About this file
This is a Technical Standards document for the Massachusetts Health Connector related to a Request for Proposals (RFP) for culturally and linguistically support services for readability and usability. The document establishes mandatory compliance requirements that the contractor must meet throughout the term of the resulting agreement. The technical standards cover general security protocols applicable when the Health Connector exercises the Contingent Interpretation Scope, including compliance with federal regulations such as 45 CFR 155.260 and HIPAA, as well as Commonwealth laws including the Fair Information Practices Act (MGL ch. 66A), identity theft laws (MGL ch. 93H and 93I), and standards established by the Executive Office for Technology Services and Security (EOTSS). The contractor's technology systems must maintain compliance with evolving federal and state regulations, policies, and standards throughout the contract term, ensuring data remains fully secured both at rest and in transit.
The contractor must comply with specific federal security requirements including those outlined in the HHS Office of the Chief Information Officer's incident reporting policy, Federal Identity, Credential, and Access Management (FICAM) guidance, the Federal Information Security Modernization Act, CMS guidance for Exchange and Medicaid IT systems, and National Institute of Standards and Technology (NIST) standards including Special Publication 800-18 and 800-53. Additionally, all IT systems must meet Section 508 accessibility standards and the Commonwealth's Enterprise Information Technology Accessibility Standards, with the contractor responsible for hiring its own accessibility vendor. The document specifies that all data received, processed, or created remains the sole property of the Health Connector and must maintain data integrity and self-identification protocols. The contractor is explicitly prohibited from using generative artificial intelligence to provide services unless written approval is obtained from the Health Connector.
