About this file

This memorandum documents a justification for limiting competition under the simplified acquisition threshold for a federal contract opportunity. The Army Contracting Command - Redstone Arsenal - Corpus Christi Army Depot seeks to award a sole source contract for one Baileigh 112-ton c-frame hydraulic press and one Beckwood elastomeric forming kit installation and on-site training. The estimated value of the contract is $150,000 with a four month delivery time. Market research was conducted from April 2021 to October 2022 and determined these specific brand name items were necessary to meet safety, capacity, and compatibility requirements. The justification cites FAR provisions allowing sole source awards for brand name items under $150,000.

4. Authority:

5. Reasons for Authority Cited: There are two (2) brand name justifications. One brand name is for a Baileigh Industrial CFP-112HD 112-ton C-frame hydraulic press to support the Directorate of Manufacturing Sheet Metal Shop. This particular press satisfies the requirements from safety engineering: ideal safety features: closed on 3 sides, light curtain front safety interlock, 2 hand remote operation pedestal. The CFP-112HD also satisfies facility, and production engineering in terms of floor footprint, weight, pressing tonnage, and bed size. Additionally, as far as the sustainability, the CFP-112HD is standard Commercial Off the Shelf press, and Baileigh Industrial is a high-volume brand with many distributors including direct-to-consumer, so CCAD should not have problems with obtaining repair parts in the future. The second brand name item is a custom designed Beckwood elastomeric forming kit (“tooling”) to accompany a 112-ton C-frame hydraulic press to support the Directorate of Manufacturing Sheet Metal Shop. Beckwood offers ideal safety features, capacity, thoughtful design to rotate forming surfaces and eject worn blocks using the power of the press and is designed specifically to fit in the Baileigh CFP-112HD press.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, apply and will be followed, or do not apply due to an exception at 5.202.

Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A) Action is NOT a brand name restriction and is under $150K, no posting required Action is a brand name restriction, under $25K, no posting required Action is a brand name restriction, over $25K. It will be redacted and posted with the solicitation.

Action is a brand name restriction over $25K but will not be posted due to exception:

7. Market Research: Market research was conducted by Paul – Anthony Benavidez, Equipment Engineer and Terry Clark, Contract Specialist from April 30, 2021 – October 18, 2022.

Personal knowledge in procuring supplies of this type and how knowledge was obtained: On April 5, 2021, Mr. Benavidez met on shop floor to discuss functionality and safety features with Arturo Gomez, Sheetmetal acting supervisor, and John Smith, Safety Engineer. Arturo may not have extensive knowledge of commercial marketplace, but he does have knowledge of elastomeric metal forming.

The results of recent market research review for similar or identical supplies/services. Identify research and date performed: Mr. Benavidez conducted a broad search for hydraulic presses with the main characteristics of flat plates for tooling attachment, enclosed on 3 sides, light curtain safety interlock, and 2 handed operation only led to one machine, however several normal Online retailers sell it.

Review of Government and/or commercial databases for relevant information: Mr. Benavidez conducted other online sources and searched the following: GSA, FedMall, and FEDLOG, 4/26/2021 - Available in GSA Advantage! $57,148.22 (Online Source), 4/26/2021 - Available in FedMall, $68,737.88 "on sale through 13/31/2021"(Online Source) and 4/26/2021 - Check if available in FEDLOG, not available(Online Source).

Discuss other types of Market Research (not mentioned above) and date performed: On 18 October 2022 the Contract Specialist performed market research on the search engine Google and found some small companies that can provide this part as shown on the following link:
