About this file

This document is a Questions and Answers supplement to Invitation to Bid (ITB) S-10700-00015503 issued by the State of Oregon Department of Administrative Services, State Procurement Services on behalf of state agencies and the Oregon Cooperative Procurement Program (ORCPP) for Herbicide Chemicals (Liquid & Dry). The Q&A addresses clarifications regarding bid evaluation criteria, specifically confirming that the "Price List" tab and "Adjuvants" sections will not be considered in award determination, though approved add-ons will be included in the resulting Price Agreement. The solicitation is statewide rather than ODOT-specific, with contract award determined by the lowest evaluation total on pricing for seventeen items listed in the revised Attachment D as outlined in ITB Addendum No. 3. The response date for these questions is February 6, 2026, with the original questions due date being January 29, 2026.

The evaluation and award methodology focuses exclusively on the seventeen line items in the revised Attachment D price form, with one Price Agreement anticipated per geographical region across Oregon's five regions. The current incumbent vendor is Wilber Ellis, which has generated approximately $22.7 million in cumulative spending under the existing contract. Award criteria emphasize compliance with Oregon Pesticide Control Act requirements, pesticide dealer licensing, pricing stability, insurance coverage meeting $2 million thresholds for Commercial General Liability, Professional Liability, and Pollution Liability, and delivery capability. The anticipated contract term is three years with potential extensions, requiring successful contractors to remit a 2 percent Vendor Collected Administrative Fee on gross sales and submit quarterly Volume Sales Reports. Annual economic price adjustments commence May 1, 2027, based on the U.S. Department of Labor Bureau of Labor Statistics Producer Price Index for agricultural chemicals.
