Setting aside for an SDVOSB firm is in compliance with regulations to meet our goals and fulfill the VA’s mission to meet socioeconomic goals.
2. SUBMITTAL OF OFFERS
2.1 Offerors submitting proposals for this project should limit submissions to data essential for evaluation of proposals, so that a minimum of time and monies will have been expended in preparing information required herein. However, in order to be effectively and equitably evaluated, the proposals must include information sufficiently detailed to clearly describe the offeror's experience, capability and past performance so that the Source Selection Evaluation Board (SSEB) can determine the offeror’s ability to successfully complete the project. Proposals should follow in the order of sequence set forth in this document. Information provided out of sequence may not be evaluated and may result in the offeror's disqualification from award. Requirements stated in this RFP are minimums. Innovative, creative or cost-saving proposals that meet or exceed the requirements should be clearly noted and justified in the proposal.
2.2 Offerors must comply with the detailed instructions for the format and content of the proposal; proposals that do not comply with the detailed instructions for the format and content of the proposal may be considered non-responsive and may render the Offeror ineligible for award.
2.3 These instructions prescribe the format of proposals and describe the approach for the development and presentation of the proposal data. They are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals. Carefully review this section prior to commencing proposal preparation. For proposals to receive full consideration for award, offerors should ensure that the information furnished in support of the proposal is factual, accurate, and complete.
2.4 Offerors are cautioned to strictly comply with all instructions within this solicitation to ensure submission of a complete proposal. Failure to furnish a complete proposal, at the time of proposal submission, may result in the proposal being unacceptable to the Government and elimination from consideration for award. Furthermore, all solicitation amendments must be acknowledged on the SF 1442, in accordance FAR Clause 52.215-1(b).
2.5 Prospective offerors shall submit the proposal in two (2) separate PDF documents:
2.5.1 Volume I: Technical Proposal
2.5.2 Volume II: Price Proposal
2.6 Proposal Volumes are due by the date and time set for the receipt of proposals shown in Block 13 of SF 1442. The due date for receipt of Past Performance Questionnaires from your references is the same as the date and time set for the receipt of proposals shown in Block 13 of the SF 1442.
2.7 Proposals must be submitted via email as two separate PDF attachments to Amanda.Murphy5@va.gov AND Elijah.McIntosh@va.gov. Subject line should read: “Solicitation 36C24426R0055 Regrout Bathrooms Bldg. 1 Project”. VAAR Clause 852.219-75 MUST be signed and returned with the proposal. Please include applicable SAM UEI on the cover page of each volume.
3. PROPOSAL FORMAT:
3.1 Purpose: These instructions prescribe the format of proposals and describe the approach for the development and presentation of the proposed data. The proposal shall include all the information requested in the specific instructions. Failure to include all information requested may adversely affect the evaluation. A proposal that merely reiterates or promises to accomplish the requirements of the RFP may receive a lower rating. Offerors are reminded of their responsibility to submit a proposal that is orderly and sufficiently documented that will enable the Government to easily understand and perform a thorough and fair evaluation.
3.2 Offerors are cautioned to submit enough information to enable the evaluation board to fully ascertain each offeror’s ability to perform all the requirements contemplated by this solicitation. Offerors are cautioned not to assume knowledge of the Government. All commitments made in the proposal may, at the sole discretion of the government, become a part of the resultant contract. The data submitted with each proposal shall be complete and concise, but not overly elaborate. Reliance on promotional brochures is discouraged.
3.3 Proposal Volume I shall not exceed the stated page limits. Page limit for Volume 1 is twenty-five (25) pages. If the page limit is exceeded, the pages in excess of the limit may be unread.
3.3.1 Page Limit Includes: All appendices, charts, graphs, diagrams, tables, photographs, drawings, etc. except as noted in the instructions.
3.3.2 PDF proposals shall conform to standard 8.5 x 11-inch pages (charts may be landscaped but must be on 8.5 x 11-inch pages), text lines shall be single-spaced, and shall have a font size no smaller than Microsoft Word Times New Roman 11-point font. Type that is smaller will be considered illegible. Packages that are handwritten will not be evaluated. Schedules may be landscaped on 11 x 17-inch pages. Pages of each proposal shall be appropriately numbered and identified with the RFP number.
