to perform under government contract. This will be independent of the government¿s responsibility determination. The mailto:scott_voigt@ios.doi.gov government will assign a adjunctive rating to support a comparative analysis leading to the award decision.
Price Evaluation Factor The government will perform a price analysis against Part II comparing evaluated pricing against the governments independent government estimates, market research data, and historical prices on project awarded by the government.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
