The award will be made to the lowest responsive, responsible bidder with no renewal options.
By signing the Hold Harmless Agreement, business owners and employees waive and release all workers' compensation claims against Flagler County and agree to indemnify and hold harmless the County from any workers' compensation claims, injuries, deaths, losses, damages, or related liabilities arising from work performed under the contract. Signatories assume all legal costs, attorney fees, and expenses associated with the indemnity. All new employees must be listed with signed waivers and releases provided to the County Project Manager before commencing work; failure to obtain signed releases constitutes material breach. The agreement requires notarization and applies to all listed employees. Pricing proposals must remain firm for 120 days from solicitation opening and include FOB Destination pricing with all packing, handling, shipping, and delivery charges. The County will remit full payment on undisputed invoices within 45 days of receipt, with interest accruing at no more than one percent per month on late payments under Florida Statute 218.74. Local vendor preference applies to businesses maintaining a physical location in Flagler County for at least 12 months prior to solicitation issuance, holding required business licenses, and employing at least one full-time or two part-time employees with primary residency in Flagler County.
