About this file
This is a Performance Bond document required by the County of Orange, California for contractors entering into service agreements with the county. The bond serves as a faithful performance guarantee for the contract between the county and the principal contractor, ensuring compliance with all contractual obligations, covenants, conditions, and agreements. The surety company executing the bond is jointly and severally liable with the contractor for the penal sum specified in the bond, which is calculated at a stated premium rate per thousand dollars of the contract price. The bond remains in effect for the duration of the contract term and any alterations or extensions to the contract terms do not affect the surety's obligations. The surety waives notice of any changes, extensions, alterations, or additions to the contract specifications or work scope. The county retains the right to pursue the bond for recovery of costs, reasonable expenses, and attorney fees incurred in enforcing the obligation, which are taxable as costs and includable in any judgment rendered.
The bond requires notarization of the surety representative's signature with an attached certificate of notarization and must include the surety company name typed or stamped above the signature line. The bond document must be approved by the County's Chief Executive Officer/Risk Management and the Office of the County Counsel prior to execution. For corporate signatories, California Corporations Code section 313 requires either two authorized officers (chairman, president, vice president, secretary, assistant secretary, chief financial officer, or assistant treasurer) or one corporate officer with documented written authority such as a corporate resolution. As applied to the industrial laundry equipment maintenance contract opportunity, this performance bond would be required from the awarded contractor to guarantee faithful performance of the three-year service contract commencing February 22, 2026, with potential renewal for two additional years.
