About this file
This is a Safety Compliance Requirement notice that outlines mandatory safety and environmental qualification standards for bidders and offerors on federal contracts. All bidders must submit documentation certifying they have no more than three serious OSHA or EPA violations, or one repeat or willful violation within the past three years. Additionally, bidders must provide current Experience Modification Rate (EMR) information equal to or less than 1.0, obtained from their insurance carrier on company letterhead. Self-insured contractors or those unable to provide EMR ratings on insurance letterhead must obtain ratings from the National Council on Compensation Insurance, Inc. (NCCI) using form ERM-6, or from their state's worker's compensation insurance rating bureau if located in CA, DE, MI, NJ, ND, OH, PA, WA, WY, or PR.
Failure to submit the required safety documentation at the time of bid opening or proposal receipt will result in the bid or proposal being deemed non-responsive and ineligible for consideration. Post-award, this requirement extends to all subcontracting tiers, making prime contractors responsible for verifying the safety compliance of prospective subcontractors and submitting their documentation to the Contracting Officer in the same format prior to commencement of work.
