About this file

This is a Section 3 Business Concern Certification form issued by the Marin Housing Authority (MHA) for the Landscaping Services contract at Golden Gate Village in Marin City, California. The certification document establishes eligibility criteria for businesses seeking to qualify as Section 3 business concerns under HUD regulations. Applicants must demonstrate that their business meets at least one of three qualifying conditions: ownership and control by low- or very low-income persons (at least 51 percent), ownership and control by current public housing or Section 8-assisted housing residents (at least 51 percent), or performance of labor hours by Section 3 workers for over 75 percent of work hours in the prior three-month period. The form requires submission of standard business information including the business name, address, owner details, business structure type, and contact information.

The certification incorporates HUD income limits effective on the proposal due date, referenced through the HUD User portal, to determine eligibility of low- and very low-income persons. Section 3 workers are defined as individuals whose income is below HUD-established limits, employees of Section 3 business concerns, or YouthBuild participants. Targeted Section 3 workers must be employed by Section 3 business concerns or meet documented criteria including residence in public housing, Section 8-assisted housing, or YouthBuild participation within the past five years. The MHA reserves the right to request supporting documentation for the certification prior to contract award or during contract performance. All certifications must be executed under penalty of perjury and signed by an authorized business representative with title and date.
