Award will be made to the offeror who is deemed responsible in accordance with the FAR, as supplemented, whose quote conforms to the solicitation's requirements (to include all stated terms, conditions, representations, certifications, and all other information required by 52.212-1 addendum of this solicitation) and is judged, based on price and other factors considered to represent the best value to the Government.
The following factors will be used in evaluation process:
- Factor 1 – Technical: The Government will evaluate the Technical Proposal on an Acceptable /Unacceptable basis, assigning a rating of Acceptable or Unacceptable, as defined below.
a. Acceptable- The submitted proposal is compliant with RFQ and SOW requirements.
b. Unacceptable- The submitted proposal is non-compliant with RFQ and SOW requirements, rendering it ineligible for award due to the presence of deficiencies.
Offerors will be evaluated on their understanding of the requirement as it relates to the Specific Instruction section Factor 1 (Technical Proposal).
- Factor 2 – Past Performance: The Government will evaluate the Past Performance submitted to determine whether the offeror’s past performance is recent and relevant or not relevant to this requirement as defined in 52.212-1. The Government will also evaluate how well the offeror performed on the prior contracts/projects.
Based on this rating, the Government will assign a rating of Highly Reliable, Acceptably Reliable, Neutral Reliability, Limited Reliability, or No reliability as defined below.
a. Highly Reliable- The Government strongly anticipates successful execution of the required effort, based on the offeror's recent/relevant performance record.
b. Acceptably Reliable- The Government expects the offeror to perform the required effort successfully, based on their recent and relevant performance history.
c. Neutral Reliability- Insufficient performance data exists to allow for a meaningful reliability assessment. Offerors who have no past performance will be assessed this rating. The offeror will not be assigned a positive or negative rating for past performance. The offeror will not be assigned a positive or negative rating for past performance.
d. Limited Reliability- The Government has concerns about the offer’s ability to successfully perform the required efforts due to a recent/relevant performance record indicating limited reliability
e. No Reliability- Due to a recent/relevant performance record demonstrating no reliability, the Government has no confidence in the offeror’s ability to effectively execute the project.
- Factor 3 – Price: The Government will evaluate the price proposal submitted in response to this solicitation, reviewing the price proposal to ensure that the proposed price is complete, reasonable, and balanced as defined earlier in this section. The Government reserves the right to reject an offer if the Contracting Officer determines that the proposed price does not meet the criteria of completeness, reasonableness, and balance.
The Initial Total Evaluated Price (I-TEP) will be calculated as the sum of the Offeror’s proposed prices for the base period and four 12-month option periods,). Evaluation of options and the Extension of Services (EOS) shall not obligate the Government to exercise such options. A six-month Extension of Services IAW FAR 52.217-8, “Option to Extend Services” will be utilized if necessary.
The six-month EOS is not to be considered part of option period pricing and will be a separate option exercised if it is utilized. After any interchanges or quote revisions, if necessary, the Government will evaluate the Final TEP (F-TEP). Under this factor, the Government will evaluate the Offeror’s TEP based on the following:
i. Completeness. The offeror's price and other supporting information will be evaluated to ensure continuity and traceability of prices to the proposed technical proposal and between initial quotes and any revisions thereto. The review will determine the adequacy of the offeror's quote in addressing and fulfilling the solicitation requirements.
ii. Reasonableness. The price proposal will be reviewed to determine the reasonableness of price and the offeror's understanding of and ability to perform the requirement.
iii. Balance. IAW FAR 15.404 unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. All separately priced line items will be analyzed to determine if the prices are unbalanced. The offer may be rejected if the CO determines the lack of balance poses an unacceptable risk to the Government.
Strengths Exceedances The Government intends, if it is in its best interest, to incorporate into the resulting contract, all beneficial aspects of the awardee’s quote and all above threshold (minimum) attributes, performance levels, or capabilities for which evaluation credit was given.
By submission of your quote, the offeror agrees to all solicitation requirements including terms and conditions and representations and certifications. The offeror shall clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The Government reserves the right to cancel this solicitation, with no obligation to the offeror.
General Considerations. The quote must comply in all material respects with the requirement of law, regulations, and conditions set forth in the solicitation. To be eligible for award, the offeror must be determined responsible as defined in Federal Acquisition Regulation (FAR) 9.104-1.
A written notice of award or acceptance of an offer, mailed, or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Award will be made IAW the procedures specified in the Simplified Acquisition Proposal Request (SAPR). The Government will award a single contract resulting from the solicitation using the procedures in the Basis of Award section of this clause. In the event adequate price competition is not received, the Contracting Officer will use one or more of the price analysis techniques described at FAR 15.404-1(b)(2) to ensure the price to the Government is fair and reasonable.
Basis of Award: Award will be made on a best value tradeoff basis.
A contract may be awarded to the offeror who is deemed responsible IAW FAR Subpart 9.1, as supplemented, whose quote conforms to the solicitation requirements and is judged to represent the best value to the Government.
Phase 1 - Technical will be reviewed first and will be evaluated on an acceptable/unacceptable basis.
If Technical is deemed Unacceptable, Past Performance and Price will not be reviewed and the quote will be ineligible for award due to an Unacceptable rating.
Phase 2 –Past Performance will first be reviewed in Phase 2 and will be graded on the Reliability Rating’s spelled out in the RFQ. Following the grading, price will be evaluated.
Note - Past performance will be considered more important than Technical (with Acceptable rating) and Price.
The Government reserves the right to award to a higher rated, higher priced offeror where the decision is consistent with the evaluation factors outlined in the solicitation and the Government reasonably determines that the superior past performance of the higher priced offeror outweighs the cost difference. In the event the multiple offerors receive equal past performance and technical ratings, price will be the determining factor.
The Government reserves the right to conduct interchanges with offerors. These interchanges may be used to clarify aspects of quotes, resolve minor deficiencies, or allow offerors to revise their quotes (including price). The Government is not obligated to conduct interchanges with all offerors and may award without conducting interchanges.
