Individual projects are capped at $6,500 per project inclusive of all labor, materials, equipment, permits, and overhead costs. All work is subject to OCTA inspection and final verification, with contractors warranting all work, materials, and workmanship free from defects for one year from final acceptance. Contractors designated to work near OC Streetcar facilities must complete mandatory four-hour OC Streetcar Roadway Worker Program training. Payment is made only after work completion, final inspection, submission of verification forms, and provision of all required supporting documentation including certified payroll records and disposal manifests. Questions or clarifications must be submitted in writing by 4:00 p.m. on April 10, 2026, with written addenda responses due by April 15, 2026. SCOPE OF WORK

MINOR MAINTENANCE CONSTRUCTION PROJECTS

1. OVERVIEW

1.1. On an as-needed basis, Contractor shall provide all labor, materials, equipment, permits, and personnel required to perform minor maintenance construction projects at Orange County Transportation Authority (OCTA) bus bases, park-and-rides, transportation centers, and streetcar facilities.

1.2. Minor maintenance construction projects shall not exceed $6,500.00 per project. The $6,500 maximum project cost shall be inclusive of all labor, materials, equipment, mobilization, overhead, profit, subcontractor markups, taxes, permits, fees, regulatory compliance costs, and any other incidental or administrative expenses required to complete the work. No change order shall increase the total project cost beyond $6,500. Any work exceeding this amount shall require separate procurement. No change order work shall be performed without prior written authorization from OCTA’s Facilities Manager or designee, and Contractor shall proceed at its own risk for any work performed without written approval.

1.3. Public Contract Code Section 10329 states that “no person shall willfully split a single transaction into a series of transactions for the purpose of evading the bidding requirements of this article.” OCTA must obtain bids through a formalized bidding process for any project exceeding $6,500.00. Any award that results from said bid process shall be formalized in a separate agreement.

2. GENERAL REQUIREMENTS

2.1. Contractor shall provide a turn-key operation by managing all aspects of any approved project from start to finish, ensuring that it is fully functional and ready for use upon completion.

2.2. Contractor shall provide OCTA’s Facilities Manager, or designee, with a daily report that includes the date, number in workforce, hours worked, equipment, weather, construction activities, incidents and/or safety concerns, visitors, and outside agency communications, as a minimum amount of daily report information.

2.3. Contractor shall provide applicable submittals for OCTA review and approval prior to use, including, but not limited to: Safety Data Sheets (SDS) for coatings, product data for non-skid systems, and other relevant materials as required.

2.4. Contractor shall be solely responsible for means, methods, techniques, sequences, and procedures of construction.

2.5. If hazardous materials are encountered, Contractor shall immediately stop work and notify OCTA. Contractor shall not disturb any suspect hazardous material unless properly licensed and authorized.

3. LICENSE AND PERMIT REQUIREMENTS

3.1. Contractor shall possess and maintain an active Class B General Building or appropriate specialty license(s) issued by the California Contractors State License Board (CSLB). A copy of the current CSLB pocket-card (front & back) shall be provided to OCTA, upon request. License shall be kept current and in good standing throughout the term of the contract.

3.2. Contractor shall secure all necessary regulatory compliance including plan checks, permits and licenses required by local, state, and federal agencies, and payment of all associated charges and fees related to such compliance.

3.3. Contractor shall ensure all necessary notices are given and comply with all regulations to lawfully complete the project.

4. SAFETY TRAINING

OCTA shall provide a mandatory four (4)-hour OC Streetcar Roadway Worker Program training/qualification for Contractor field personnel designated to perform work near the OC Streetcar facility, tracks, and/or overhead contact system, as outlined in Appendix A – OC Streetcar Yard & Maintenance Storage Facility Safety Awareness Guide. Contractor shall ensure that all designated personnel successfully complete the training prior to commencing work in these areas, maintain current qualification status, and renew the training annually. At the discretion of the OCTA Facility Maintenance Supervisor, training may be scheduled on the same day as approved work; however, it must be satisfactorily completed before any work begins. If Contractor’s scope of work does not require personnel to complete the training, Contractor shall coordinate with the OCTA Facility Maintenance Supervisor or designee to arrange for a safety-trained OCTA escort prior to performing work in these areas.

