About this file
This is a quarantine order issued by the Michigan Department of Agriculture's Pesticide and Plant Pest Management Division establishing restrictions on the movement of articles that may carry Thousand Cankers Disease of Walnut into Michigan. The quarantine designates entire states of Arizona, California, Colorado, Idaho, Nevada, New Mexico, Oregon, Washington, and Utah as regulated areas, along with any other areas where the disease becomes established. Regulated articles include the walnut twig beetle (Pityophthorus juglandis) and the fungal pathogen (Geosmithia morbida), firewood of all hardwood species, all plants and plant parts of the genus Juglans including nursery stock, green lumber, logs, stumps, branches, and wood chips. The quarantine prohibits entry of all regulated articles originating from designated regulated areas into Michigan, with exceptions for nuts, nut meats, hulls, processed bark-free kiln-dried lumber with squared edges, and finished wood products without bark such as furniture and instruments.
The order includes specific provisions for compliance, including record-keeping requirements mandating that persons receiving regulated articles retain shipping records, invoices, waybills, bills of lading, and phytosanitary certificates for 36 months. Regulated articles intended for research purposes may move under a discretionary compliance agreement approved by the Director. Articles transiting through regulated areas are treated as regulated articles themselves and require documentation indicating state of origin. Violations of the quarantine constitute a misdemeanor under Act 189 of 1931, with penalties enforced according to that statute. The quarantine was effective as of May 17, 2010, signed by Don Koivisto, Director of the Michigan Department of Agriculture.
