About this file

This document is an email exchange regarding a federal grant opportunity for the Foreign Assistance Leveraged for Cybersecurity Operational Needs (FALCON) project, solicitation number DFOP0016632.

The key details are:

  • The FALCON project, funded by the Department of State under the Cyberspace and Digital Policy grant program (CFDA 19.665), aims to establish and maintain a reservoir of commercial cybersecurity and technology capabilities to support U.S. allies and partners in preventing, responding to, mitigating, and recovering from cybersecurity incidents.
  • The email addresses questions regarding whether non-federal entities can receive fee or profit under this grant, and whether the Department of State would revise the NOFO text prohibiting profit for commercial organizations. The Department of State indicated they would post a revised NOFO to provide clarification, and extended the due date for applications to August 9, 2024.

Hello Ms. Kraske, Please see our answers to your questions below.

Can a non-Federal entity participating in this grant award/cooperative agreement, as either a Recipient or sub-recipient, receive fee or profit? 2 CFR 200 - § 200.400 (g) Policy guide, addresses this question.

“The non-Federal entity may not earn or keep any profit resulting from Federal financial assistance, unless explicitly authorized by the terms and conditions of the Federal award. See also § 200.307.”

If yes, are offerors allowed to tailor the Detailed Budget Template to allow for those costs? Yes.

If yes, could the government revise the following text from C.1 Eligible Applicants from the NOFO, “Additionally, the Department of State prohibits profit to for-profit or commercial organizations under its assistance awards” via a modification. We will post a revised NOFO to provide clarification on this point by COB today.

and please extend the due date to August 13, 2024 for this FALCON NOFO opportunity due to modifications and posting of an updated NOFO? We are only able to extend the due date to August 9, 2024. Thank you for understanding.
