About this file

This is an employee rights notice issued by the U.S. Department of Labor's Wage and Hour Division pertaining to the Davis-Bacon Act. The document outlines mandatory wage and labor protections for laborers and mechanics employed on federal or federally assisted construction projects. Employees must receive prevailing wages as listed in the Davis-Bacon Wage Decision posted with the solicitation and must be paid not less than one and one-half times their basic rate of pay for all hours worked over 40 in a work week, with limited exceptions. The notice emphasizes that contract payments may be withheld to ensure proper wage and overtime compensation, and contractors face significant penalties including contract termination, debarment for up to three years, and potential civil or criminal prosecution for falsifying payroll records or inducing wage kickbacks.

The contracting officer for this particular action is Daniel P. Kinney, Contract Specialist with the Department of Veterans Affairs National Cemetery Administration. Employees or applicants who do not receive proper pay or require further wage information should contact the Contracting Officer at daniel.kinney@va.gov or 402-830-4683, or they may contact the U.S. Department of Labor's Wage and Hour Division directly at 1-866-487-9243, TTY 1-877-889-5627, or www.dol.gov/whd. Apprentice rates apply only to apprentices properly registered under approved Federal or State apprenticeship programs.