3.3.3 Indexing: Each volume shall contain a “Table of Contents” for that volume. The “Table of Contents” shall identify major areas, paragraphs and subparagraphs by number and title as well as by page number and volume locations. Tab indexing shall be used to identify Sections as appropriate. Table of Contents and Tab indexes do not count toward page limitation.
3.4 VOLUME 1
3.4.1 The Volume 1 proposal shall be prepared in accordance with the instructions and format given in this section. Failure to provide a Technical proposal in accordance with this section and the solicitation may render an offeror’s proposal incomplete and ineligible for award. Offerors are strongly cautioned to follow the format in preparing their proposals. Include the question before each narrative. This will allow for ease of evaluation. Technical Proposals shall not include price or pricing information.
3.4.2 General Instructions: The Volume 1 question narratives should include necessary information regarding the offeror’s ability to perform complete project management of required construction services. Project management includes the full spectrum of activities such as, estimating, proposal preparation, subcontract purchasing and management, work scoping and planning, construction superintendent duties, quality controls, limited architect and engineering design, and safety. Additional clarification of these requirements is to be inferred from information contained in the description of content of each question of the Technical proposal, as well as the evaluation factors for award. Offerors are strongly encouraged to review the evaluation information as they complete their Volume 1. The Technical proposal shall be submitted in accordance with the instruction contained herein.
3.4.3 The Government acknowledges that Volume 1 evaluates some of the same projects/contracts in both the technical experience and past performance sections. Past Performance examines how an offeror performed in the past so as to determine the probability of success on future projects. Experience examines the offeror’s and their team’s (including sub-contractors) experience with multidiscipline project management and execution on contracts of similar in size and scope to this requirement, as well as how the offeror demonstrates an understanding of the contract’s requirements. The Government intends to use Factor 1 information as part of the evaluation of both experience and past performance.
3.4.5 Offerors are strongly encouraged to review the evaluation information located in the solicitation as they complete their Volume 1. Each question shall be covered with sufficient detail to clearly address all required information. Contractor shall answer questions in the order presented. There is an overall technical proposal page limit listed in Paragraph 3.3.
3.4.6 Volume 1 Technical: Organization and Requirements
1. TECHINCAL EXPERIENCE: The offeror shall list up to five completed projects, similar in size and scope to this requirement, that they have completed as a Prime Contractor in the past five (5) years. Proposals demonstrating experience with heightened ICRA and safety requirements will be more favorably rated. Page limitation: One page (in 12-point Times New Roman font) for each project. In describing project construction experience, provide the following information:
· Project title and location including the building use (Medical Facility, Major Building Renovation, etc.) and contracting method (design build, design bid build, CM at risk etc.).
· Brief description of the work performed (Including phasing room usage if applicable)
· Extent of Infection Control required
· Project owner, owner’s point of contact and telephone number of owner’s contact person.

· Project Statistics including start and completion dates (original vs. actual) for construction; cost (original vs. actual with brief explanation of what is included in the cost); square footage; foundation type; number of levels; and any awards (prizes) received.
2. CAPABILITY TO PERFORM
2A. PERSONNEL: The offeror shall demonstrate the relevant experience of key project personnel who will be assigned to this project. Page limitation: One page (in 12-point Times New Roman font) for each person.
· Biographical data shall include the following:
· Name of individual.
· Company of employment.
· Company position title.
· Years with the company.
· An indication of which (if any) projects submitted under Technical Experience (above) the individual participated in and what the individual’s responsibility was for that project.
· Supply this biographical data for key personnel for at least the following: (Note if one individual is proposed for more than one position listed):
· Overall Senior Project Manager
· Construction Project Manager.
· Construction Superintendent
· Quality Control Manager
2B. APPROACH: Provide a brief narrative (page limitation: two pages (in 12-point Times New Roman font) for brief narrative) describing the offeror’s method to manage the project to achieve design and construction objectives as described in the RFP. Include at a minimum all aspects covered in the scope of work. Describe the techniques and methods for this Construction Project to include projected project timelines, coordination of work including phasing of rooms, and infection control/safety.
2C. SCHEDULE: Provide your planned work schedule with critical path and float indicated.
