About this file
This is a Brand Name Justification document for procurement request 36C24525B0001, citing FAR 11.105(a)(1) and 36.202(c) to justify the use of Johnson Controls, Incorporated (JCI) as the specified control system provider. The document relates to a VA facility renovation project requiring an ASHRAE 135 BACNet/IP Control System.
The justification explains that the campus has standardized on JCI's control system and is upgrading from N2 to M5 in phases, primarily for Air Handling Units (AHUs). While third-party gateway devices are technically allowed, they are not preferred due to potential interoperability issues, increased bandwidth requirements, and the need for IT department approval. The document specifies that JCI must be hired as Controls Integrator if not directly performing the controls work, as detailed in specification section 23 09 23 - Direct-Digital Control System for HVAC. The document requires signatures from both the Contracting Officer (CO) and Contracting Officer Representative (COR) for approval.

BRAND NAME JUSTIFICATION
FAR 36.202 Specifications and VAAR 836.202-70 Specifications – use of equal products
PROCUREMENT REQUEST 36C24525B0001
In accordance with Federal Acquisition Regulation (FAR) 11.105(a)(1) and 36.202(c), the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs
For Specifications – use of equal products (VAAR 836.202-70 and 852.236-90).
As per VA guide specification 23 09 23, Part 1, paragraph 1.1.G, this campus has standardized on an existing ASHRAE 135 BACNet/IP Control System supported by a preselected controls service company, Johnson Controls, Incorporated (JCI). The specification requires the GC to hire JCI as Controls Integrator, if JCI is not directly doing the controls. As mentioned, we are upgrading from N2 to M5 on a piecemeal basis, predominantly in association with AHU’s. The specification allows for the use of third-party gateway devices, and specifies the requirements for BACNet conformance and interoperability. The preference is not to use third party gateway devices, as we are upgrading the Metasys piecemeal. Unrestricted use of gateway devices would be expected to cause problems, as interoperability does not equate to interchangeability.
The expertise to evaluate the Protocol Implementation Conformance Statement and analyze schedules for each device and listing for all BACNet Interoperability Building Blocks would be far above me. Usage of each gateway device would also require approval from the IT department. Last, use of third-party gateways would increase bandwidth requirements and slow the system.
The JCI Control System is specified in the specification section 23 09 23 - Direct-Digital Control System for HVAC.
