Evaluation Factors for Award
The Proposed Task Order will be awarded to the responsible offeror offering the best value to the Government. To make a determination of Best Value, the Government shall evaluate price and the following non-cost/price factors:
Factor 1 – Past Performance
Factor 2 – Technical Solution
The relative order of importance of the non-cost/price evaluation factors is the technical factor (Factor 2 – Technical
Solution) is of equal importance to the performance confidence assessment (Factor 1 – Past Performance). The combined non-cost/price factors are approximately equal to price.
Non–price factors Solicitation Submittal Requirements: The offeror shall submit one (1) original, marked “Original”, and two (2) copies marked “copy”, each in a separate three-ring binder (1.5 inch. maximum), and one electronic copy on CD with the following characteristics:
• Text pages 8 ½ x 11 format
• Drawings 11x17 inches and folded down to 8-1/2 x 11 inches
• 12-point font, Times New Roman mailto:casey.buell@navy.mil
• One complete electronic copy of the technical proposal factors as a single .pdf searchable file on a
CDROM (include with the “Original” technical submission). If there are any conflicts between hard copies and/or electronic copies, the “Original” hard copy will govern.
• Include a cover page with Solicitation Number, Solicitation Title, Prime Contractor Name, Address, Phone Number, Fax Number, DUNS, Cage Code, Point of Contact, Title, phone number, and email address.
Price information contained in the technical proposal will not be considered. Likewise, technical information contained in the price proposal will not be considered.
Factor 1 – Past Performance:
(a) Solicitation Submittal Requirements:
Offerors do not need to provide any information under this factor as the Government will base the evaluation on known past performance on task orders awarded under this Multiple Award Contract (MAC), or, if there is no past performance information available under this MAC, the Government will rely on information from the evaluation for the basic contract award. However, Offerors may provide any information on problems encountered and the corrective actions taken on task orders under this MAC. Offerors may also address any adverse past performance issues under this MAC. Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.
(b) Basis of Evaluation:
This evaluation focuses on how well the Offeror performed on projects under this MAC. More emphasis will be placed on task orders that are more similar to the RFP. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government.
Other sources may include, but are not limited to, past performance information retrieved through the Past
Performance Information Retrieval System (PPIRS), inquiries of owner representative(s), Federal Awardee
Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources.
The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the
Contracting Officer’s responsibility determination. The assessment of the Offeror’s past performance will be used as a means of evaluating the Offeror’s ability to successfully meet the requirements of the RFP.
Offerors lacking past performance information on other task orders under this Multiple Award Contract will not be evaluated favorably or unfavorably in past performance and will receive a Neutral Confidence rating.
Factor 2 – Technical Solution
Offeror shall submit both a narrative describing its proposed technical solution for executing the project in a manner that meets the requirements of the RFP and a basic project schedule. The narrative for Factor 2 – Technical Solution shall not exceed five (5) double-sided pages (or ten (10) single-sided pages). The total page count is comprised of both 8 ½ x 11 inches text pages and 11x17 inches drawings/schedule pages. The narrative shall address all of the following:
- Project management team: Include a description of the proposed team members including (a) offeror’s key personnel; (b) proposed major subcontractors; and (c) their respective experience in executing requirements similar to the RFP. Address how the project management team intends to identify and obtain (either through direct employment or subcontracting) the necessary labor force to execute the requirements of the RFP.
Address how the project management team will ensure sufficient oversight is provided in order to work multiple jobsites concurrently.
- Project schedule: Describe the key elements of your scheduling/phasing plan, to demonstrate understanding of the project requirements. Address at a minimum the ability to complete all the work within the provided timeframe or better. Offerors may propose a shorter duration in their schedule; however, the proposed duration will be incorporated into the contract and liquidated damages shall start the day following the completion date included the Offeror’s proposal. The schedule and narrative should address potential impacts of submittals, reviews, and permits and detail a logical sequence of events to accomplish the scope of work as described in the
RFP. Specifically, describe the means and methods for how you intend to minimize potential delays while installing underground utilities in areas already congested with existing utilities. Include a narrative depicting your plan of action as it relates to coordination with Atlantic Marine Corps Communities (AMCC), as well as with the tenants living aboard the installation.
If the Offeror utilizes experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate an acceptable technical solution under this evaluation factor, the proposal must provide a letter of commitment and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract. Any provided letters will be exempt from the page count.
Price information contained in the technical proposal will not be considered. Likewise, technical information contained in the price proposal will not be considered.
The Government will evaluate the narrative, considering the extent to which the Offeror demonstrates a clear understanding of the architectural and engineering requirements of the project, and capability to fulfill the solicitation requirements, with a focus on the project management team, planned project schedule, and minimization of potential delays. The Government will evaluate the effectiveness of the design-build team's technical solution to determine the likelihood that the work will be performed in accordance with the technical requirements of the RFP.
Price
Offerors shall submit an original and one (1) copy of the price proposal, in separate three-ring binders or folders, which shall include the following:
Cover page that includes:
- Solicitation Number
- Solicitation Title
- Prime Contractor Name
- Prime Contractor Address
- Phone Number
- Fax Number
- DUNS
- Cage Code
- Point of Contact
- Point of Contact Phone No.
- Point of Contact Email
Price Proposal Form
Acknowledged Amendments (if applicable)
Bid Bond
The price proposal shall be submitted separately, but at the same time as the technical proposal. Offerors may ship both the price proposal and the technical proposal in the same shipping container. In the event of discrepancy, the original hard copy will govern. Furthermore, technical information contained in the price proposal will not be considered. Likewise, price information contained in the technical proposal will not be considered.
The Government will evaluate price based on the total lump sum price. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
a. Comparison of proposed prices received in response to the RFP.
b. Comparison of proposed prices with the Independent Government Cost Estimate (IGCE).
c. Comparison of proposed prices with available historical information.
d. Comparison of market survey results.
VI. EVALUATION
1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the proposal determined to represent the best value-the proposal most advantageous to the Government, price and other factors considered.
2. The Government intends to evaluate proposals and award a contract without discussions with offerors
(except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting
Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
3. The tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced offeror or other than the highest technically rated offeror.
4. Technical factor 2 and the performance confidence assessment (past performance) rating, when combined are approximately equal to price in the final best value determination.
5. Any proposal found to have a Deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the Deficiency is corrected through discussions.
Proposals may be found to have either a Significant Weakness or multiple Weaknesses that impact either the individual factor rating or the overall rating for the proposal. The evaluation report must document the evaluation board’s assessment of the identified Weakness(s) and the associated risk to successful contract performance resulting from the Weakness(s). This assessment must provide the rationale for proceeding to award without discussions.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal
Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January
1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to
56 hours of paid sick leave each year. Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate
(weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey.
Example: PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.
5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010
08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.)
should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage
Determinations. Write to:
Branch of Construction Wage Determinations
Wage and Hour Division
U.S. Department of Labor
200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party
(those affected by the action) can request review and reconsideration from the
Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator
U.S. Department of Labor
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage
Appeals Board). Write to:
Administrative Review Board
U.S. Department of Labor
4.) All decisions by the Administrative Review Board are final.