3. PAST PERFORMANCE: Offerors shall provide up to three (3) references from current/past clients of the contractor (within the past five (5) years) for projects similar in size and scope. References shall complete the attached past performance questionnaire and return directly to the Contract Specialist as indicated in the questionnaire. Unless offeror obtains confirmation of submission of past performance questionnaires from his/her clients, offerors should ensure their quote contains full contact information for at least two (2) references. Past performance questionnaires shall be received by the due date/time stated in the RFP. The contact's responses will be scored based on the following elements with projects participated in by the Prime being weighted more heavily than projects participated in by consultants, sub-contractors and individuals. If offeror has CPARS reports, copies of these reports shall be submitted for this factor.
In addition to the above, the VA may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through CPARS, using all SAM UEI numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), and any other known sources not provided by the offeror. The VA may use personal knowledge of projects, as well. While the VA may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror.
The Source Selection Evaluation Board will also review any and all projects submitted in Factor 1: Technical Experience to determine relevancy. Projects of a similar size and scope to the work outlined in this Request for Proposal will be scored more favorably towards the overall Past Performance rating.
3.6 Volume II: Price Information.
3.6.1 Offerors shall submit all price information necessary to provide a meaningful basis for Government's analysis and evaluation of price for the project. The Government does not intend to request certified pricing data. If an offeror proposes an unusually low price, the offeror may also be required to provide rationale to justify the price. Detailed requirements follow:
3.6.2 Offer – Complete in its entirety the “Offeror” portion of the Standard Form (SF) 1442. An official having the authority to contractually bind your company must sign the SF 1442 in accordance with FAR 4.102.
3.6.3 Discounts: Prompt payment discounts will not be considered in the evaluation of offers.
3.6.4 In the event a minor clerical error has occurred, the offeror may be given an opportunity to correct the minor error within the constraints of the “clarifications” process or the Contracting Officer determines discussions are required.
3.6.5 Discussions: Government intends to make award to a responsible Offeror submitting a conforming proposal without discussions if deemed to be in the best interest of the Government.
4. PROPOSAL EVALUATION:
4.1 To arrive at a Best Value decision, the Source Selection Authority (SSA), using the SSEB documentation, will integrate the evaluation of Past Performance, Technical Experience, Capability to Perform and Price. Past Performance is slightly more important than Capability to Perform which is slightly more important than Technical Experience which is more important than Price. While the Government and the SSA will strive for maximum objectivity, the evaluation process, by its nature, is subjective and, therefore, professional judgment is implicit throughout the entire evaluation process. Offerors are reminded that a failure to comply with the format and submission requirements above may preclude the agency from evaluating the proposal.
4.1.1 Offeror may, at the discretion of the Government, be asked to provide information for clarification purposes regarding their proposals. Requests for such clarification information do not constitute discussions.
4.1.2 The offeror shall be held responsible for the validity of all information supplied in the submitted proposal, including that provided by potential subcontractors. Should the subsequent investigation disclose that the fact and conditions were not as stated, the proposal may be rejected.
4.2 The Past Performance proposal evaluation will consider such things as an offeror's business practices, customer relationship, timeliness, and ability to successfully perform as proposed and other considerations considering currency, relevancy, sources, context, and trends. Past Performance includes current on-going (present) performance.
4.2.1 The Government will conduct a performance risk assessment based upon the Past Performance of the offeror, as it relates to the Government’s confidence relating to the probability of successful accomplishment of the work required by the solicitation. Ratings will consider the offeror's Past Performance, considering currency, relevancy, sources, context, and trends, using descriptive adjectives that most accurately define the offeror's performance risk considering all potential evaluation criteria identified in this section. Relevance will be considered in the overall Past Performance rating. Ratings will review the offeror's Past Performance considering currency, relevancy, sources, context, corrective actions taken, and trends. The Past Performance evaluation will include, but is not limited, to the following: Quality, Management, and Workmanship; Timeliness and adherence to schedule; Specification compliance, Offeror’s business practices/Customer relationship; Ability to successfully perform; Safety and Adequacy of safety programs; Federal Law Compliance; Infection Control Program; Overall customer satisfaction. The most critical aspect of the past performance risk rating shall be the SSEB’s determination of past performance based on performance on all contracts, whether identified by the offeror or not, at the Lebanon VAMC. All other past performance considerations are evaluated but are substantially less important.
