About this file

This is a Prohibition Against Contingent Fees affidavit required by the Flagler County Board of County Commissioners for the construction of two new hurricane-resilient buildings at the Flagler County Fairgrounds under ITB #26-ITB-019. Bids are due August 17, 2026 at 2:00 p.m., with a mandatory site visit scheduled for July 31, 2026 at 8:00 a.m. The project encompasses all labor, materials, equipment, concrete work, permitting, and site preparation for two structures designed to meet all applicable local, state, and federal building codes and industry standards at 150 Sawgrass Road, Bunnell, Florida 32110. Evaluation criteria include total cost, delivery schedule, past performance based on three references from projects completed within the last three years of similar magnitude, compliance with technical specifications, and financial stability. The County will award to the lowest responsive, responsible bidder with no renewal options.

Each proposal must include a duly signed and notarized affidavit in which the firm warrants that it has not employed or retained any company or person, other than bona fide employees, to solicit or secure the agreement, and that it has not paid or agreed to pay any person, company, corporation, individual, or firm any fee, commission, percentage, gift, or other consideration contingent upon or resulting from the award of this agreement. This requirement complies with Florida Statute 287.055(6)(a). Local vendor preference applies to businesses maintaining a physical location in Flagler County for at least 12 months prior to solicitation issuance, holding required business licenses, and employing at least one full-time or two part-time employees with primary residency in Flagler County. Pricing proposals must remain firm for at least 120 days from solicitation opening and must include FOB Destination pricing with all packing, handling, shipping charges, and delivery to the project site. The County will remit full payment on undisputed invoices within 45 days of receipt, with interest accruing at no more than one percent per month on unpaid invoices under Florida Statute 218.74.
