About this file

This is a Liquidation Damages Formulation Memo for federal construction contract 36C24426R0055, concerning regrout bathroom work on the 3rd Floor of Building 1. The memo establishes the daily liquidated damages rate of $609.33 that the contractor must pay for each calendar day of inexcusable delay past the scheduled completion date. The damages calculation is based on General Schedule Locality Pay Table rates for Lebanon County effective January 1, 2025, and comprises two components: VISN 4 contracting, engineering, and legal reviews totaling $340.03 per day (including a GS-14/5 Contracting Officer Supervisor, GS-13/5 Contract Specialist, GS-11/1 Contract Specialist, and GS-14/4 Legal Officer), and Facility Engineering support totaling $269.30 per day (including a GS-13/5 Construction Manager and GS-12/6 Project Engineer). The memo clarifies that liquidated damages serve a compensatory purpose based on historical trends of additional contract administration time required when contractors fail to meet deadlines, and the government reserves the right to pursue actual damages separately and distinguishably from the liquidated damages assessment.