5. PREVAILING WAGE COMPLIANCE

Contractor and all their subcontractors shall be registered with the California Department of Industrial Relations (DIR) in accordance with Labor Code §1725.5. Contractor shall submit certified payroll records as required by Labor Code §1776. Contractor shall comply with all applicable provisions of Division 2, Part 7, Chapter 1 of the California Labor Code governing public works, as well as all applicable federal prevailing wage requirements. In the event of a difference between the wage rates predetermined by the U.S. Secretary of Labor and those determined by the DIR for similar classifications of labor, Contractor and subcontractors shall pay the higher of the two rates. Lower state wage rates not specifically included in the federal determination will not be accepted by the DIR.

Prior to providing a quote on the work, Contractor shall conduct a careful examination of the premises and shall become thoroughly familiar with the requirements of the contract and scope of the work to be completed. By submitting a quote for the work for each project, Contractor shall be deemed to have made such study, and examination, and certify familiarity and acceptance with all conditions of the site.

6.4. Inspection, Damages, and Removal of Rejected Work

All work performed and materials supplied shall be subject to OCTA inspection. Such inspection shall not relieve Contractor of its obligation to comply with contract requirements. Work or materials not meeting specifications may be rejected and shall be corrected, removed, or replaced at Contractor’s expense. Contractor shall be responsible for any damage to existing facilities, pavement, landscaping, or equipment caused by its operations and shall repair such damage at its sole expense. No compensation shall be allowed for removal or replacement of rejected or unauthorized work.

6.5. Housekeeping, Disposal, and Final Clean-up

Contractor shall provide on-site waste containers and dispose of all materials at legal disposal facilities in accordance with applicable regulations. Prior to final inspection, Contractor shall perform a comprehensive final clean-up, leaving the site in a neat and presentable condition. All cleanup costs shall be included in the contract price, and no separate payment will be made. Copies of disposal manifests or receipts shall be provided to OCTA when applicable.

6.6. Final Inspection

OCTA’s Facilities Manager, or designee, will perform the final inspection upon completion of work and final clean-up.

7. SCHEDULE OF WORK

7.1. OCTA, at its sole discretion, shall determine which tasks shall be performed by Contractor and the frequency. Prior to commencing any task under the Agreement, Contractor, in conjunction with OCTA, shall develop a plan for completing the task(s) which shall include a time schedule, list of equipment to be used, number of labor hours, and total cost to perform the task. No mobilization nor work shall commence without prior authorization from OCTA’s Facilities Manager, or designee. OCTA is under no obligation to "purchase" any or all quoted projects or services from Contractor.

7.2. Contractor shall coordinate work schedule with the OCTA Facilities Manager, or designee, and shall accomplish all work in such a manner to limit inconvenience and any unsecured premises. Contractor shall be given at least a seventy-two (72)-hour notice to commence services from receipt of approval to proceed from OCTA Facilities Manager, or designee.

7.3. In an emergency, OCTA will require Contractor to commence services within twenty-four

(24) hours from receipt of approval to proceed from OCTA Facilities Manager, or designee. Emergency work shall remain subject to the $6,500 per-project limitation unless otherwise formally procured under separate written authorization from OCTA.

8. WARRANTY

Contractor warrants that all work, materials, equipment, and workmanship shall be free from defects for a period of one (1) year from the date of final acceptance by OCTA. Contractor shall, at its sole expense, promptly correct any defective work and repair any damage to OCTA property resulting from such defects. Contractor shall respond to warranty claims within five (5) business days of notification and commence corrective action promptly. Required warranty documentation shall be provided prior to release of final payment.

9. SERVICE VERIFICATION

Upon completion of work, a final inspection and verification of service will be made by OCTA's Facilities Manager or designee prior to Contractor departing premises. Contractor shall complete a Verification of Work form (Attachment No. 1) and forward the form to the OCTA Maintenance Supervisor, or designee. Failure to adhere to these requirements and terms may cause non-payment of invoices.

10. INVOICING AND PAYMENT

Contractor shall submit invoices only after completion of work, final inspection, and submission of the Verification of Work form. Each invoice shall reference the approved quotation and include all required supporting documentation, including certified payroll records and disposal manifests when applicable. Invoices shall be consistent with the approved not-to-exceed price, and OCTA reserves the right to withhold payment for incomplete, non-compliant, or defective work. Payment shall be made in accordance with the Agreement.
