About this file

This Q&A Center Addendum document addresses clarifications for RFQ26006744, a pricing event solicitation issued by the State of Rhode Island's Department of Administration, Division of Purchases, on behalf of the Executive and Judicial Branches, Cities and Towns, and other State entities for retail electricity supply service under the MPA 623 qualified vendor program. The solicitation contains no line items and requires vendors to submit pricing via a completed Exhibit 2 Pricing Form. The collaboration period for vendor questions ran from June 9, 2026 at 3:00 p.m. EDT through June 12, 2026 at 2:00 p.m. EDT, with bids due on June 23, 2026 at 1:00 p.m. EDT. The contract will be awarded on a firm, fixed unit price basis with F.O.B. destination delivery terms and vendor-specified payment terms.

The addendum addresses three key vendor inquiries regarding Renewable Energy Standard (RES) requirements, capacity cost adjustments, and loss adjustments. The State clarified that pricing should be based on current RES requirements rather than the pending FY 2027 Budget changes, advised respondents to follow the existing Renewable Energy Standard specifications for loss adjustments on voluntary REC purchases, and referenced the "Change in Law" section regarding capacity cost disputes while maintaining that no final contract rate changes will be accepted solely due to capacity cost modifications. The State specified that "then-current" capacity costs refer to the baseline year preceding any market changes, with requests for rate adjustments subject to State review but not guaranteed approval. All submissions must be made electronically through Ocean State Procures, and a 0.33% contract administrative fee is withheld by the State at invoice payment.

The Rhode Island General Assembly approved the FY 2027 Budget, which includes changes to RPS requirements, but it has not been signed by the Governor yet.

Does the State expect pricing to include the currently effective mandatory RPS requirements?

Does the State require pricing with the updated RPS requirements from the approved FY 2027 Budget?

If yes, will the State delay the bid until at least two business days after the Governor signs, to give suppliers time to update pricing?

If yes, will the State allow for a price adjustment if the contract is awarded using the FY 2027 RPS changes, and if the RPS changes are further modified or not approved?

Pricing for this RFQ process should be based on the current RES requirements.

The renewable energy standard specifies that

RES requirements are based on retail load

“adjusted for electric line losses”. Can the

State confirm that for the voluntary purchases, they are expecting retired REC volumes to be adjusted for losses as well?

Ex: If the annual usage is 100,000 MWh for a given year, and weighted losses is 5% for the account(s), and the voluntary % is 60%, the state would expect the retired voluntary RECs to be: 100,000 x 60% x 1.05% = 63,000

RECs.

The State advises respondents to follow the specifications and guidance of the

Renewable Energy Standard.

Regarding capacity, the RFP states:

“However, if there is a material, incremental increase in Capacity costs or rates (versus the then-current Capacity costs or rates)…”.

Can the state confirm that the “then-current

Capacity costs or rates” refers to the costs and rates in the year prior (6/1/2027 –

5/31/2028) to the market change beginning

June 2028?

The State believes that "then-current" is already clear.

We are seeking clarification regarding how capacity costs should be priced beyond June

2028.

The State's most recent Q&A response indicates that it "will not unreasonably withhold review, consideration and potential approval of a request for change in rate."

However, this appears to conflict with the solicitation language stating that "No change to the State's final contract rate will be accepted as a result of a change in Capacity costs."

As written, these two provisions are difficult to reconcile, and the Q&A response leaves some ambiguity as to whether a request for rate adjustment due to capacity cost changes could ultimately be denied. Could the State please provide additional clarity on how this should be interpreted and reflected in our pricing?

Please note that this solicitation is separate and distinct from any other solicitation. Refer to Section entitled "Change in Law" (page 6) in this RFQ.