4.2.2 In accordance with FAR 15.306(a)(2), if awards are made without conducting discussions, offerors may be given the opportunity to clarify certain aspects of their proposals, e.g., the relevance of an offeror's Past Performance information and adverse Past Performance information to which the offeror has not previously had an opportunity to respond, or to resolve minor clerical errors.
4.3 The evaluation of each Technical Proposal will assess and measure the ability of the offeror to effectively manage multi-discipline or specialized discipline, as applicable, construction projects based on the material provided in response to the submission requirements specified in the solicitation and paragraph 3. The Government will determine, based on the information provided, if the offeror has demonstrated the ability to perform complete project management of construction projects at the dollar levels and complexities indicated in the solicitation.
4.3.1 The evaluation will be divided into four (4) factors. Past Performance is slightly more important than Capability which is slightly more important than Experience which is more important than Price.
4.3.1.1 Factor 1, Technical Experience: The Government will evaluate the offeror’s experience in performing construction projects of similar size or scope as defined in the solicitation. The assessment of the offeror’s experience will be used as a means of evaluating the technical ability of the offeror to successfully meet the requirements of the RFP. Proposals that fail to provide required and complete information will be rated lower. Projects where the Prime and potential Sub-contractors have previously worked together will receive a higher rating. Projects that demonstrate infection control and room phasing will receive a higher rating. Offerors providing more projects of similar size and scope will be more favorably rated.
4.3.1.2 Factor 2, Capability to Perform: The Government will evaluate the offeror concerning their capability to manage this construction project. The government will evaluate the proposed team to ensure the prime contractor and/or subs are capable of performing the work detailed in the SOW. This will include each firm and individual’s qualifications to perform the work, their methods and their proposed schedule, to include the critical path and float, and proposed outcomes. Each of the capability sub-factors is of equal weight.
4.3.1.3 Factor 3, Past Performance: The Government will evaluate the offeror's past performance to determine the level of confidence that the contractor will successfully perform the current requirement. As part of this evaluation, VA will consider the relevancy of the projects submitted, to include the size and scope. Projects will be rated either Relevant, Somewhat Relevant, and Not Relevant. The Government may evaluate present and past performance information by using data independently obtained from other Government or commercial sources, including, but not limited to: Government databases; personal business experience with the offeror; and information provided in the Offeror’s Experience Project Description; Past Performance Evaluation Questionnaires completed by the offeror’s references. Past Performance information on contracts not listed by the offeror, or that of planned subcontractors, may also be evaluated. The Government may contact references and contact parties other than those identified by the offeror, and information received may be used in the evaluation of the offeror’s Past Performance. The evaluation may take into account Past Performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to this acquisition. If multiple subcontractors are provided for the same discipline, the government will use the lowest rated subcontractor in the evaluation. The Government reserves the right to obtain and evaluate Past Performance information from any source it deems appropriate. The following ratings will be used to define the past performance risk:
SUBSTANTIAL CONFIDENCE – Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
SATISFACTORY CONFIDENCE – Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
LIMITED CONFIDENCE – Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
NO CONFIDENCE – Based on the offeror’s recent/relevant performance record, the Government has no expectations that the offeror will be able to successfully perform the required effort.
NEUTRAL - No current and/or relevant performance record is identifiable upon which to base a meaningful performance risk prediction. Government Personnel were unable to identify any relevant Past Performance information for the offeror or key team members/subcontractors or their key personnel. This is neither a negative or positive assessment. Unknown Risk
4.4 PRICE EVALUATION: The purpose of the Price evaluation is to provide an assessment of the reasonableness of the total proposed price in relation to the solicitation requirements. Proposals will be evaluated in the following manner.
4.4.1 The Government evaluation team will conduct a price evaluation of each offeror's total price proposal, to determine reasonableness. Reasonableness of an offeror's proposal shall be evaluated using one or more of the price analysis techniques, as set forth in FAR part 15 or part 13 as appropriate.
4.4.2 The Contracting Officer determines if discussions are required.
4.4.3 Prompt payment discounts will not be considered in the evaluation of offers.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
