About this file

This Performance Bond document is a standard surety bond template for Collin County, Texas, establishing the bonding requirements for contractors entering into construction or service contracts with the county. The bond serves as a financial guarantee that the principal contractor will faithfully execute all work in accordance with contract specifications, plans, and documents. The penal sum of the bond must equal no less than 100 percent of the approximate total contract amount plus an additional 10 percent to cover court expenses, attorneys' fees, and liquidated damages. The bond obligates the contractor to repair or replace all defects resulting from faulty materials or workmanship within one year from the date of final completion and acceptance by the owner. The contractor must also fully indemnify the county from all costs and damages resulting from failure to perform, and the county reserves the right to complete any defaulted work and charge associated costs against both the contractor and surety. Venue for any legal action arising from the bond is established in Collin County, Texas.

The bond is executed pursuant to Texas Government Code Chapter 2253 and Texas Insurance Code Chapter 3503, and the surety agrees that the bond automatically increases with any change orders that increase the contract price, though reductions in contract price do not decrease the penal sum. The surety waives notice of any changes, extensions of time, alterations, or additions to the contract terms or work performance. The bond remains in effect throughout the original contract term and the life of any guaranty required under the contract. A resident agent designated by the surety must be identified for receipt of notice and service of process related to the suretyship. The bond date must not precede the contract date, and the document requires execution by authorized representatives of both the principal contractor and surety corporation.
